LEAST AGREEMENT
THIS AGREEMENT is entered into this Ist day of
June 1981 by and between the City of Huntington
Beach, a municipal corporation, as Lessor, hereinafter referred -
to as "CITY" and CHURCH BY THE SEAL a California, non-profi corp.,
as Lessee, hereinafter referred to as "TENANT."
WHEREAS, CITY owns and is in possession of that certain
office building known as and located at 220 Pain Street,
Huntington Beach, California, the interior of which consists of
approximately 1,200 square feet and includes five parking spaces
in the rear thereof; and
WHEREAS, CITY has no present use or need of said build-
ing; and
WHEREAS, said building is in a desirable location for
the purposes of the commercial use thereof and ,,represents a poten-
tial source of revenue, and CITY desires to enter into a commercial
lease therefor;
NOW, THEREFORE, the parties hereby agree as follows
1.. DESCRIPTION OF PREMISES CITY hereby leases under
terms and conditions set forth herein the office building located
at 220 Main Street, Huntington. Beach, California, to TENANT and
TENANT accepts premises.
2. TERM. The term of this lease shall be for a period

of one (1) year from the date set forth hereinabove.
Upon thirty (30) days written notice by TENANT to
CITY, prior to the end of the lease term, th tenancy mp.y con-
tinue on a month -to -month basis from and after the da:.,e e,f termi-
nation of this lease. Any month -to -month tenancy shall be sub-
ject to all the provisions of this agreement.

tenancy upon thirty (30) days prior written notice to the oti�er
party.
3. RENT: Monthly rental shall be $600 due and payable
in advance on the first day of each month. If rent is not paid
on or before the tenth day of each month, a 10 percent penalty
shall be applicable. TENANT will pay any possessory interest tax
asses,�ed.
4. SECURITY DEPOSITS: TENANT shall pay the first and
last months rent upon execution of this lease. In addition
thereto, TENANT shall pay the sum of $300 as a security deposit
for the performance of the conditions of this lease. If at any

conditions of the lease or causes damage to the premises or fails
to leave the dwelling .in a rea onably clean condition upon termi-
nation, then CITY may appropriate and apply any portion of the
security necessary to make < the repairs or clean the premises.
5. MAINTENANCE: TENANT shall maintain premises-in-
cl.uding landsdaping in good condition. If TENANT fails to main

tain the premises, CITY may, at its option, perform necessary
maintenance and bill TENANT for the cost of services rendered,
and TENANT shall eimburse CITY for the cost thereof within ten
(10) days after rec 'Dt of billing.
6. UTILITIES CITY shall pay for water only at the
leased premises. TENANT shall pay for all other utilities at the
subject premises:
7. INDEMNIFICATION; During the term of this tenancy,
TENANT agrees to indemnify*, defend, and save CITY harmless from
any and all claims arising from any act, omission or negligence of
TENANT or his agents or employees arising from any accident, in-
jury or damage whatsoever caused. to any person or property oc-
curring in, on or about the leased premises, and from any and all
cost, expense, or liability incurred in connection with any such
claim or proceeding.
8 ALTERATIONS DURING TERM OF TENANCY: TENANT :,hall
not make any alterations to the pre,'ses without the written con-
sent of CITY.
9. ASSIGNMENT, REENTRY: TENANT shell not assign the
lease or sublet the premises except with the written permission
of CITY, and CITY expressly reserves the right of reentry for
any violation of this section or other conditions of this leas,,
and CITY reserves the right to reenter and inspect the premises
at all reasonable times.
10. INSURANCE: TENANT agrees to ,furnish to CITY and

maintain in force until termination of this tenancy a general
liability Certificate of insurance in which CITY is named as an
additional insured. Such certificate of insurance shall indicate
insurance coverage for TENANT, its officers and employees, while
acting within the scope of their duties, against all claims arising
out of or in connection with TENANT'S activities on or about the
leased premises. The policy shall provide for not less than the
following amounts: combined single limit bodily injury and/or
property damage of $300,000 per occurrence.

STATEMENT OF ISSUE
Church by the Sea has submitted a letter of intent to lease an
unoccupied city-owns-4 building' located at 220 Main Street for one
year with a thirty -day cancellat—Lon clause by either party,
RECOMMENDATION
Approve the agreement with Church by the Sea for use of 220 Main Street
to conduct Bible studies and authorize Mayor to execute same.
ANALYSIS
The office building at 220 Main Street was originally used for the
downtown redevelopment program. The facility was vacant from late
1976 until it was rented in February, 1980, to a sportswear company.
After one year, the tenants, E,G, & Sonia Mittelstedt, sent formal
notification that they would no longer be occupying the premises.
The Church by the Sea has expressed interest in renting .ne facility
for $600-per month for thepurposeof conducting Bible studies. The
City Attorney's Office has prepared the attached lease agreement and
the proposed tenants have met all city insurance requirements. The
monthly rent of $600 per month or 5U per square foot was recommended
by the City's Real Property Agent. This amount was based on existing
rentals in the downtown area which range from 35d to 20� per square
foot
