Relocation is required of certain utility facilities of OWNER, cast. of which is to be borne by STATE bet -Aux; Section
703 of the Streets and Highways Code. Publicly owned utility
used solely to supply water that is lawfully maintained in a city
street and installed prior to its becoming a state highway.
A. Inst-ill
1. 1846 feet 12" I.D. CN.ICH W.S. water pipeline on the
north side of Edinger street within the Freeway
construction area.
2. 695 feet of 20" I.D. n 1/411 steel pipe ca3ing.
3. 2-12" P1. gate valves.
4. 1-1" A-V/A-R valve.
5. 1-6" Blow -off.
B. Relocate
One existing A-V/A-R valve assembly.
C. Abandon
1800 feet + of 12" I•C. cement mortar lined and coatedt
gelded steel pipe and appurtenances.

All work shall be performed substantially in accardsnnce with
Omnir's dewing nur0ered Sheet 1-B, and estimate, dated
Febraarry* 21, 1963, tin file in the District 07 Office of the
Division of Highways, 120 South Spring Street, boos Angeles,
California.

A. All relocation work shall be done by contractor on a
competitive bid basis.
B. State shall reimburse Owner upon receipt of six (6) copies
of itemized bills of cost of the work in accordance vith
Owner's regularly established accounting p:cactice, with the
State receiving credit for accrued depreciation.

Vemorandum 30—if as amended is hereby incorporated into tblis
Agreement with the understanding that provisions governing
reimbursement procedures are applicable to the relationship
between the State and the United Staten.
V. In order to comply with Title VI of the United States Civil
Rights Act of 1964, Appendix A is attached to and trade a
part of this Agreement, excepting therefrom any and all work
performed by Owner's own. forces.

APPENDIX A
During the performance of this eontract, the contractor, for itself, its
assignees and AlWeessors in interest (hereinafter referred to as the "contrac-
tor"), agrees ns fullUws :
(1) Compliance with Regulations: The eontrartor will comply with the
Regulntionti of the Department of Cotntnerve relative to nonc'iacrimina•
tion in fe(leralhy•assisted prn,►ranas of the Department of `omn:erce
(Title V5. Code of }Federa) lievulaltion,, fart h, hereinafter referred to
as the Regulations), whi► h atro her -in incorporated by reference and
made a part of this c•ontralet.
(2) Nondiscriminatian: The contractor with regard to the work performed
bY it after award and prior to ennip:etion of th:, contrnet work. will
not di�vriminate on the gromid of rare, color, nr national origin in the
selection anti retention of sub;ontractors, inehtding procurements of
materials and leases of equipment. The contractor will not participate
either directly or indirectly in the discrimination prohibited by Section

(3) SolicitaUons3 for Subcontracts, Including Procurements of Materials tmd

(4) It:fomnation and Reports: The contractor will provide all information
and reports required by the Re zulation�., or onlers and instructions
issued pursunnt thereto, and will permit access to its books, records,
accounts, other sources of information, and its facilities as ma;; be
determined by the State Iliviitvay Department or the Bureau of Public
Roads to be pertinent to ascertain compliane,, with much Regulations,
orders and instructions. Where any information required of a contractor
is in the exclusive possession of another who fails or refuses to furnish
this information, the contractor shall so certify to the State Highway
Department, or the Burean of Publir Roads as appropriate, and shall
set forth ghat efforts it has made to obtain the information.
(5) Sanctions for Noncompliance: in the event of the enntractor's noncom-
pliance with the nondiscriminatiun provisions of this contract, the State
Highway i)epnrtment shall impose such tontract "netion% as it or the
Bureau of Public Bondy may det,•rinine to be appropriate, including,
but not lir.:ited to,
(a) withholding of payments to the contrartor under the contract until
the contractor complies, antl or
(b) cancellation, t:rmination or suspensicin of the contract, in whole
or in part.
(6) lwo.poration of Provisions: The contractor will include the provisions
of para1►raph ,11 through (61 in ever;. subcontract, including procure-
ments of nimerials and leases of equipment, unless exempt by the Regu•
lat:ons, o-der, or instructions imue(l pur rant thereto. The contractor
will take such action with respect to any subcontract or procurement
as the State Highway I)epartrnent or the Bureau of Public: Roads may
direct as a means of enforcing such provision% including satactions for
noncompliance-. Pm ided, however. that, in the event a contractor be-
comes involved in, or is threatened t: ith, litigation :with a subcontractor
or supplier ar. a result of such direction, the contractor may request the
State to enter into such litigation to pro!ect the interests of the State,
and, in addition, the contractor may request the U sited States to enter
into such litigatinn to protect the interests oa the United States.
