SMALL, CHIEF OF P CE �R106 e SUBJECT: APPROVE THE MEMORANDUM OF UNDERSTANDING BETWEEN THE COUNTY OF ORANGE AND THE CITY OF HUNTINGTON BEACH FOR FEDERAL 2009 EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT (JAG) PROGRAM Statement of Issue, Funding Source, Recommended Action, Alternative Action(s), Analysis, Environmental Status, Attachment(s) Statement of Issue: In order to comply with the federal requirement for the Edward Byrne Memorial Justice Assistance Grant, a memorandum of understanding is necessary between the County of Orange and the City of Huntington Beach. The City Council is asked 'to. approve the attached memorandum of understanding. Funding Source: Grant funds not anticipated in the original FY 2008-09 city budget, estimated to be $197,946 will be fully reimbursed by the grant from the Department of Justice. No other matching or in -kind city funds are required for this grant. A new fund will be established for this funding. Recommended Action: Motion to: Approve and accept the JAG Grant between the County of Orange and the City of Huntington Beach for federal fiscal year 2009; 2. Authorize the City Manager to execute on the City's behalf the Federal 2009 Edward Byrne Memorial JAG Memorandum of Understanding between the County of Orange and the City of Huntington Beach that are approved as to form by the City Attorney; 3. Approve the appropriation and expenditure up to $197,946 to be fully reimbursed by the grant from the Department of Justice via the County of Orange. Analysis: This is a coordinated grant that was applied for on a countywide basis. The City of Huntington Beach falls within the Orange County urban area and will be funded via the County of Orange. The Edward Byrne Memorial Justice Assistance Grant (JAG) funds will be utilized to support a broad range of activities to prevent and control crime within the County of Orange. The County of Orange has been certified disparate; therefore this joint application includes twenty units of local government for which the applicant and fiscal agent is the County of Orange. The twenty units of local government in the jurisdiction will utilize the funds for local initiatives, technical assistance, training, personnel, equipment, supplies, and information systems for criminal justice within the following purpose areas: law enforcement, prosecution and court, prevention and education, corrections and community corrections, drug treatment, planning, evaluation and technology improvement. The total City of Huntington Beach grant is $197,946. Of the total grant amount, a 5% up to maximum of 10% is for the administrative fee. The Police Department intends to utilize the remaining money to enhance the security of public safety employees by providing upgraded body armor options. Strategic Plan Goal: To provide public services with the highest professional standards to meet community expectations and needs, assuring that the city is sufficiently staffed and equipped overall. VILLELLA, CPA SUBJECT: FIS 2008-09-10 Approve the Memorandum of Understanding with County of Orange for Federal 2009 Edward Byrne Memorial Justice Assistance Grant (Jag) Program DATE: MARCH 25, 2009 As required by Resolution 4832, this Fiscal Impact Statement has been prepared for "Approve the Memorandum of Understanding with County of Orange for Federal 2009 Edward Byrne Memorial Justice Assistance Grant (Jag) Program." If the City Council approves this action (total appropriation $197,946), there will be no effect on the fund balance of any fund since this will be funded by additional revenues not anticipated during budget adoption. Villella, CPA DTV/rs ATTACHMENT #2 March 17, 2009 RE: 2009 Justice Assistance Grant Program (JAG) City Managers & Chiefs of Police Congratulations intended recipients, the 2009 Edward Byrne Memorial Justice Assistance Grant (JAG) allocations have been posted and the grant solicitation has been released. The County of Orange is eligible for $3,959,880 in local JAG funds (see page 2 for allocations) in 2009, for which 32 agencies and the County of Orange are eligible. The suggested amounts are based on a formula used by the U.S. Department of Justice OJP/BJA, this is defined in the solicitation. The County of Orange, through its Sheriff's Department, will serve as the applicant/fiscal agent for the funding. The Sheriff's Department will complete and submit the grant application, and will be responsible for compiling and submitting financial and programmatic reports for all agencies that receive funding. Due to the reporting requirements being much more stringent an anticipated 10.0% administration fee will possibly be implemented for the 2009 JAG funding. JAG funds can be used for local initiatives, technical assistance, training, personnel, equipment, supplies, contractual support, and information systems for criminal justice, and criminal justice -related research and evaluation activities. Please keep in mind the requirements for this grant are much more specific, due to the funding being offered through the American Recovery and Reinvestment Act of 2009 (Stimulus package). In addition to the MOU, a final version of the JAG Allocation Expenditure Form (a draft is attached) will need to be filled out, approved by your city council declaring your intended use of the 2009 JAG program funds, and returned to me. Funding for planned recipients with late and/or non submission of required reporting will be redirected in accordance with a transfer agreement when approval of the award has been received. Due to the grant application deadline and a variety of approval and reviewing requirements, the final documents will need to be completed, signed and returned to me by the first week in April 2009.
