C O N T R A C T
THIS. AGREEMENT. made and entered into on the 15th
day, of : 'Seprember , 19 80 , by and between the CITY of
HUNTINGTON BEACH, a municipal corporation, her,einafter referred
to as CITY,. and Christeve Corporation
hereinafter referred to as CONTRACTOR,
RECITALS:
WHEREAS, in accordance with the provisions of California
Labor Code section 1773, the Director of the Department of In-
dustrial Relations shall determine the general prevailing rate of
wages applicable to the work covered by the contract; copies of
the latest general prevailing wage determinations are on file in
the office of the City Clerk and made a part hereof. The sup-
plementary conditions attached hereto are part of this contract
and incorporated herein; and
The City Council of the City of Huntington Beach, County
of Orange, State of. California, pursuant to statutes in such cases
made and provided, duly and regularly caused a notice to be pub-
lished calling for bids for labor, material, tools and equipment
for the construction of the York town/Wo rches ter storm drain and storm drain
inlets at Freeborn and Edwards, Garfield and Newland, and Adams and Huntington
in the City of Huntington beach, California - Project CC-509.
in said city of Huntington Beach, California, said ti,r,:)rk to be con-
structed according to plans, specifications, and special provisions
for same on file in the office of the Director of Public Works and
adopted by the City Council of the City of Huntington Beach on the
4th day of August , 19 80 , and reference is hereby made
to such plans, specifications, and special provisions and by such
reference incorporated as though set out in full herein; and
The City Council at a regular meeting thereof and at
the time and place appointed therefor received the report of the
results of the bids submitted by the respective bidders for the
construction and completion of the above -mentioned work, and after
careful consideration of all bids submitted to the City Council,
awarded the contract therefor to the contractor therein named at
the prices set forth in his bid, it being the lowest and best bid

received by the said City Council,
NOW, THEREFORE, in consideration of the covenants and
agreements herein contained, being done and performed by the
parties hereto, it is hereby agreed as follows:
1. By my signature hereunder as CONTRACTOR, I certify
that I am aware of the provisions of California Labor Code section
3706 which requires every employer to be insured against liability
for workers' compensation or to undertake self-insurance in accord-
ance with the provisions of that code, and I will comply with such
provisions before commencing the performance of the work of this
contract.
2. CONTRACTOR agrees to receive and accept as full com-
pensation for furnishing all materials and for doing all the work
contemplated and embraced in this agreement, the unit prices
CONTRACTOR submitted in his proposal which was accepted by the City
Council. A copy of said proposal is attached hereto and incor-
porated herein by reference and made a part hereof. C014TRACTOR
further agrees that said payment by CITY shall include all pay-
ments for all loss or damage arising out of the nature of the work
aforesaid, or from the action of the elements, or from any un-
foreseen difficulties or obstructions which may arise or be en-
countered in the prosecution of the work until its acceptance by
CITY, and for all risks of every description connected with the
work; also for all expenses incurred by or in consequence of the
suspension or discontinuance of work and for well and faithfully
completing the work, and the whole thereof, in the manner and ac-
cording to the plans and specifications, and the requirements of
the engineer under them.
3. CITY agrees with said CONTRACTOR to employ, and does
hereby employ, the said CONTRACTOR to provide the materials and to
do the work according to .the terms and conditions herein containers
and referred to, for the prices aforesaid, and hereby contracts to
pay the same at the time, in the manner and upon the conditions set
forth in the special provisions and the said parties for them-
selves, their heirs, executors, administrators, successors and as-
signs, do hereby agree to the full performance of the covenants
herein contained for the contract bid amount of $178,125.90
One hundredspyen y eight thousand dollars, one hundred twenty five and no/100
which amount is subject to adjustment upward or downward depondent
upon in -place quantity where applicable.
4. It is further expressly agreed by and between the
parties hereto that should there be any conflict between the terms

5. Bid Bond. CONTRACTOR further agrees that his pro-
posal shall be accompanied by a bidder'.s security in an amount
equal, to 10 percent of his bid in accordance with California
Government Code sections 37931 et seq.
6. Bonds. The bond or bonds, required to be furnished
to CITY under this contract covering CONTRACTOR'S faithful per-
formance, the cost of labor and materials expended, and CONTRACTOR'S
one-y'ear warranty must be furnished to and accepted by CITY prior
L. commencement of any work hereunder. All bonds must be in the
amount stated in the special provisions incorpot,ated herein, and in
such form as is acceptable to the City Attorney.
7. Warranty. All wot,k performed in accordance with
these plans, standard specifications, and special provisions in-
cluding, but not limited to, workmanship, installation, fabrica-
tions, material and structural, mechanical, or electrical facili-
ties shall be warranted for a period of one year commencing with
the filing of the notice of completion and acceptance of the con-
tract by CITY unless specific areas are to be warranted longer as
provided in special provisions.
Security for such warranty may be provided as part
of the .faithful performance bond or by a separate bond and shall
be in the full amount of the performance bond. Release of the
performance bond shall not release the warranty portion of the
bond or the separate warranty bond.
CONTRACTOR, within ten (10) days after notification
of a defect warranted hereunder, will either make appropriate re-
pairs, replace the defective item or items or show reasonable
cause as to reason for his Jelay, and refusal or failure to com-
ply will cause CITY to file claim against the bond.
8. Californi - Fair Employment ment Practice Act. CONTRACTOR
agrees to utilize fair employment practices in accordance with

RESOLVED: That any. bond, undertaking, recognizance, consent of surety or written obligation in the nature
thereof shall be valid and, binding upon the Company when signed by the President or any Senior Vice President
or Vice President and duly attested and sealed, if a seal is required, by any Secretary or Assistant Secretary or
when signed by the President or any Senior Vice President or Vice President and countersigned and sealed. if
a seal is required, by a duly authorized attorney -in -fact or agent; and any such bond, undertaking, recognizance,
consent of surety or written obligation in the nature thereof shall be valid and binding upon the Company when
duly executed and sealed, if a seal is required, by one or more attorneys -in -fact or agents pursuant to and
within the limits of the authority granted by his or their power or powers of attorney.
FURTHER RESOLVED: That the signature of any officer authorized by the by-laws and the Company seal
may be affixed by facsimile to any power of attorney or special power of attorney or certification of either
given for the execution of any bond, undertaking, recognizance or other written obligation in the nature there-
of: such signature and seal, when so used being hereby adopted by the Company as the original signature of
such officer and the original seal of the Company, to be valid and binding upon the Company with the same

held a Special Meeting at 233 Longley Way, Arcadia, California on April 1,
1977, at 10:a.m. The following were present, being all members of the
Board: Michael P. Mitrovich; Olga Mitrovich; and Mila Miller.

and Edwards, Garfield and Newland, and Adams and Huntington in the City of
Huntington Beach, California -.Project CC-509. The Contract was awa;•ded to
your firm at the regular meeting of the City Council held Monday,
September 15, 1980.
Will you kindly execute the contracts and have all signatures notarized an
all copies and return to this.office, together with the Labor and Materials
Bond equal to fifty.percent (50%) and Performance Bond in the amount of one
hundred percent (100%) of the contrart price.
A guarantee for the project shall be furnished to the City and may be in-
cluded as part of the Faithful. Performance Bond. There shall be express
wording in the Performance Bond if such bond includes the guarantee or
warranty of the Labor and Materials for a one year period commencing with
the filing of the Notice of Comrletion and acceptance of the contract by
the City. The guarantee amount shall be for the full imount of the Perfor-
mance Bond. Release of the Performance Bond shall not apply to the guarantee
and warranty period.
Also enclosed are two sets of a Certificate of Ins urarice in quadruplicate.
This insurance form is the only one that will be accepted by the City of
Huntington Beach. Please return one set with the bonds and executed
contracts.
Following approval of the bonds and insurance, the City will execute the
contract and return a copy to you.

Statement of Issue:
On August 4, 1980, the City Council authorized a call for bids for the
Yorktown/Worchester storm drain and other drainage inlets at Edwards
and Freeborn, Garfield ai;%: Newland, and Adams and Huntington.
Recommended Action:
Accept the low bid and award the contract to Christeve Corporation, P.O.
Box N-1, Arcadia, CA 91006, in the amount of $178,125.00 and reject
all other bids.

Notice is hereby given that: the City Council of the City of
Huntington'Beach, California will receive sealed bids for the con-
struction of the Yorktown/Worchester storm drain and storm drain
in'lets.at Freeborn and Edwards, Garfield and Newland, and Adams and
Huntington in the City of Huntington Beach, California in accordance
with the plans and specifications and special provisions on file in
the office of the Director of Public Works. Documents will be avail-
able on August 20, 1980. A charge of $10.00, not refunable, will be
required for each set of spe,-A fications and accompanying drawings.

In accordance with the provisions of Section-1773 of the Labor
Code, the State of California, Director of the Department of Indus-
trial Relations shall determine the general prevailing rate of wages,
applicable to the work to be done; copies of the latest general wage
rate determinations are on file at the office of the City Clerk and
the office of the Director of Public Works of the City of Huntington
Beach, California.
Plans and specifications, together with proposal form, may be
obtained at the office of the Director of Public Works, City Hall,
Huntington Beach, Cs'.-ifornia.

No bid will be received unless it is made. on a blank form furnished
by the Director of Public Works. The special attention of prospective
bidders is called to the proposal requirements, setforth in the speci-
fications, for full directions as to the bidding.
The foregoing quantities are approximate only, being given as a
basis for the compairson of bids, and the C-ty of Huntington Beach
does not express or by implications agree that the actual ,amount of
work will correspond therewith but reserves the right to increase or
decrease the amount of any class or portion of the work, as may be
deerr:ad necessary or expedient :ay the Director of Public Works.
All bids will be compared on the basis of the Director of Public
Works estimate of the quantities of work to be done.
No bid will be accepted from a contractor who is not licensed in
accordance with the law, California Business and Professions Code,
Division 3, Chapter 9, Contractors, or to whom a proposal form has
not been issued by the City of Huntington Beach.
Each bid shall be made out on a form to be obtained at the office
of the Director of Public Works, Development t4ing, 2000 Hain Street,
Huntington Beach, California- shall be sealed and filed with the City
Clerk at the Civic Center, Second Floor Administration Building, 2000
I -lain Street, Huntington Beach, California, on or before 10:00 AM of
September 4, 1980, and shall be opened by a committee composed of the
City Clerk, the City Attorney and Director of Public Works or their
authorized representative and the results of said bidding will be
reported -to the City Council of said Ciuy of Huntington Beach at their
regular meeting to be held on Monday, the 15th of September, 1980, at
the hour of 7:30 PM in the City Council ChamberL in the Civic Center
of said City of. Huntington Beach, and shall be acted upon by said City
Council at the regular meeting of September 15, 1980.

Statement of Issue:
All of the above areas have a history of flooding. The construction of drainage systems
in these areas is propose to alleviate the existing problems.
Recnericed '11,
Action:
Approve the plans, specifications and Negative Declaration No. 80-4 and authorize the
call for bids to construct the drainage systems.
Analysis:
The existing storm drain system in the Yorktcywn Ave./Worchester Ln. area is presently in-
adequate.. Several homes on C-brchester Ln. have experienced .flooding in recent years.
An apparent reason for this is property fronting on Beach Blvd. which lies adjacent to the
htfn::j, on Worchester Ln. , drains to the east directly tcxaard the hares on Worchester Lane.
It is proposed that a storm drain system of increased capacity be constructed to alleviate
the existing problem of flooding and provide adequate drainage for rossible future develop-
ment of properties fronting Beach Blvd.
The, construction of drain inlets in the ether areas mentioned will eliminate the problem of
ponding nuisance water due to ground subsidence. The problem occurs throughout the year
and originates from sources such as rainfall, lawn sprinkling, car washing,, etc. The
present method of alleviating the problem is to have a City vacuum truck ranove the ponded
water as citizen complaints are received. Since this is a very expensive maintenance
operation, it is proposed that drain inlets be constructed to receive and convey water to
existing storm drains.
The City 's Environmental Review Committee has recamnded the granting of Negative Declara-
tion 80-4 for the Yorkta4n/tbrehester storm drain and the Planning C emission found the
project to be in conformance with the City's General Plan on Feb. 5, 1980. There is a
categorical exeanption on the construction of the three drainage inlets.
Alternatives:
If. there is no project, parts of the surrounding tributary, drainage in the Yorktown/
Worchester arei will be without an adequate storm drain sy:item and will be susceptible to
the flooding that presently occurs. We will also continue to receive citizen complaints
from all the subject areas.
Funding Source:
The, project is estimated to cost $1801000 and will be financed from Gas Tax and drainage
plgi icts.
