The Department of transportation hereby offers to sell the above -
referenced property to the City of Huntington Beach for the
appraised value of The following portion of this
letter, when the duplicate copy is executed and returned to
you with a Resolution from the City Council, will constitute
the agreement for the purchase. This Resolution must indicate
that said property will be purchased for public purposes.
The description of the public use must be specified in the Reso-
lution. In the absence of the Resolution, a clause will be
added to the Director's Deed restricting, the property to a
public use,.
This transaction will not be processed for the California High-
way Commission's approval until the duplicate copy of this
letter is fully executed and returned with the Resolution.
If these two documents are not returned to the undersigned by
June 15, 1977, then the above property will be processed for
sale by other means.
The City of Huntington Beach, hereil,after knot -in as purchaser,
offers to acquire from the California Department of Transpor-
tation that certain property referred to above and depicted
on the attached map for the State's appraised value of $154,100.00,
to be paid upon demand and prior to the State's forwarding
a fully executed and recoeded Director's Deed.

title and interest in the property to be transferred by this

and that no Policy of Title Insurance will be furnished or
escrow fees paid by the State of California in this transaction.
It is sxpressly agreed by the purchaser that the State of

way or highway, slope, and/or drainage rights as indicated
on the enclosed map.
It is further understood that, the purchasci shall not have
use of the property until a Director's Deed has been recorded.
It is also mutual ly agreed that the purchaser wil I assume respon-
sbility for all relocation benefits that iiay accrue to existing

City staff met with Property Agents of the State Department
of Transportation (Cal Trans) this week and reviewed the
City and State appraisals of property parcel 049496-01-01
1.75 acres fronting on the west side of Delaware Street
3001 south of Yorktown Avenue in the p-.-oposed "Old Town"
park site area (See attached map).
City staff has agreed to accept the compromise asking price
of $154,100 for the 1.75 acre parcel as indicated in the at-
tached letter from Mr. Dean Edwards, Right of Way Agent, State
Department of Transportation. The original asking price in
May, 1976 was $242,100. The Davis -Baker appraisal in October
1976 reflected a vnlue of $103r000.
RECOWIENDATION:
R6quest He City Council to approve tile attached resolution
to purchase the 1.75 a.*re Cal Trans property within the "Old
Town" park site.

of land including a butler building recently purchased by the City
from the State of California Department of Transportation for park
purposes in the "Old Town" neighborhood. E I G paid the State
$450 per month for rental of the property arid would like to continue
the rental with the City on a morith-to-month basi,. until the site
is de,�qloped as a park.
Mr. DeLaLoza and I would like t%-. meet with you or one of your
deputy attorneys to draw up a draft lease between the City and E & G
Engineering on a month -to -month occupancy.
