Attaghed is CA 77-1ZS regarding the rental of buildings at the old
civic confer site:. At the October 3, 1977 Council meeting this matter
was deferred for two reasons:
Mayor Pattinson did not vtant the Junior 'Chamber of Commerce to be
required to enter a lease agreement before November 1, since they
` had not budgeted for rent.

The matter of applying a more restrictive eligibility standard
than that of "non profit organizations" has been considered. If, the Ar

still remains vacant. Councilman Coen's concern was that if the
City had a multitude of applicants for the space, more restrir.tive
criteria 'might be needed to screen the applicants down to a. manageable
dew. However, few agencies have expressed: interest to date so a more
general restriction (such as "non-profit organizations) is recommended �
in; order to obtain full, utiliziotion of these vacant bui.idings4 Council-
man Coen agrees with. .this recommendation.

"CITY", and Catholic Community Agencies
_hereinafter referred to as "LESSEE".
W I T N E S S E T H:
WHEREAS, the CITY owns certain improved real property
located in the vicinity of Main and: Pecan Streets in the City
of _Huntington Beach, said property formerly used for City Hail
purposes, and

2. TERM
The term of this lease shall be month to month.
3. RENT
The rent shall be payable on or before the 10th day of each
month, at the rate of $83.39 per month. All rent not paid
within ten (10) days of due date shall include a 10% penalty.
4. MAINTENANCE
CITY shall maintain the exterior of the structure, including
the grounds of the !eased premises, and LESSEE shall maintain
the interior of the leased premises. If LESSEE fails t<
maintain the Interior of the leased pr:-amises, the CITY may, at
its option, perform necessary maintenance and bill LESSEE for
the cost of the service rendered. LESSEE shall reimburse CITY l
for the cost cf the serv'ces within tern {10} days after reeeiDt
of billing.
5. INDEMNIFY, DEFEND, SASE HARMLESS
During the term of this lease, LESSEE agrees to indemnify and
defend and save CITY harmless from any ar4 all claims arising
from any act, omission or negligence of LESSEE or its
contractors, sublessees, licensees, agents, servants, or
employees arising from any accident, injury, or damage
whatsoever caused to any person_ or =roperty occurring in, on,
or -,bout the leased premises,and from and against all costs,

expenses and liaoilities incurred in or in connection with any
!� such claim or proceeding brought thereon. LESSEE shall obtain
for the entire term of this lease, minimum insu.^ance liability
limits as follows: Combined Single Limit Bodily Injury and/or
Property Damage including Products Liability of Three Hundred
Thousand Dollars ($300,000), Said insurance shall include the
I City Council, all City -appointed groups, committees, boards and
commissions, and all elective and appointive officers, servants
or employees of CITY as named additional insureds under such
policy. LESSEE shall provide CITY with a certificate of
insurance on a form approved and provided bar CITY. Such
insurance shall be primary to any insurance CITY has in effect.
6. ALTFR W IONS
During the term of this lease, LESSEE shall not make any
alterations to the leased premises without the written consent
of CITY.
7 UTLITIES
CITY agrees to pay all utility bills applicable to the leased
premises during the term of the lease, except telephone service
shall be separately charged to and the sole responsibility of

LESSEE shall pay any taxes assessed on its personal property
located in the leased premises, , and shall pay, if assessed, an
aliquot portion of any possessory interest taxes on the
premises.
13. TERMINATION NOTICE
Either party may terminate this lease by giving thirty (30)
days written notice to the other party.
14. PARKING
LESSEE shall have the right of reasonable access to off -::street
parking included with the leased premises.
15. JANITORIAL SERVICES
CITY shall provide basic janitorial services during the term of

THIS LEASE is made and entered into this 27th day of

W I T N E S S E T H:
WHEREAS, the CITY owns certain improved real property
located in the vicinity of Main and Pecan Streets in the City o
Huntington Beach, said property formerly used for City Hall pur
ooses; and
Said property is not presently needed for CITY purposes
and the CITY desires to le .so said. property;
NOW, THERE -FORE, IN CONSIDERATION OF T%E MUTUAL COVENANTS
AND PROMISE.3 OF THE PARTIES HERETO, IT IS HEREBY AGREED by
and between them as follows
1. CITY hereby leases to LESSEE, on the terms and con-
ditions set forth herein, a portion of the premises formerly
used for City Hall purpose',, specifically described as follows;
six rooms in the .northwest corner of the old civic center totalling
776 square feet
all of which said premises are set forth ,in the plan marked
Exhibit "A" and attached hereto and incorporated herein by
reference.

2. The term of this lease shall be for a period of one
year , commencing on October 1, 1977
3. The rent shall be the stun of $2, 886. 72 _
pFyable on or before the 10th day of each month, at the rate of
$240.56 per month. All rent not paid within ten (10) days
of due date shall include a 10% penalty.
4. CITY shall maintain the exterior of the structure,
including the grounds of the leased premises, and LESSEE shall
maintain the interior of the leased premises. If LESSEE fails
to maintain the interior of the leased premises, the CITY may., at
its option, perform necessary maintenance and bill LESSEE for the
cost of the service rendered. LESSEE shall reimburse CITY for the
ccsi, of the sey vices within ten (10) days after receipt of bi aing.
5. During the term of this lease, LESSEE agrees to indem-
reify and defend and save CITY harmless from any and all claims
f�f arising from any act, OM-4S3ion or negligence of LESSEE or it; con-

arising from any accident, injury, or damage whatsoever caused
f to any person or property occu°ring in, on, or about the leased
premises, and from and against all costs, expenses and liabil'_ties
incurred in or in connection with any such claim or pr•oceedin
brought thereon. LESSEE shall obtain for the entire term of this
lease, minimum insurance liability limits as follows: Cozfbined
Single Limit Bodily Injury and/or Property Damage including Pro-
e ducts. Liability of Three Hundred Thousand Dollars ($300,000).

Said insurance shall include the City Council, all City -appointed
groups, committees, boards and commissions, and all elective and
appointive officers, servants or employees of CITY as named addi-
tional insureds under such policy. LESSEE shall provide CITY
with a certificate of insurance on a form approved and provided
by CITY. Such insurance shall be primary to any insurance CI`PY
has in effect.
6. Durir,g the term of thi; lease, LESSEE shall not make
any alterations to the leased premises without the kriGten con-
sent of CITY.
7. CI12Y agrees to pay all utility bills applicablq to the
leased premises during the term of the lease, except telephone
service shall be separately charged to and the sole responsibility
of LESSEE
8. LESSEE shall not assign the lease or sublet the premises

STATEMENT OF ISSUE:
The Catholic Social Service wishes to reduce its office space at the old
City Hall, 520 Pecan.
RECOMMENDATION:
Approve the attached lease agreement.
ANALYSIS:
Various social service agencies rent space at the old City Hall, 520 Pecan.
Due: to Proposition 13, the Catholic Social Service has lost a counseling
grant and must reduce its office space.
All tenants are currently paying ,a rental rate of ,$0.31 per square foot as
provided for in Resolution 4535. The results of a bid for a new main-
tenance contract have not yet been received. If our costs increase, it
may be necessary to change the resolution and increase the rental rate
at that time.
FUNDING SOURCE
No funds are necessary.

Statement of Problem:
Attached is CA 77-125 regarding the rental of buildings at the old
civic center site. At the October 3, 1977 Council meeting this matter
was deferred for two reasons:
1. Mayor Pattinson did not want L"Le Junior Chamber of Commerce to be
required to enter a lease agreement before November 1 since they
had not budgeted for rent.
2. Councilman Coen asked if a more restrictive eligibility standard
should be used than that of "non-profit organizations."
Recommended Action
1. Adopt the attached resolution which establishes a policy for
rental of the'old civic center as follows:
a) Tenants shall be restricted to non-profit organizations
b) A rental rate of'$0..31 per square foot shall apply to the
Community Services Center Building and to the top .floor
of the old fire station.
c) A rental rate of $0.06 per square foot shall apply to the
Administrative annex.
2. Approve and execute the attached agreements with the following
agencies:
a) Youth Service Program
b) Catholic Ccrimunity Agencies
c) Legal Aid Society
Analysis:
The policy resolution does not require that the Jaycees pay rent
immediately; it only establishes what the rental rate will be This
can be adopted without requiring that the Junior Chamber of Commerce

immediately begin payment. A lease agreement has been prepared
for the Jaycees which will be effective November 1, 1977. As the
contract does not require payment in advance, they will have until
December 10, 1977 to pay their first month's rent. The president
is taking it to the membership for approval and it will be on the
agenda of the November 7 Council meeting.
The matter of applying a more restrictive eligibility standard
than that of "non profit.: organizations" has been considered. If the
attached lease agreements are approved, 61% of the available space
still remains vacant. Councilman Coen's concern was that if the
City had a multitude of applicants for the space, more restrictive
criteria might be needed to screen the applicantsdown to a manageable
fees. however, few agencies have expressed interest to date so a more
general restriction (such as "non-profit organizations) is recommended
in order to obtain full utilization of these vacant buildings. Council-
man Coen agreeswiththis recommendation.

0 The Youth Service Program requests rental space in the Community Service
Center for an employment program for referred juveniles beginning October 1,
1977. The rental space requested is 269 feet at 31t a square foot, totaling
83.39 monthly. This project is an extension of existing services to juveniles
referred by police for diversion services. The Youth Service Program is sup-
ported by a Law Enforcement Assistance. Admlaistration Grant to which the City
of Huntington Beach contributes financially.
The Youth Service Program has been located in the Huntington Beach Police
Department for four years; however, additional housing for the employment pro_
gram is not available at this site. The Youth Employment Program is being
initiated with the cooperation of the Huntington Beach Employment and Training
Administration for referred juveniles requiring intense employment preparation,
placement, and follow-up.

OF HUNTINGTON:BEACH ADOPTING A UNIFORM POLICY
FOR THE PURPOSE OF LEASING CITY -OWNED IMPROVED
REAL PROPERTY
WHEREAS, the City ofHuntington Beach has certain unproved
real property, located in the vicinity of Main, Fifth and Pecan
Streets in the city of Huntington Beach, which property was
.formerly used for city hall purposes (herein called "said
property"); and
Said property is not presently needed for city purposes
and city desires to lease said property; and
The city desires to adopt a uniform policy for leasing of
said property,
NOW, THEREFORE, DE IT RESOLVED by the City Council of the
City of Huntington Beach that it does hereby adopt the following
leasing policy for said property:.
1. apace in said property shall be leased to nonprofit
organizations only.
2. For the top floor of the building, located at 505 Fifth
Street (corner of Fifth and Pecan Streets), and the building at
