In the event of a pipeline rupture there is no way to pro- vide water to this area of the City east of the San Diego Freeway. Recommendation: Authorize the Mayor and City Clerk to execute an Agreement with the City of Westminster. Analysis : To install an emergency water supply inter-connection between the City of Westminster and Huntington Beach on Sugar Drive in Huntington Beach. Funding: $4 , 000. 00 from transmission and Distribution Mains Account, cost will be shared by each City. Alternative Action: Deny approval of Agreement. CWT:PEC:ek Attachment WATER LINE INTERCONNECTION AGREEMENT THIS AGREEMENT, made and entered into by and between the CITY OF WESTMINSTER, a municipal corporation, hereinafter referred to as WESTMINSTER" , and the CITY OF HUNTINGTON BEACH, a municipal corporation, hereinafter referred to as "HUNTINGTON BEACH" , and collectively referred to as CITIES : W I T N E S S E T H: WHEREAS, there is presently a need to have an emergency water supply interconnection between WESTMINSTER and HUNTINGTON BEACH and both of said CITIES have water lines in Sugar Drive, and said CITIES have made the interconnection of such lines for said emergency water supply; NOW, THEREFORE, IT IS AGREED AS FOLLOWS : 1. MAINTENANCE OF THE INTERCONNECTION. The testing management and control of the interconnection within each CITY shall be managed by each CITY through use of its own valve and pipe to the CITY' S LIMITS . 2 . AGREEMENT AS TO PROCEDURE FOR VALVE OPENING: (a) When either CITY desires to make use of the water within the pipe, or test the interconnection, such CITY shall give notice to the other CITY, and shall arrange a meeting at the location of the connection so that the valves may be opened by both CITIES to purge the air and chlorinate and flush the waste water. (b) When there is an emergency need, either CITY may open the valve of the other CITY, purge the air, chlorinate and flush the waste water and shall give notice of such emergency 0��usc to the other CITY as soon as possible . (c) Each CITY must estimate or measure the water released by it based upon the size of pipe fittings and the time of flow of the water. Should a disagreement arise as to the quantity of water used, each party to this contract agrees to submit said dispute to arbitration, as described in the California Code of Civil Procedure, Sections 1280 et seq. -2- (d) EACH CITY agrees to pay for water used by it in testing or in an emergency situation at the current Metropolitan Water District rate in effect at the time of the use. Payment shall be made by the CITY using the water to the CITY supplying the water as soon as possible. (e) Each CITY agrees that its valve shall be kept closed except during testing by either or both parties, or in a planned or emergency need situation. 3. SIGNOR' S AUTHORIZATION. Each CITY does hereby covenant that each individual executing this agreement in behalf of each party is a person duly authorized and empowered to execute contracts for such party.
