By my signature hereunder, as Contractor, I certify that,I am;aware of the. provisidia of Section 3700 of the Labor Code which require every employerto be inner d against liability for Workmen's Compensation or.to undertake se'lf-insurance in.accordance with the provisions of that code, and I will comply with such provicions before commencing the performance of the work of this contract. II. Contractor arees,to receive and accept as full compensa- tion for furnishing all materials and for.'doing all the work contemplated and embraced in this agreement, the unit prices con- tractor submitted in his proposal which was accepted by the City Council. A copy of staid proposal is attached hereto and incorporated herein by reference and made a part hereof. Contractor further agrees tha-.: said payment by City shall. include all payments for all loss or damage arising out of the nature of the work aforesaid, or from the action of the elements, or from any unforeseen difficulties or obstruc- tions which may arise or be encountered in the prosecution or the work until its acceptance by the City, and for all risks of every description connected with the work; also for all expenses incurred by or in consequence of the suspension or discontinuance of work and for well and faithfully completing the work, and the whole thereof, in the manner and according to tine plans and specifications, and the require- ments of the engineer under them. City agrees with the said Contractor to employ, and does hereby employ, the said contractor to provide the materials and to do the work according to the terms and conditions herein contained and referred to, for the prices aforesaid, and hereby contracts to pay the same at the time, in the manner and upon the conditions set forth in the general requirements and the said parties for themselves, their heirs, executors, administrators, successors and assigns, do hereby agree to the full performance of the convenants herein contained far the contract bid amount of $ 214,900.00 which amount is subject to adjustment upward or downward dependent upon inplace -r-iantity where applicable . IV. It is further expressly agreed by and between the parties hereto that should there be any conflict between the terms of this instrument and the bid or proposal of said Contractor, then thins instrument shall control and nothing herein shall be considered as an acceptancecf the said terms of said proposal conflicting herewith. V. Bid Bond. The Contractor further agrees that his proposal shall be accompanied by a bidder's security in an amount equal to ten percent (10%) of his bid in accordance with California Government Code Section 37931 et seq. Ll VI. Performance Bond and Labor and Material Payment Bond. The contractor agrees to furnish, prior to the execution of the,contract, bonds, covering the faithful performance of this contract and the payment of Ull obligations arising thereunder in such form and amount as the City may prescribe. VII. California Fair Employment Practice Act. The contractor agrees to utilize fair employment practices in accordance with California Labor Code Section 1410 et seq. Club , of Huntingtorrt Beach. Subsequent to the Iexecution of the.ground lease, it was discovered that the site was severely impacted by.peat soil conditioins.,. This situation dictated a re -design of-the.facility to include an elaborate and expensive foundation system. in anticipation of cost increases resulting from the -proposed facility's re- design, the Boys` Club has entered an independent agreement with the Fountain Valley Sch'ool.District.to lease existing surplus classroom space at the Bushard Elementary School. The Boys' Club intends to operate the juvenile recreation program planned for the new building within this leased space and has also received approval of .the $10,00'0 Grant from the Anderson Foundation for equipment and plans additional fund raising activities. There- fore, the objective of this project will be accomplished without expenditure of the Block Grant funds. Therefore, because of.the insufficient bid bond, the sole bid for the construction of the Bushard Cortununity Cen-;:er should be re- jected, and it is further recommended that due to the increased costs and alternative arrangements stated above, that the Bushard Community Center Project not be implemented. 2. Oakv:Lew Day Care Center This project was originally funded with $165,000 from the third year Housing.and Community Development Block Grant and is to pro- vide a•3000 square foot facility on a portion of the Oakview Elementary School site leased by the City from the Ocean View School District and to be operated by the Orange County Superin- tendent of Schools. After payment'of architectural services, soils reports, and State of California plan check fees, there remains approximately $151,000 for this project. The low bid for this project of $214,900 by D & B Enterprises, Inc. is consistent with the architect's estimate of $215,250. The continuing need fora day care center -in the Oakview neigh- borhood warrants the completion of this project and, therefore, it is recommended that surplus HCD funds be reprogrammed to this project in accordance with the attached schedule. 3. Disposition of Additional Funds Through the course of the first five years of..the Housing and Community Development Program, certain projects have been coin-- pleted for less than the amount budgeted and other projects have been deemed ineligible by HUD. As a result, approximately $401`000 of these funds plus the approximately $280,000 diverted from the Bushard Community Center are availal)le for reprogram- ming at this time. It is recommended that these funds be re- programmed to the Oakview Day Care Center and Old Civic Center project in accordance with the attached schedule. This will accomplish several objectives: 1. Permit the implementation of the Day Care Center; Pace 3 2 . Repay the 'f urids - appropr iated f rom the 01.d Civic Center to assist with the Wycliffe Gardens land acquisition; 3. Fund the planned improvements to the -Main Street Branch Library for which no funds have been previously committed; 4. Build a contingency -fund for both the Day Care.Center and Old Civic Center project- to help off -set the inflation of construction costs. In addition, it is recommended that the third, fourth, and fifth years' local option funds be earmarked as contingency funds for the Old Civic Center. project. This would further build the contingency fund for this project, and help assure that inflation does not make the project infeasible by the time construction begins. These local option funds, however, should not be reprogrammed at this time, but should be drawn upon only if needed. ALTERNATIVES: Without the reprograindng of funds, the Oakview Day Care Center can- not move forward, nor can the additional funds for the Library improvements and Wycliffe loan repayment be allocated to the Old Civic Center project. RECOMMENDATION: Accept the low bid of $214,900 by DcB Enterprises, Inc., reject all other bids and reprogram additional $95,822 necessary to im- plement the construction of the Oakview Center. The HCD .advisory Board reaffirmed the need for the Day Care Center and took action to recommend to the City Council that additional funds be reprogrammed to the project to permit its implementation. The low bid for this project of $214,900 by D Enterprises, Inc. is consistent with the architect's estimate of $215,250. The continuing need for a day care center in the Oakview neigh- borhood warrants -the completion of this project and, therefore, it is recommended that surplus HCD funds be reprogrammed to this project. Statement of Issue, Recommendation, Analysis, Funding Source, Alternative Actions: STATEMENT OF ISSUE: Working drawings for the Bushard. Commuanity Center and the Oak74.ew Day Care Center have been completed and were reviewed and approved by the Design Review Board on September 6, 1978. Construction of these two projects may begin upon completion of competitive bidding and the award of a construction contract. RECOMMENDATION: ;Approve project plans and specifications,.and approve and direct `the Department of Public Works in conjunction with the project 'architects, Blurock and Partners, to a1vertise and receive con-- �struction bids. ANALYSIS: Ins part of both the Second and Third Year Housing and Community Deve' opment Block Grant programs, funds were allocated for the construction of the Oakview Day Care Center. and the Bushard Community Center. On' December 12, 1977, the City Council approved the selection of Blurock. and Partners as architects for the two projects. Working drawings for the facilities have now been completed and approved by the Design Review Board. The two projects are now ready to go to bid. Upon receipt of construc- tion bids - and the selection of a contractor, the construction contract. will be submitted to the Council for review and approval. Due to the escalating nature of construction costs and problems with soil condi- tions at the Bushard Community Center site, it is anticipated that these projects will exceed their present budgeted allocations. At this time it is not possible to estimate the exact amount of.additional funding required for these projects. At the time the construction bids are reviewed, the exact amount of additional funding required should be known.
