Statement of Issue:
Need for agreement with the City of Westrinster regarding the improvement/
modification of the traffic signals at Goldenwest Street and McFadden by
adding lEft turn phases.
Recommendation:
Approve the execution of an agreement with the City of Westminster providing
for the modification of the existing traffic signals at Goldenwest Street
and McFadden Avenue. Authorize the Director of Public Works to prepare
plans, specifications, and estimates for the work and to advertise for bids
in accordance with the terms and conditionF of the agreement.
Analysis:
Early in 1977, citizens contacted the staff members of both cities concerning

the conditions at the subject intersection. Sile City of Westminster request-

4-28-78 Agreement executed by Westminster, forwarded to City Clerk
for action by Huntington Beach.
The project will provide new traffic signal poles, signals, detectors,
and a replacement controller. Street lighting will also be improved.
The estimate for the work is $40,000.00. The cost would be divided by
the two agencies as follows:
Westminster 42% $16,800 estimated
Huntington Dea�.-h 58% $23,200 estimated
Alternative Actions:
The alternatives available a:�e as follows:
1. No action - retain existing traffic signal system; deny execution
of agreement.
2. Modify agreement and return to Westminster for concurrence and
and approval.
Funding Source:
The funding for this project is provided from the Gas Tax Fund.

Subject: Goldenwest and McFadden
Gentlemen:
The turning movement counts that were made at this inter-
section indicated that left -turn phases aze warranted. The
additional phases can be provided by installing a new controller
and cabinet and replacing the existing signal poles with the long
mast arm poles (type 26A). The estimated cost of accomplishing
this work is $35,000 wh-'ch could be shared in the same proportion
as the exiscing agreement for maintenance; that is, 42% by -the
City of Westminster and 58% by Huntington Beach.
We have included a copy of the agreement which was executed
by our City and Fountain Valley for a similar project. If this
agreement appears satisfactory, in cnncept, we will prepare the
agreement for review by your City.
Funding.for this project should he scheduled for the 1977-78
budget year. Please let us know if information is sufficient
for your needs. If additional information is desirable, feel free
to call Ralph Leyva (536-5525) of the Traffic Engineering Division.

Street and McFadden Avenue
The City Council, at its regular meeting of A.pril 25, 1978
approved an agreement between the City of Westminster and
the City of Huntington Beach to modify the traffic signal
at Goldenwest Street and McFadden Avenue to provide a left
turn signal for Goldenwest Street and authorized the Mayor
and City Clerk to execute the agreement on behalf of the
City.
This agreement sets forth the.t the City of Huntington Beach
shall prepare the plans and specifications for this project
and after approval by the City of Westminster, Huntington
Beach shall advertise for bids with Westminster bearing
42� of the total cost of this project.
We are enclosing two copies of this agreement which have
been executed by the Ci'y of Westminster. We would appreci-
ate receiving o'-ie fullY executed copy when it has been
signed by the Meyor and City Clark of the City of Huntington
Beach.

THIS AGREEMENT by and between CITY OF WESTMINSTER, a
municipal corporation of the State of California, hereinafter
called '%TSTMINSTER1' and the CITY OF HUNTINGTON BEACH, a muni-
cipal corporation oI- the State of California, hereinafter
called "HUNTINGTON BEACH".

WHEREAS, the intersectioE Goldenwest Street and
McFadden AvDnue lies on a mutu&� corporate boundary line oi
the cities of Huntington Beach and Westminster: and
Engineering studies indicate that upgrading of the traffic
signal is warranted at the above named intersection for improved
traffic safety and efficie-qc7, and
WHEREAS, it is agreed between the cities that modification
of the traffic signal would be mutually beneficial and improve
traffic: safety in both cities,
NOW, THERBFORE, in consideration of the covenants and
conditions herein contained, the parties hereto agree as follows:
1. Ifuntington Beach shall prepare plans and specifications
for the modification of a traffic system at the intersection of
Goldenwest Str3et and McFadden Avenue, to include left turn phases
for Goldenwest Street.
2. Westminster shall have the right of approval of such
plans.
3. After approval by Westminster, Huntington Beach shall
advertise for bids, pursuant to State law.
4. Huntington Beach Engineering Department shall super-
vise the performance of said work.
S. The cost of the modification of the traffic signal
system shall be paid by the parties hereto as follows:
Westminster 42%
Huntington Beach 5896
6. Westminster will pay its proportionate share within
thirty (30) days after notice of completion of the construction
contract.
7. Huntington Beach will require the contractor who
receives the bid to keep an exact accounting of the expenditures
on the project.
8. Huntington Beach shall not Jissue any contract change
orders without first having obtained approval from the Director
of Community Development of the City of Westminster.
9. Upon completion of the modification of the traffic
signal system at the intersection of Goldenwest Street and
McFadden Avenue, the maintenance of said system shall be per-
formed by or under tl.�.; direction of Huntington Beach. The cost
of said maintenance shall be proport.-Loned between the parties
hereto as follows:

10. Any controversy or claim arising out of or related
to this Agreen.ent or to the interpretation, breach or er-force-
ment thereof shall be submitted to three (3) qrbitrators, one
being the Assistant Pirector, Development, E.N,.A., County of
Orange, or an engineer member of his staff, and the remaining
two (2) to be rhosen by the respective cities or by ar. engineer
associated with the Public Works Department of a municipality.
Any decision made by the iftajority of said arbitrators shall be
final, binding and not appealable.
11. Each party hereto pledges its full faith and credit
to pass said necessary resolution and take proper legal steps
to periorm and to effect this Agreement
