AGR.FLMENT FOR CODIFICATION
OF ORDINANCES
The City of Huntington Beach (hereinafter called the City),
and Cleveland Smith (hereinafter called the Writer) agree:
The Writer shall write a Huntington Beach Ordinance Code (and
furnish 15 copies thereof to the City).
The Code shall comprise the substantive provisions of such
ordinances as are selected by the Writer, subject to the approval
of the City Attorney. The format of the Code shall be similar to
that of the Glendora Ordinance Code.
The ordinance by which the Code is adopted by reference shall be
written by the Writer, but the newspaper publication thereof shall
be at the expense of the City. The Writer and the City Attorney
shall co-operate with a view to including in the code any suitable
ordinances adopted during the writing of the Code.
The City shall pav to the Writer sums totaling either a sum equal
to five dollQrs ($5.00) for each page contained in the finished Code,
or $1,000.00, whichever is the greater. Payments shall accrue
as follows:
11pon conclusion of preliminary research and presentation to the
City Attorney of detailed written recommendations by the Writer
as to the scope and arrangement of the Code, $500 shall be paid.
Upon adoption of the Code (passing of the ordinance by which the
code is adopted), a sum equal to $5 per page for each page of the
Code (as adopted) in excess of 100 pages shall be paid.
Upon completion of the Code, and delivery of all required copies
thereof to the City Clerk, the balance :.�nall be paid.

I am enclosing copies of correspondence with Cleveland
Smith relative to the codification of city ordinances.
You will recall that Mr. Smith appeared before the Council
at a previous, time to discuss with you the matter of codi-
fication. Heretofore you have been furnished by this office
with other in —formation relative to codification of ordin-
ances, and at tha request of the Council I wrote to several
of the City Attorneys where Mr. Smith had codified their
ordinances, and at a recent council meeting delivered
these letters.
In the event that you are still interested in having the
ordinances codified and desire to employ Mr. Smith for
this work, I would suggest that at the next council meeting
you authorize the City Attorney to prepare an agreement for
this work.

I am glad to hear that your city is following through on the codifi-
cation plans. Neither you nor the council will regret it. You
might be interested in knowing that the City of Escondido has
agreed to pay $3 , 000 for an ordinance code,
The Glendora code is the latest one which I have •w•ritten. How-
ever, I have only two copies of my own; and one of those is now
with the city manager in Upland. I will mail the other one to you.
The chief difference of the Glendora and E1 Centro codas Is that
the Glendora. code does not have a list of section headings at the
front of each Article. As there may be 1500 to 2000 of these
section headings in the Huntington Beach. Code, you will Save 40
or 50 pahes by leaving them out. As a matter of fact, I believe
the code will be less confusing to one who looks at it for the
first time if it does not have the lists of section titles which make
the Ar"u-1cles resembLn Chapters.
The mimeographing of the Glendora code is not as good as yours
will be. They got their $800 worth; but I am going to do a better
job (probably using an Underwood electric with Victorian type)
for the Oceanside and Huntington Beach codes. This IBM PSM
is not good .for mimeographing, because the different type char-
acters hit with different impact. (Note is on back of this letter.)

Herewith is a contract the provisions of which have proved satis-
factory on past codification jobs. The aim has been to make cer-
tain that the parties know what they are going to get, and to main-
tain a sound relationship between payments and wort. accomplished.
Every effort is made by the writer to conserve the time of the City
Attorney and other of£icigls of the City. The written recommendations
'
of the writer as to scope and arrangement of the code play a great
part in this, as they are in a form easily checked at a glance by any
cfficial who is interested. Such recommendations •,rill, be based upon
a careful perusal and correlation of all ordinances.
