Hartge�h� Department Public Works Date Prepared September 12, , 19 78 Backup Material Attached Fx Yes ❑ No Subject Freeway Agreement Between the City and the State of California City Administrator's Comments Statement of Issue, Recommendation, Analysis, Funding Source, Alternative Actions: Statement of Issue The State has requested the City to enter into a new freeway agreement relating to that portion of the 405 Freeway within the City limits. Recommendation 1) Approve the new freeway agreement with the State, (2) authorize the Mayor and City Clerk to execute same, and (3) instruct the City Clerk to send the original and one signed copy along with two certified copies of the statement of action of the City Council to the District 7 office. Analysis The modifications recently made to the freeway offramp at Center Drive and Beach Blvd, necessitate a new freeway agreement which supersedes the existing agreement dated February 1, 1960. The agreement identifies the responsibilities of the State pertaining to the Route 405 freeway and the City pertaining to City streets within_the.City. There cul-de-sacs were not in- cluded in the freeway agreement. This resolution will supplement the freeway agreement dated February 1, 1960 until a revised freeway agreement can be executed. It is respectfully requested that your Honorable Body adopt this resolution and direct the City Clerk to return two (2) certified copies to this office for transmittal to the State. This Agreamnt supersedes that portion of said rroeway Agreemnt dated rebruary 8, 1956 from Bristol Street to the Los Angeles- Orangs County Line, as it pertains to the portion of said freeway within the present limits of the City of Huntington Beach. 2, This Agreement suporsedes that portion of said rreaway, Agreerent dated rebruary 1, 1960 from the Huntington Beach - fountain Valley city limit at Cannery Street to the Huntington beach - Westminster city limit at the Southern Pacific railroad, as it pertains to the portion of said freeway within the present limits of the City of Huntington reach. 3. CITY agrees and consents to the closing CITY streets, relocation of CITY streets, construction of frontage roads and other local roads, and other construction affecting CITY streets, -2-- all as shown, on said plan map attached hereto marked Exhibit B and made a part hereof by this reference. 4. This agreement supersedes those portions of the free- way agreement dated February 8, 1956, between the County of Orange and the State insofar as it pertains to the portion of said freeway within the present limits of the City of Hunting- ton Beach. 2.- The City agrees and consents to the closing of city streets, relocation of city streets, construction of frontage roads and other local roads, and other construction affecting city streets, all as shown on said plan map attached hereto marked Exhibit A for the portion of the San Diego Freeway with- in the City between the Huntington Beach -Fountain Valley city limit at Cannery Street and the Huntington Beach -Westminster city limit at the.Southern Pacific Railroad, and made a part hereof by this reference. 3. The State in the construction of. said freeway will, at the Statets expense, make such changes affecting city streets -in accordance with the said plan map attached hereto or as.the same may hereafter be modified by subsequent agreement between the parties hereto.. 4. The -City will accept control and maintenance over each of the relocated or reconstructed city streets, the pedestrian facilities, and the frontage roads and other State constructed local roads on notice to the City Engineer from the State that the work thereon has been completed, except as to any portion thereof which is adopted by the State as a part of the freeway proper, and presentation of a separate maintenance agreement delineating in detail the areas and specific portions of the junctions of such relinquished roads with the freeway. The City will also accept -title to the portions of such roads lying outside the freeway limits, upon relinquishment by the Statee 6. The grade separations shown on plan map Exhibit A will either be underpasses or overpasses as detailed engineer- ing studies may determine will best fit the localit;.
