WHEREAS, the Board of t,,pervisors by Resolution of May 31, 1956
14 adopted the Master Plan -irterial Highways 'to serve the entij.-e_ County
11 including the incorporated cities thereof, and
12 WHEREAS, Article 2 and 3 of Chapter 9, Division 2 of the Streets
13 and Highways Code authorize a county if it so desii:es to expend funds
14 apportioned t:D it out of the California Highway Users Tax Fund for aid
15 to cities And in the improvement, construction, or repair of streets
16 within a city, and
17 WHEREAS, the Orange County Board of Supervisors and the Orange
18 County Division of the League of California Cities have agreed upon a
In cooperative financial program for the establishment, construction and
20 maintenance of a County Arterial Highway System known as the Arterial
21 Highway Financing Program, and
22 WHEREAS, the Board of Supervisors has, by appropriate action,
23 provided in the budget of the Special Road Improvement Fund for the
24 Fiscal Year W1642 funds for the improvement of streets within the
25 incorporated cities of the County, which streets are a part of the
26 County's Master Plan of Arterial Highways, and
27 WHEREAS, the Board of Supervisors on November 5, 1958 has by
2.8 formal resolution .adopted the formal procedure for the administration
29 of the Arterial Highway Financing Program, which procedure is outlined
30, in a document on file with the County Clerk, formally known as the

and facilities in the safe and usable condition to which they have
been improved or constructed under this Project.
9. County -wide extension of Arterial System:
To promote uniformity of County Arterial Highway System with City
Master Plan of Major Streets,, both parties agree to continue the
promulgation' of the. A."i.F. P. as outlined in the aforementioned
Procedure Manual.
IN WITNESS WHEREOF, City has caused this agreement to be executed.
by its Mayor and attested by its Clerk, and County has caused this
agreement to be executed by the Chairman of its Board of Supervisors
and attested by its Clerk on the dates written opposite their signatures,
all thereunto duly authorized by the City Council and the Board of Super-
visors, respectively.

(b) On the basis of the above estimate, this Project will be

(c) If upon completion of detailed design, it appears that the

project estimate will exceed the original allocation by more
7
than 15%, the Contracting Authority shall request the City.

Council and Board of Supervisors for additional funds. The.
9
City Council and the Hoard of Supervisors shall adopt resolu-
10
tions allocating the additiDnal funds pri�:r to advertising for
11
bids. The request for additional allocations shall follow the
12
procedures as set forth in the AHFP Procedure Manual.

(d) Final adjustments of Project costs will be made on the basis
.14
of the County 50 percent, the City Ll_ percent on eligible
15
items in the Contract.

(e) Final adjustments of project storm drain costs will be made on
17
the basis of matching funds up to a maximum of fifty percent
18
(50%) of the total cost of eligible itemL; that is, County i
19
participation shall not exceed a maximum of twenty-five percent
20
(250%) of the total cost of eligible storm drain construction.
21
(f) It is the intent of the parties hereto to comply witt: all
22
applicable rules regarding the expenditure of State Gas Tax
23
Funds. Eligibility of any storm drain item will be sub)ect to
24
final audit and determination by the State Controllers' Office.
25
Any future adjustment required by said Controller's Office shall
2611 be made by the City with City funds, including complete refund
27. to t*he County of any County gas tax funds declared by the
28 Controller to have been expended on ineligible construction.
29 (g) Any funds spent prior to wrap 1. hifl shall not be

(e) Final adjustments of project storm drain costs will be made on
the basis of matching funds up to a maximum of fifty percent
(50%) of the total cost of eligible items; that is, County
participation shall not exceed a maximum or twenty-five percent
(25%) of the total cost of eligible storm drain construction.
(f) It is the intent of the parties hereto to comply with all
applicable rules regarding the expenditure of State Gas Tax
Funds. Eligibility of any storm drain item will be subject to
final audit and determination oy the State Controllers' office.
Any suture adjustment required by said Controller's Office shall
be made by the City with City funds, including complete refund
to the County of any County gas tax funds de-zlared by the
Controller to have been expended on ineligible. construction.
(g) Any funds spent prior to March !i 1'l'71 shall not be
considered in the final acciunting of this Project.
After completion of construction, the party having responsibility

18 County Division of the League of California Cities have agreed upon a j

18 cooperative financial program for the establishment, construction and
20 maintenance of a County Arterial Highway System known as the Arterial.

22 WHEREAS, the Board of Supervisors has, by appropriate action,
23 provided in the budget of the Special Road Improvement. Fund for the
24 Fiscal. Year 1969--70funds for the improvement of streets within the

incorporated cities of the County, which streets are a part of the
26 County's Master Plan of Arterial Highways, and

WHEREAS, the Board of Supervisors on November 5, 1958 has by

incorporated cities of the County, which streets are a part of the

7 WHEREAS, the Board of Supervisors by Resolution of May 31, 1956
8 adopted the Master Plan of Arterial Highways to serve the entire County
9 including the incorporated cities thereof, and j

10 WHEREAS, Articles 2 and 3 of Chapter 9, Division 2 of the Streets
1111and Highways Code authorize a county if it so desires to expend funds
1211apportioned to it out of the California Highway Users Tax Fund for aid
1311to cities and in the improvement, construction, or repair of streets
1411within a city, and
15 WHEREAS, the Orange County Board of Supervisors and the Orange County
16 Division of the League of. California Cities have agreed upon a coopera-
1711tive financial program for the establishment, construction, and mainten-
1811ance of a County Arterial Highway System known as the Arterial Highway
19 f I Financing Program, and
20 WHEREAS, the Board of Supervisors has, by appropriate action, pro-
21 vided in the budget of the Special Road Improvement Fund for the Fiscal
221Year 1966-67 funds for the improvement of streets within the incorporated
23 cities of the County, which streets are a part of the County's Master
24 Plan of Arterial Highways, and
25 WHEREAS, the Board of Supervisors on November 5, 1958 has by formal.
26 resolution adopted the formr.1 procedure for the administration of the
27 Arterial Highway Financing Program, which procedure is outlined in a
Z8 document on file with the County Clerk, formally known as the County of
29110range Arterial Highway Financing Program Procedure Manual, and
3011 WHEREAS, it is mutually agreed between the parties that

All soils engineering and material and construction testing neces-

include preliminary soils investigations, structure foundation
investiations, recommendations for structural sections and
cmpaction requirements, and quality control of materials and
construction.
6. The work shall be subject at all times to inspection
by the
authorized representatives of both parties.
7. Funds to be used for the Project:

(c) Final adjustments of Project costs will be made on the basis of
the County 50 per cent, the City 50 per cent on eligible
items in the Contract.
(d) Any funds spent prior to Mweb 1, 1966 shall not be con-
sidered in the final accounting of this Project.
8. After completion of construction, the party having responsibility
for maintenance of the Project shall maintain the roadway structures
and facilities in the safe and usable condition to which they have
been improved or constructed under this Project.
9. County -wide extension of Arterial System:
To Promote uniformity of County Arterial Highway System with City
Master Plan of Major Streets, both parties agree to continue the
promulgation of the A.H.F.P. as outlined in the aforementioned
Procedure Manual.
IN WITNESS WHEREOF, City has L,iused this agreement to be executed
by its Mayor and attested by its Cler, and County has caused this agree
meet to be executed by the Chairman of it. Board of Supervisors and
attested by its Clerk, on the dates written of �tisite their signatures,
all thereunto duly authorized by Minute Order of. I City Council and
the Board of Supervisors, respectively.
