The purpoze of this letter is to: 1. provide an update of the ti-ing of the project. 2. Provides an update of the cost of the project.. 3. Cbtain approval -,)f the City Council to acquire right of *.Gay. Timing Due to compli.ations in obtaining the rights of way from Huntington Center and from tht: Edison Company, the project will probably be doluyad by five (5) months from the last schedule. The significant change is an increase in the cosy: of right of way acquisition. The partnership which owns Huntirgton Center was not in agreement with our offer of purchase. Their principal concern I is that they should be reimbursed f:r the cost of restoring the parking lot which ins being severed. As a result of the lick of agreement we obtained an appraisal. Our revised offer of $159,70() is a compromice approximately in the middle of our original offer and the appraisal. Edison Company personnel appraised the street right of way value at $19,520.00. Our appraisor placed a right of way value at $7,500.00. At the time of the writing of this letter we have not reached agreement as t:o the cost of acquisition. Due to a drastic lay off in Cal Trans, personnel who have been worki,tg on the project have either been transferred or are gone. There: is now concern as to whether or not th-:y can live up to the 120 day commitment for completion of the plans, apcci-- fi.cations and estimate. Therefore, they have re:quest,�d the addition of the following underlined words to Paragraph G on Page It of the agreement. 6. The other smaller mail tenant shops will also realize economic benefits through profits on their increased sales. However these benefits have rot been included based pri- marily upon pragmatic considerations which recognize the difficult; in successfully obtaining financial participation from these smaller tenants. Economic 3enefit to Jerwel En:erurisis Pr�ert� Tire development potential of the presently undeveloped 30 acre parcel owned by Jerr'rel Enterprises which lies ir.mediately to the north of the Huntington Center will also be positively enhanced by installation of the proposed street improvements. A development concept has previously been prepared for the parcel assuming -installation of the improvements, which galls for several integrated land uses including an adult apartment complex, Old World Specialty Retail Center with condominium home/retail units, mutel and restaurant, high- rise office project, major 300 room hotel, restaurant sites, etc. Several of the proposed uses are dependent upon the availability of good freeway access to the site. Estimates of the probable economic impact upon the Jerwel property as a result of the proposed Center Drive/freeway off -ramp modifica- tions have boon made based upon the amount and type of development that !'could be feasible with and without the proposed street improvements. These results ar•e sunrrarized in Table 2 which is shorn faring. The consultants computed all of the shares to, two decimal places, i.e., to ore -one hundredth of a per cent, but this is clearly a cage of over -precision. We do not believe that the consultants intended to convey that Huntington Center, for example, receives exactly 2.77% of the total benefits of the project. A better form of expression proba;:iy would have been to conclude that the owners of Huntington Center i•muld almost certainly receive some economic benefit from the proposed project, and that their percentage of total benefits would be very small, perhaps in the range of 1% to 4%. The acme type of imprecise statement might also, of course, be applied to each of the other parties. Therefore, the City Council should not consider this report as an automatic decision maker, to be applied with total equity merely by arithmetic. The conclusions reached are much too imprecise for that type of approach. All 1 that this report really says is thr.t most of the benefits of the project: will accrue to the p•iblic sector, and that if they could be precisely quantified, that would probably fall into the range of SO/ to 907 of the total benefits. T. on the econumic benefits from the subject project, and Generally concur with its methodology and conclusions. This report is not - and was never intended to be - a precise analysis of all the benafite and their recipients; because the scope of such an analysis is so large that its evat might exceed the cost of the project itself. Bather, it is intended to determine the order of magnitude of public and private benefits derived from the pro,',•ect - whether the public. receives a minority of the benefits, half of the benefits, or a substantial majorit) of the benefits. We beliave that this analysis does inlit care clearly that a Substantial preponderance of the benefits do accrue to the public. This ratio of public benefits would have been even higher, if public agencies other than the city had been included in the analysis. Our calculations indicate that if only the benefits of higher assessed values had beer. quanrified for other public agencies receiving property tax revinue (school districts, country, etc.), thr percentage of public Lenefits would be in the grange of 85% to 87%. if, in addition, the reduced cost to the school di-tticc of the two alternative development,. pcssibi:ities of the Jerwel. properties had been evaluated, the percentage of public be'2fits would undoubtedly have exceeded 90%. r s- 14 r r r1 j #r } .. r1✓ Because,of necessity, all of the bansficiariee have not been identified, not their benefits preci.stly defined, tre City Councii should nc.t give too such authority to the precise distribution of benefits derived in the report. The consultants computed all, of the shares to two decimal places, i.e., to one -one hundredth of a per cent, but this is clearly a camp of ovar-precision. We do not believe that the consultants intended to convey that Huntington Center, for e-x=ple, receives exactly 2.77x of the total benefits of the project. A better form of expreasion probably would have bean to conclude that the ownera of Huntington Center would almost certainly receive some scouamic benefit from the proposed project, and that their percentage of total benefits would be very small, perhaps in the range of 1% to 4%. The same type of imprecise atatewent might also, of course, be applied to each of the other parties. a T.terefore, the City Council should not consider this report as an automatic decision maker, to be applied With total equity merely by arithmetic. The conclusions reached are much too imprecise for that type of approach. All that this report really says in that most of the benefits of the project will accrue to the public sector, and that if they could be precisely quantified, that would probably fall into the range of 80% to 90% of the total benefits. How can any private entity agree to chart a definite percentage of a project of unknown cost, +mid whose scope he cannot control? ...Because the three department starers are nationwide chairs whose financial decisions are not wade locally, more preciet data and a lengthy delay would undcubtedly be needed to secure a guarantee of their participation in coots. ...What we+rld happen if one of the five private parties involved declined to share coats? Would the project be Jropped, car vould the city pay his tAsare? Based on these considerations, we urge the Council to proceed with at '.east the design phase_ of this ivrortant project, without attaching a pre -condition of privatc participation in sn) arbitrary amount.
