RENTAL AGREEMENT`;

THIS AGREEMENT is entered into this _(Z&7-- day of�,.

"CITY" and DAVID HAMPTON, :einafter rQferr(l co as"TENANT" .

WHEREAS, "CITY" has acquired property for park purposes E'
in the vicinity of Huntington ar.l Yorktown, and development will >
not take place immediately, and
WHEREAS a single family residence is located on a portion
of the property, and. the "CI'!TY" is desirous of renting said
residence on a month -to -month basis until improvement of the pai k
pzoect can commence;
NOW, THEREFORE, parties hereby agree as follows;
1.. DESCRIPTION OF PREMISES: CITY hereby rents under terms
and conditions set forth herein_ ? single family .residence located
at 2318 Huntir ton Street, to 'TENANT and TENANT accepts premises
-on an "as is basis.

3. RENT: Monthly rentel shall be four hund...ed seventy-five
dollars ($475) due and payable in advance on the first day of.

as a security deposit for the performance of the conditions of

this lease, If at any time during the term hereof, TENANT fails
to perform any of conditions of the lease, or causes damage
to the premises, or fails to tee.ve --he dwelling ina reasonably
clean condition upon termination, then CITY may appropriate and
apply any portion of the security necessary to intake the repairs
or clean the premises.
5. POvINT.ENANCE: TENANT shall maintain premises, including
landscaping, in good condition. if TENANT fails to maintain the
premises, CITY, may at its option, perform necessary maintenance
and bill TENANT for the cost of services renderer, and TENANT
shall re m&jrse CITY for the cost thereof within -ken (10) days

6. INDEPINIVICATION : During the term of this tenancy, TENANT
agrees to indemnify, defk:nd, and save CITY ha=less fi,om any and
all claim:: arising from any act, omission or negl.i.gesice of +TENAIT
or his agents or employees arising from any accident, injury or
damage whatsoever caused to any person or preiperty occurr2,dg in,
on or L,. at the leased premises, :end from s<<ay and all cost,
expenses or liability incurrsd in connection with any such claim
or prodeeding,

make any alterations to the premises without the written consent
of CITY, and shall 'use the premises for residence purposes only.
8. ASSIGNMENT, REENTRY: TENANT shall not assign the lease

or sublet the premises except with the written permission of the

CITY, and CITY expressly reserves the right of reentry for any
violation of this section or other conditions of lease, and CITY
reserves -he right to reenter and inspect the premises at allY�"
reascaable cities .
9. COMMENCEMENT OF TER4: The tenancy under this agreement
s,zall commence on December 1, 1981.
10. LIMITED DURATION OF TENANCY IN TERMINATION NOTICE:

Either party may terminate this lease by thirty 130) days written
notice to the other party. In executing and eater .g this tenancy,
TENANT has been informed and _s aware that said tenancy will only
be for an interim period, and that the maximum duration of the
lease will be until such time as CITY develops the subject property
for park purneses . 'TENANT will not be ent.Ltl;ed to relocation, Qr
other assistance, or reimbursement upon the termination of this
lease.
11. U-MITIES: TMANT shall, pay and be responsible for all
utilities- servicing the property, except for water and trash pick-
up. The CITY will provide and be responsible for ,providing to the
property water and trash pack -up.

The City hos been leasing the residence on City park property at 2318 `Huntington Street up.

ANALYSIS:
Subject. property was purchased on July 31, 1978, from Foxx Development Corporation, for
$75,00. The property is designOted as part of MGCallen Pork, which is scheduled for
development in FY 82/83. The residence will be demolished in cc junction with park
development. The City will realize $5,700 yearly revenue from this lean:.
