HomeMy WebLinkAboutCOURTLAND PAUL/ARTHUR BEGGS - 1972-04-17i CONTRACT FOR LANDSCAPE ARCHITECTURAL SERVICES THIS AGREEMENT, by and between the CITY OF HUNTIIIGTON ' BEACH, a municipal corporation of the State of California, here- inafter called "CITY," and COURTLAND PAUL/ARTHUR BEGGS, herein- after called "ARCI?ITECT.'P \* 4 WITNESSETH: WHEREAS, CITY proposes to construct- the following 4.t , neighborhood parks: Greer Annex 0705), Gle,rz View 0930), Golden View '1860), Marine View (#93.0), and Haven View (#915).. ARCi,iTECT is a landscape architectural firm, the principal members of which are fully registered under the laws of the.State of California, and the Director of Public.:Works is the i7epresentative of CITY, NOW, THEREFORE, IT IS MUTUALLY AGREED between the 1 parties hereto that; is ARCHITECT shall prepare and furnish to CITY,.com- a plete and ready for use, all necessary studies, sketches,shematics estimates, working drawings and specifications, shall check shop drawings., catalog cuts, material lists as submitted by the con- struction contractor, shall furnish consultat:on and advice as requested by. CITY during construction, n ',Wding evaluation of specified tests as.further defined herein (but not including any supervision of the construction work), and shall furnish all other landscape architectural services, including without limitation those specified hereinafter and required for the, five parts listed here..- inabove, having; an estimated constructic cost or Two Hundred Fifty -One. Thousand and Two Hundred Dollars ($251,200.00), and more specifically set forth in Exhibit "All entitled "Scope of the Work' :r to be Accomplished," atta-hed hereto and made ,a. part hereof. ARCHITECT agrees to design facilities which can be constructed j within the amount hereinabove sat forth. �Iae project design., including utilities, plumbing, electrical, paving and ,planting, Mif /a 1 i issued by the Director of Public Works. If, after receipt of competitive bids, it is found that a construction contract cannot be awarded within ten per- cent (10%) of the aforementioned estimated construction cost, ARCHITECT will, as a part of this agreement, and at no addi- tional cost to CITY, perform such redesign, re -estimating and other services as may, in the opinion of the Director of Public Works, be required to produce a usable facility within the estimated construction cost. In connection with toe foregoing, ARCHITECT shall be obligated to pernorra such additional services at no increase in contract price only when CITY has received competitive bids within two (2). month3 from date or final ap- proval of plans and specifications. 2.' All drawings, designs, specifications., and other incidental: architectural and engineering work or materials fur- nishedhereunder shall be and remain the property of CITY, ex- cept that 'said drawings, etc., cannot be used for other parks. 3. ARCHITECT shall, if necessary, visit the site and shall hold such'conferences with 'representative's of CITY and take such other action as may be necessary to obtain the data upon which•to develop the design showing the contemplated project in accordance`with'the following: 4. As an architectural design requirements CITY will provide as -built topographic maps, engineering street improvement plans, and complete soil analysis of the existing sites. (a) Schematic Des'fan: ?ha'se: The schematic design phase shall include conferences with CITY.departments concerned and preparation of schematic sketches based upon the CITY'.S pro gram for the function and scope of the profef, It will include a scope of estimate of cost. This phase shall be submitted to the Director of Public Works, for signature approval within forty-five (45) calendar days from the date of this agreement. (b) ' 'Design Deve16pperit• Ph6se s Upon approval of Ss i 'c� site plans, elevations and other drawings with outline speoi ft I cations covering the project, and including materials and equip - meat, as are necessary to integrate the design, explain the pro- ject fully, and enable a preliminary estimate of construction cost.. This phase shall be submitted to the Director of Public Works for signature approval within sixty (60) days after ap- proval of the schematic design. ARCHITECT shall change the design development plans for the project to the extent necessary to meet the requir-aments of the Director of Public Works. After approval by signature of the Director, the ARCHITECT shall furnish neces- sary prints of type approved design development plans to the Director as specified in Exhibit "A.n (e) The 'C'oris"cructidn Documents 'Phase: After approval of the 'design clPvelopment 'phase plans and estimates, ARCHITECT shall proceed with the preparation of complete working dnawincgs and specifications as required by the Director of Public Works for the construction of said project. One set of repro- ducible transparancies of the working drawings, specifications, and estimates shall be delivered to the Director of Public Works within ninety (90) days after approval of the design development phase.. After working, drawings and specifications have been ap- proved by -CITY, as indicated by the signature thereon of the Director, ARCHITECT shall furnish sets of prints of the approved working drawings and sets of the approved specifications as may be required by the Director as per Exhibit "A."' 5. Upon approval .of. _Final plans, :ARCHITECT shall deliver to CITY one'set":of tracings, in such medium and on such materials as may be required by the Director of Public Works, suitable for blueprinting showing complete approved construction requirements. Such tracings as are delivered shall be signed by the Director as an indication of approval thereof and shall be- come and remain the propevlt;y of CITY,, 6. ARCHITECT shall perform and provide all necessary 3. yF _ a (i architectural services of every kind in connection with the ' studies, designs and the preparatic,ba of drawings and specifi- cations, but said services shall not, unless otherwise stipulated include surveys, engineering services, soil tests, or supervision of construction work executed from the drawings and specifications, provided 'however, that ARCHITECT shall furnish upon request and without additional compensation;, such amplifications and explan- ations and attend such conferences as may, in the opinion of the Director of Public Works, be necessary to clarify the intent of the drawings and specifications and shall afford the benefit of his advice on questions that may arise in connection with the 'con- struction of the project. 7. ARCHITECT shall, without additional fee, correct - or revise the drawings and specifications if the Director of - Public Works finds that such revision is necessary to correct errors or deficiencies for which ARCHITECT is responsible. 8. All services to be rendered hereunder shall be { subject to.the 'direction and approval of the Director o' Public Works. Approval by said Director of drawings, designs, specifi- cations and other incidental architectural work or materlals ` furnished hereunder shall not in any way relieve 11RCHITEOT of responsibility for the technical adequacy of the work. 9 The cost to CITY. ,for the aforementiotaed arch tec= tural services shall be Twenty Thousand and Ninety -Six Dollars ,4 ($20,096.bo) 1.0 The cost for the .work,;:including the fees 1�nd reimbursement items, will be billed by ARCHITECT to CITY monthly in proportion to the work accomplished and to the extent That the reimbursable items are incurred; aid bills to be subihitted to the Director of POlie works for his approval before payment . may bemade by CITY Finance Director. ARCHITECT will keep accurate aocounting records of time and expenditures, which records will be available for inspection by CITY at reasonable times. r 12. CITY may, at any time, by written order of the Director of Public Works, make any changes in the services to be performed hereunder. If such changes cause an increase in the cost of doing the work under this agreement or i.n the time required for its performance, an adjustment shall be made based on the direct cost to ARCHITECT plus reasonable overhead costs . and profit and the contract shall be modified in writing cordingly. Any clatm for adjustment under this clause 'must be made in writing to the. Director of Public Works withLn thirty (30) days from the date the change is ordered; provided, however, said Director, .if he determines the facts justify such action, may receive and consider and adjust any such claim asserted at any time prior to the date of final settlement of the.cont"act. 13 Wherever herein the action of the Director of Public Works is required, a representative of said Director, designated in writing, may act on his behalf. 14.
