HomeMy WebLinkAboutCity of Fountain Valley - 1963-01-01AGREEMENT THIS AGREEMENT is made and entered into by and between the City of Huntington Beach, a Municipal Corporation and City of Fountain Valley, a Municipal Corporation. RECITALS: The City of Huntington Beach and the City of Fountain Valley have coordinated their storm drain construction in such a manner as to be mutually beneficial to each City. The City of Huntington Beach has acquired right-of-way and excavated an ultimate storm drain channel for the first leg of the proposed East Valley Channel. The City of Huntington Beach has constructed temporary storm drain culverts underneath Bushard Street. The City of Fountain Valley has purchased right-of-way for the second leg of the storm drain channel for 1320 feet from Garfield southerly. Contractors for the City of Fountain Valley shall construct the second leg of the channel from Garfield 1320 feet southerly. City of Fountain Valley recognizes the inability of present structures at Bushard Street in the City of Huntington Beach to transmit the run-off that could ultimately be delivered to that point. The parties hereto desire to enter into this Agreement and do agree as follows: 1. The City of Fountain Valley agrees to accept the responsibility of constructing an ultimate Reinforced Concrete box culvert from right-of-way to right-of-way and transitions at Bushard Street to replace the present temporary facilities. 2. The City of Fountain Valley agrees to perform said con- struction at such time as the land developed for housing, commercial, -1- industrial or other improved uses within the City of Fountain Valley which is contributary to this drainage channel exceeds 250 acres. 3. The City of Huntington Beach and the City of Fountain Valley shall jointly share in the maintenance of the section of this East Valley Flood Control Channel from a point 1200 feet South of Garfield to Garfield Avenue. 4. The maintenance services to be performed by the City of Fountain Valley shall be a semi-annual removal of weed growth including the costs of acquiring and spraying of chemicals and sterilents as necessary to keep the channel in a well maintained condition. 5. The City of Fountain Valley will grant to the City of Huntington Beach whatever rights are necessary for and pertinent to the performance of necessary repair work and for restoration of flow. Per the terms of the agreement the City of Fountain Valley agrees to construct a reinforced concrete structure at Bushard Street at such time as necessary. The City of Huntington Beach per the agreement is being obligated. to share only in the maintenance of a section of the flood control channel. The City of Fountain Valley requested, by a letter dated March 21, 1963, the cooperation of this city to obtain necessary right of way for the channel within Huntington Beach, This right of way has been obtained and construction has commenced. The agreement has been approved for form by the City Attorney's office. It is the recommendation of this office that the agreement be approved.
