If rincipal shall faithfully perform said contract and guarantee that the work will be free of defer ve materials and wurkmanship for a peflod of Tt,'ELVir ( 12) months toliowing completion of the contract, then this obligation shall be null and void. Any additional warranty or guarpintee whether eypressed or implied is extended by the principal or manufacturer only, and the surety assumes no Lability for such a guarantee. Whenever Principal shall be, and be declared by Obligee to be in default under the contract, the Obligee having performed Obligee's obligations thereunder: (1) Surety mt./ promptly remedy the default subject to the provisions of paragraph 3 herein, or; (2) Oblipee after reasonable notice to Surety may, or Surety upon demand of Obligee may arrange for the performance of Principal's obligation under the contract subject to the provisions of paragraph 3 herein; (3) The balance of the contract price, as defined below, shall be credited against the rea• sonable cost of completing performance of the contract. If completed by Obligee, and that reasonable cost exceeds the balance o! the contract price, Surety shall pay the Obligee such excess, but in no event shall the aggregate liability of the Surety exceed the amount of this bond. if Surety arranges completion or remedies the default, that portion of the balance of the contract price as may oe required to complete the contract or remedy the default and to reimburse Surety for its outlays shall be pdid to Surety at the times and in the manner as said sums would have been payable to Principal had there been no default under the contract. The tern "balance of the contract price," as used in this paragraph, shall mean the total amount payable by Obligee to Principal under the contract and any amendments thereto, less the amounts heretofore properly paid by Obligee under the contract. Any suit under this bond must be instituted before the expiration of two years from rate on which final payment under the contract falls due. No right of action shall accrue on this bond to or for the use of any person or corporation other than Obligee or the heirs, executors, administrators or successors of Obligee. IS On January 27, 1992, the City Council awarded a construction contract to D.H.Y. for the installations of new traffic signals on Beach Boulevard at Newman Drive and Terry Drive. At the time of award, the Orange Cowsty Transportation Authority (C.C.T.A.) was invoiced for 90% of the fund. to constt-uct the improvements. The construction of these Improvements are now compiete and the O.C.T.A. will release the final payment upon receipt of the recorded Notice of Completion. ANALYSIS: As part of the Beach Boulevard Super Street project, traffic signal installations were approved at the intersections of Newman Avenue, Terry Drive, and Taylor Street. The design details at Taylor Street have not been finalized by CALTRANS. The other intersections are complete and have been approved by CALTRANS and funded by the Orange County Transpertation Authority (formerly OCTC, which was, since June of 1990 incorporated into the OCTA). When completed, these intersections will be equipped to provide left turn moven►ents from Beach Boulevard onto the local streets, and allow the local traffic to enter the traffic flow onto Beach Boulevard. The project also calls for the Installation of emergency vehicle pre-emption (Opticom) devices and median modifications. FUNDINQ WPILCES• The estimated cost and funding is $296,000.
