this agreement at its pleasure and Lake settlement with CONSULTANT
upon an equitable basis.

This is a follow'up to the request for City Council approval of the
second contract with Donald Fris.--heir and Associates for the San Diego
Frae vAy off ramp study. The request caused the following questions from
the City Council:
�1. Why did l ut: the first agreement include provisions for information
ntm requested?
7. W!aere will funds come from and how does the project relate financially
.to other road projects?
3. How abut getting the cost shairing formula firmed up before we proceed
with any additibna l work?'
My reply to the above is:
1.
The first: agreement called far a study as to the feaisibility of making
changes to the road system. if it proved to be infeasible from an
engineeeing and financial standpoint, the matter Tfrculd have been dropped.

Now that it appears to be feasible traffic --wise, additional information
will be: necessary to expedite the rciquest for perr.lts from Cal Tans
and FHWA.
2.
Funds for the City participation of the engineering studies comes from
22! 07. 5 Gays Tax funds. There is currently about $15, 000 in that fiend.

Cost of engineering plans and specifications and construction can coma
t
frcm 2106 and 2107 Gas Tax funds. Participation in this project will
delay other planned road projects.
3.
Huntington Center and Jerwel Enterprises, the two properties adjacent
to thi proposed work, h;evea not committed to any share formula for the
plans and construction. Due to the corporate structures of Huntington
center and the major stor+ea , I don't 2nticipatc that resolution for
fz:veral months. I have a written communication from Je:rwril Enterprisers
that they will guarantee funds for 50% of the cost of this second study.
They will coordinate the collec.::fon of any other private funis for the
at-ady.

Proceed with the study as requested, with A 50-50 split cast between
City and private*

wait for an agreement as to cost split before proceeding with a
.;ontract for further ,studies.

Have the C ty traffic engineering staff provide the additional traffic

Alternatee s and C would deilay the permit process by a minimum of ttxee
months. The review by Cal Trans and FHWA has momentum and interruption at
this time would have a certain but unknown effect on further delay. I
recommend that the City Council select Alternate A.
To keep you up to date I have been meeting with Cal Trans personnel
regarding a possible engineer's agreement k-atween the City and State whereby
the State will prepare the plans and specifications. The State is not in a
position to participate in the cost; howaver, it would be to our advantage
to have them prep-4r3 the plans instead of gotnq to a private engineering firm.

No. 2 for San Diego Freeway Off stamp
The modification study of the Beach Boulevard interchange at, the
San Diego Freeway has been completed by the cis• su,ltant nonald , ri.scher
and Associates in accordance with the agreement dated May 20, 1975.
The results of the report were presented to California Department of
Transportation and Federal Highway Administration personnel and adjoining
property owners at a meeting on August 13. The conceptual plan as out-
lined in the report was favorably received by -those in attendance and
further contact indicates that Cal Frans and FHWA will cooperate IrL efforts
to obtain approval for the project.
In order to expedite the second phase which will be the preparation
of plans and the preparation of the environmental document., additional
consulting servicen will. be required such as:
1. Cal Trans and FHWA representat ..ves have indicated tMt additio%al
Cinformation on detail data may be required for the evaluation of
the proposed interchange modification. This would irnolude an evalua-
tion of the planned signal system on Beach Boulevard and its relation-
ship with the proposed interchange modification.
2. The City's Environmentg.l Ramourcen group will be preparing the
environmental impact document which will require additional traffic
engineering data.
3. Several conferences with the representatives of Cal Trans and FHWA
pertaining to the design and environmental impacts will be necessary
and should involve the consultant.
4. I)ea{.gn hearings and environmental hearings may require the attendance
of the consultant.
it is recommended that we enter into a second agreement with
Don rrischer and Associates to provide the services outlined above. I
suggest that he be retained on a hourly basis with an initial budget not to
exceed $5,000.00. Any work to be Performed by Fr.ische+r would only be
performed with my authorization. it is recommended that the C� ty
provide money out of Gas Tax funds for the engineering services with
a provision for a refund from Jerwel Enterprises and Huntington Center
on an equitable cost sharing basis to be established for the project.

Gentlemen:
The City Council previou3ly approved the subject agreement
in concept and authorized the Administrator to execute the
argre ent can behalf of the Council. However, the City Attorney's
office informs us that per Section 518 of the City Charter the
agre meat must be approved by the City Council and executed by
the Mayor.
AoCordingly, transmitted herewith is the Consultant'c
Agreement prepared by the City Attorney's office. It is recom-
mended that the City Council approve the agreemcnt ane iuthorixe
