Statement of Issue:
Should the city proceed with the hiring of a consultant for professional architectural services
to develop the plans and specifications for four remaining buildings to be built on the
Huntington Beach Pier?
Fundinq Source: Pier Fund.
Recommended Actions:
1. Motion to approve staffs selection of Dougherty & Dougherty Consultants, (a
professional architectural firm) to perform the work as outlined in the Request for Proposals
for Professional Architectural Services dated March 1998;
2. Motion to approve the attached agreement with Dougherty & Dougherty Consultants,
authorize the Director of Public Works to expend $68,026 to cover contract costs of $57,726,
estimated contingency costs of $5,800 and supplemental expenditures of $4,500, and
authorize Mayor and City Clerk to execute agreement; and
3. Motion to approve an amendment to the Fiscal Year 97/98 budget to allocate $68,026
from the Pier Fund for design development, environmental processing, preparation of
construction documents and renderings for the Huntington Beach Pier Buildings Project.
Alternative Action(s): Deny approval of the agreement and forego the all project tasks to
be performed by the consultant.
Analysis: With the development and construction of the Huntington Beach Pier, Ruby's
Diner, and Pier Plaza completed, city staff requested proposals from qualified architectural

firms for obtaining all city, county, state project approvals for the design development and
environmental phases of four pier buildings (Lifeguard Tower Zero, Pier Rest Room,
Bermline Snack Shop and Bait & Tackle Shop).
Staff has also directed the consultant to proceed with the planning, design and preparation
of construction plans, specifications, detailed cost estimates, and bid documents for two of
the four pier buildings (Lifeguard Tower Zero, Pier Rest Room).
On March 11, 1998, staff mailed requests for proposals to four qualified architectural firms,
and on April 6, 1998, received two proposals from the following firms:
1. Dougherty & Dougherty, Costa Mesa
2. HMR Architects AIA, Huntington Beach
On May 8, 1998, a four member committee submitted independent written evaluations of
each proposal on the basis of qualifications and experience of key individuals, staff
availability, references, successful completion of similar projects, and quality of proposal.
Staff, therefore, recommends hiring Dougherty & Dougherty.

THIS AGREEMENT, made and entered into this tb day of
4U(�u6r 9 1998, by and between the City of Huntington Beach, a
municipal corporation of the State of California, hereinafter referred to as "CITY", and
DOUGHERTY & DOUGHERTY, a general partnership, hereinafter referred to as
"CONSULTANT".
WHEREAS, CITY desires to engage the services of a consultant for architectural services
to design and develop construction plans and specifications for four pier buildings, in the City of
Huntington Beach; and
Pursuant to documentation on file in the office of the City Clerk, the provisions of
HBMC Chapter 3.03 relating to procurement of professional service contracts has been complied
with; and
CONSULTANT has been selected to perform said services,
NOW, THEREFORE, it is agreed by CITY and CONSULTANT as follows:
WORK STATEMENT
CONSULTANT shall provide all services as described in the Request for
Proposal, and CONSULTANT's proposal dated April 3, 1998 (hereinafter referred to as Exhibit
"A"), which is attached hereto and incorporated into this AGREEMENT by this reference. Said
services shall sometimes hereinafter be referred to as "PROJECT."

CONSULTANT hereby designates Betsy Olenick Dougherty, who shall represent it and
be its sole contact and agent in all consultations with CITY during the performance of this
AGREEMENT.
2. CITY STAFF ASSISTANCE
CITY shall assign a staff coordinator to work directly with CONSULTANT in the
performance of this AGREEMENT.
3. TIME OF PERFORMANCE
Time is of the essence of this AGREEMENT. The services of CONSULTANT
are to commence as soon as practicable after the execution of this AGREEMENT and all tasks
specified in Exhibit "A" shall be completed no later than seven (7) months from the date of this
AGREEMENT. These times may be extended with the written permission of CITY. The time
for performance of the tasks identified in Exhibit "A" are generally to be shown in the Scope of
Services on the Work Program/Project Schedule. This schedule may be amended to benefit the .
PROJECT if mutually agreed by CITY and CONSULTANT.
4. COMPENSATION
In consideration of the performance of the services described herein, CITY agrees
to pay CONSULTANT fees set forth in CONSULTANT's Fee Proposal, dated April 3, 1998,
and as amended by CONSULTANT's Amended Fee Proposal, dated April 14, 1998 (both of
which- are hereinafter referred to as Exhibit "B"), which total fees shall not exceed fifty-seven
thousand seven -hundred twenty-six dollars ($57,726.00).

5. EXTRA WORK
In the event CITY requires additional services not included in Exhibit "A," or
changes in the scope of services described in Exhibit "A," CONSULTANT will undertake such
work after receiving written authorization from CITY. Additional compensation for such extra
work shall be allowed only if the prior written approval of CITY is obtained.
6 METHOD OF PAYMENT
A. CONSULTANT shall be entitled to progress payments toward the fixed
fee set forth herein in accordance with the progress and payment schedules set forth in Exhibits
B. Delivery of work product: A copy of every technical memorandum and
report prepared by CONSULTANT shall be submitted to CITY to demonstrate progress toward
completion of tasks. In the event CITY rejects or has comments on any such product, CITY
shall identify specific requirements for satisfactory completion. Any such product which has not
been formally accepted or rejected by CITY shall be deemed accepted.
C. CONSULTANT shall submit to CITY an invoice for each progress
payment due. Such invoice shall:
1) Reference this AGREEMENT;
2) Describe the services performed;
3) Show the total amount of the payment due;
4) Include a certification by a principal member of the
CONSULTANT's firm that the work has been performed in
accordance with the provisions of this AGREEMENT; and

5) For all payments include an estimate of the percentage of work
completed.
Upon submission of any such invoice, if CITY is satisfied that
CONSULTANT is making satisfactory progress toward completion of tasks in accordance with
this AGREEMENT, CITY shall promptly approve the invoice, in which event payment shall be
made within thirty (30) days of receipt of the invoice by CITY. Such approval shall not be
unreasonably withheld. If CITY does not approve an invoice, CITY shall notify
CONSULTANT in writing of the reasons for non -approval, within seven (7) calendar days of
receipt of the invoice, and the schedule of performance set forth in Exhibit "A" shall be
suspended until the parties agree that past performance by CONSULTANT is in, or has been
brought into compliance, or until this AGREEMENT is terminated as provided herein.
D. Any billings for extra work or additional services authorized by CITY
shall be invoiced separately to CITY. Such invoice shall contain all of the information required
above, and in addition shall list the hours expended and hourly rate charged for such time. Such
invoices shall be approved by CITY if the work performed is in accordance with the extra work
or additional services requested, and if CITY is satisfied that the statement of hours worked and
costs incurred is accurate. Such approval shall not be unreasonably withheld. Any dispute
between the parties concerning payment of such an invoice shall be treated as separate and apart
from the ongoing performance of the remainder of this AGREEMENT.
7. DISPOSITION OF PLANS, ESTIMATES AND OTHER DOCUMENTS
CONSULTANT agrees that all materials prepared hereunder, including all
original drawings, designs, reports, both field and office notices, calculations, maps and other

documents, shall be turned over to CITY upon termination of this AGREEMENT or upon
PROJECT completion, whichever shall occur first. In the event this AGREEMENT is
terminated, said materials may be used by CITY in the completion of PROJECT or as it
otherwise sees fit. Title to said materials shall pass to CITY upon payment of fees determined to
be earned by CONSULTANT to the point of termination or completion of the PROJECT,
whichever is applicable. CONSULTANT shall be entitled to retain copies of all data prepared
hereunder.
8. INDEMNIFICATION AND HOLD HARMLESS
CONSULTANT shall protect, defend, indemnify and hold harmless CITY, its
officers, officials, employees and agents from and against any and all liability, loss, damage,
expenses, costs (including, without limitation, costs and fees of litigation of every nature) arising
out of or in connection with CONSULTANT's performance of this AGREEMENT, or its failure
to comply with any of its obligations contained in this AGREEMENT, except such loss or
damage which was caused by the sole negligence or willful misconduct of CITY.
9. WORKERS' COMPENSATION
CONSULTANT shall comply with all of the provisions of the Workers'
Compensation Insurance and Safety Acts of the State of California, the applicable provisions of
Division 4 and 5 of the California Labor Code and all amendments thereto; and all similar state
or federal acts or laws applicable; and shall indemnify, defend and hold harmless CITY from and
against all claims, demands, payments, suits, actions, proceedings and judgments of every nature
and description, including attorney fees and costs presented, brought or recovered against CITY,

for or on account of any liability under any of said acts which may be incurred by reason of any
work to be performed by CONSULTANT under this AGREEMENT.
10. PROFESSIONAL LIABILITY INSURANCE
CONSULTANT shall furnish a professional liability insurance policy covering
the work performed by it hereunder. Said policy shall provide coverage for CONSULTANT'S
professional liability in an amount not less than $1,000,000 per occurrence and in the aggregate.
A claims made policy shall be acceptable if the policy further provides that:
The policy retroactive date coincides with or precedes the professional
services contractor's start of work (including subsequent policies
purchased as renewals or replacements).
2. CONSULTANT will make every effort to maintain similar insurance
during the required extended period of coverage following project
completion, including the requirement of adding all additional insureds.
3. If insurance is terminated for any reason, CONSULTANT agrees to
purchase an extended reporting provision of at least two (2) years to
report claims arising from work performed in connection with this
AGREEMENT.
4. The reporting of circumstances or incidents that might give rise to future
claims.
Under no circumstances shall this insurance contain a self -insured retention, or a
"deductible" or any other similar form of limitation on the required coverage in
excess of zero dollars.

11. CERTIFICATES OF INSURANCE
Prior to commencing performance of the work hereunder, CONSULTANT shall
furnish to CITY certificates of insurance subject to approval of the City Attorney evidencing the
foregoing insurance coverages as required by this AGREEMENT; said certificates shall:
a. provide the name and policy number of each carrier and policy;
b. shall state that the policy is currently in force; and
shall promise that such policies shall not be suspended, voided or canceled
by either party, reduced in coverage or in limits except after thirty (30) days prior
written notice; however, ten (10) days prior written notice in the event of
cancellation for nonpayment of premium.
CONSULTANT shall.maintain the foregoing insurance coverages in force until
the work under this AGREEMENT is fully completed and accepted by CITY.
The requirement for carrying the foregoing insurance coverages shall not derogate
from the provisions for indemnification of CITY by CONSULTANT under the AGREEMENT.
CITY or its representative shall at all times have the right to demand the original or a copy of all
said policies of insurance. CONSULTANT shall pay, in a prompt and timely manner, the
premiums on all insurance hereinabove required.
12. INDEPENDENT CONTRACTOR
CONSULTANT is, and shall be, acting at all times in the performance of this
AGREEMENT as an independent contractor. CONSULTANT shall secure at its expense, and be
responsible for any and all payment of all taxes, social security, state disability insurance
compensation, unemployment compensation and other payroll deductions for CONSULTANT

and its officers, agents and employees and all business licenses, if any, in connection with the
services to be performed hereunder.
13. TERMINATION OF AGREEMENT
All work required hereunder shall be performed in a good and workmanlike
manner. CITY may terminate CONSULTANT's services hereunder at any time with or without
cause, and whether or not PROJECT is fully complete. Any termination of this AGREEMENT
by CITY shall be made in writing, notice of which shall be delivered to CONSULTANT as
provided herein.
14. ASSIGNMENT AND SUBCONTRACTING
This AGREEMENT is a personal service contract and the supervisory work
hereunder shall not be delegated by CONSULTANT to any other person or entity without the
consent of CITY.
15. COPYRIGHTS/PATENTS
CITY shall own all rights to any patent or copyright on any work, item or material
produced as a result of this AGREEMENT.
16. CITY EMPLOYEES.AND OFFICIALS
CONSULTANT shall employ no CITY official nor any regular CITY employee
in the work performed pursuant to this AGREEMENT. No officer or employee of CITY shall
have any financial interest in this AGREEMENT in violation of the applicable provisions of the
California Government Code.

17. NOTICES
Any notice or special instructions required to be given in writing under this
AGREEMENT shall be given either by personal delivery to CONSULTANT's agent (as
designated in Section 1 hereinabove) or to CITY's Director of Public Works as the situation shall
warrant, or by enclosing the same in a sealed envelope, postage prepaid, and depositing the same
in the United States Postal Service, addressed as follows:

CONSULTANT shall be responsible for full compliance with the immigration
and naturalization laws of the United States and shall, in particular, comply with the provisions
of the United States Code regarding employment verification.
19. LEGAL SERVICES SUBCONTRACTING PROHIBITED
CONSULTANT and CITY agree that CITY is not liable for payment of any
subcontractor work involving legal services, and that such legal services are expressly outside the
scope of services contemplated hereunder. CONSULTANT understands that pursuant to
Huntington Beach City Charter Section 309, the City Attorney is the exclusive legal counsel for
CITY; and CITY shall not be liable for payment of any legal services expenses incurred by
CONSULTANT.

20. ATTORNEY FEES
In the event suit is brought by either party to enforce the terms and provisions of
this AGREEMENT or to secure the performance hereof, each party shall bear its own attorney
fees.
21. ENTIRETY
The foregoing, and Exhibits "A" and `B" attached hereto, set forth the entire
agreement between the parties.

I. INTRODUCTION
Huntington Beach continues a strong program of capital improvement in and around the
Huntington Beach Pier area. It began in 1992 with the rebirth of a landmark --the Huntington
Beach Pier. In a single weekend event, the reopening was celebrated by over 500,000
people. The next step for the City was to fund and develop five new pier buildings. The first
was Ruby's Surf City Diner. It opened in June of 1996. Its architecture replicates the
"Sunshine Room" that resided on the end of the City's historic 1914 pier. Four buildings have
yet to be designed and built. The City desires proposals from qualified architectural firms for
the planning, design and preparation of construction plans, specifications, detailed cost
estimate, and bid documents for the four remaining buildings. Two of the four buildings
have a construction set of plans developed -- Tower Zero (Lifeguard Facility) and the Pier
Public Restroom. However, these plan sets were developed by an architectural firm over
five years ago. The sets shall be considered reference only. The consultant shall be
responsible for producing all four building project plans, specifications, detailed cost
estimate, and bid documents and obtaining all City, County, and State project approvals
and environmental clearances.

III. PROJECT DESCRIPTION
Generally, conceptual drawings of all four buildings have been approved. Building one is
Life Guard Tower Zero. It is proposed as a tri-level octagonal structure of approximately 360
square feet. However, the square footage is subject to review and a possible increase of
300 square feet. Building two is the Pier Restroom. It is proposed as a single story six -sided
oblong structure of approximately 800 square feet. The other two structures, buildings three
and four, are proposed single story of like design to the pier restroom. One is a "Bermline
Snack Shop" and the other is a bait & tackle shop. Approximate square footage's for each
are 630 and 800, respectively, both to accommodate future concessionaires.
All of the proposed buildings will be design with the exact red tile roof of Ruby's at the end
of the pier. Previous design incorporated terrazzo finishes. These finishes are no longer
desired by the City and should not be incorporated into new designs.
The consultant shall approach this project with the understanding that the City desires to
fast -track the Tower Zero and Pier Restroom buildings. However, the City does not want the
consultant to have to double the amount of required project design development and
environmental approvals. The consultant shall bring all four buildings through the these
processes together. Once these approvals have been obtained, the consultant will
proceed on a fast -track with the plan preparation and construction bid documents of
Tower Zero and the Pier Restroom buildings. The City desires to have Tower Zero and Pier
Restroom out to bid by August 1998 and award the construction contract by October 1998.
The consultant shall discuss their proposed schedule and how their approach to the project
will be undertaken to meet these target dates. The consultant shall present a fee proposal

reflective of this condition. It must be structured in a two phase format similar to the
following:
PHASE I
• Project Design Development & Environmental Review (All four Buildings)
• Construction Document Preparation for Tower Zero & Pier Restroom.
PHASE II (Optional)
• Construction Document Preparation for Pier Concession Buildings
The City considers Phase II an option and dependent upon available funding once Phase I
is complete.
IV. SCOPE OF WORK
Although the City, in its RFP has attempted to identify the limits and services required, this
should not constrain the Consultant in the development of a scope he believes is necessary
to meet the City's objectives.
City staff, through the design development process, has established the size, shape, mass,
and colors of each structure. Attached are the approved elevations and floor plans for
each structure, see Attachment "A". Each structure shall include the following specific
architectural features identical to Ruby's at the end of the pier:
1. Exterior building surface shall be stucco.
2. Roof shall be red tile.
3. Construction techniques shall incorporate provisions for the murals in the recessed
areas of the buildings. (Note: The finish of the area set aside for the murals will be
determined by cost. The consultant proposal shall include alternate finishes and
estimated costs.)
The scope of architectural services, as outlined below, shall include; design development
and environmental processing, preparation of construction documents, administration of
bidding, technical support during construction, and project acceptance.
The City will be receptive to innovative or alternative scopes of services.

partitions, walls, utilities to tenant fixture locations, handicap lift, stairs, and
restrooms. Four Meetings
3. Confirm that buildings meet Title 24 and ADA compliance.
4. Determine utility requirements for each structure. Determination must include an
analysis of the existing pier utility chase capacity.
5. Determine structural support requirements for each structure and compare to
current load maximum of pier.
6. Coordinate the receipt of all tenant improvement plans.
7. Presentation to and approval of, City Planning Commission.
8. Presentation to and approval of, City Design Review Board.

1. Prepare all plans, specification, and cost estimates including the following items:
• Pier location plans
• Respective building floor plans
• Exterior elevations and sections
• Reflected ceiling plans
• Schedules
• Roof plans

• Electrical power and lighting plans

Construction drawings, complete with the stamp and signature of an architect or civil
engineer, shall be prepared on Huntington Beach title block, 24x36 mylar sheets(s), using
AutoCad version 13 and in accordance with the City's Autocad Standards Manual
(ASM) for plan preparation, see Attachment "B".
2. Prepare construction specifications and bidding documents for the project. The
City will provide a Microsoft Word version 6.0 of the General Provisions and bid
forms; the consultant will modify by adding necessary special provisions and bid
items.
3. Perform all necessary investigations and measurements required to prepare the
preliminary plans and construction drawings.

4. Prepare estimates of probable construction costs for the project. The estimates
shall be in Microsoft Excel version 5.0.
5. Attend periodic meetings with City staff during the preparation of preliminary
and construction drawings and obtain all applicable project approvals and
permits.
6. The plans, calculations, specifications, and estimates shall be processed through
the City for review and approval. The building plans will be processed through
the City Building & Safety Division for plan checking. Submittals of plans,
specifications and estimates shall be made at the 65% and 100% completion
stages.
7. Based upon an approval of the preliminary plans and cost estimates, the
architect shall prepare and provide 40 sets of necessary construction drawings
and specifications as required to advertise the project for bids. (Note: This task
includes the cost of all miscellaneous printing, etc. for plan checking and final
drawings.)
Administration of Biddinq
1. The advertising for bids and awarding of a contract for these buildings will be
administered by City staff. However, the architect will be required to:

3. Address and issue all addenda.
4. Assist in informal evaluation of bids.
Technical Support During Construction
1. Interpret plans and specifications.
2. Review and approve all shop drawings.

construction change orders.

1. Conduct final project review and prepare "punch list."
2. Provide one acceptable set of reproducible "as-builts" mylar drawings. (Note:
10% of the contract amount will be withheld until the "as-builts" are submitted
and approved.)

A. Preliminary building elevations and floor plans depicting the location, size, and
form of each building are attached for reference, see Attachment "A".
B. A reduced set of previously completed construction drawings of Lifeguard Tower
Zero and the Pier Restroom Building are attached for reference, see Attachment

V. FEE PROPOSAL REQUIREMENTS
Compensation for services provided shall be based upon the Consultant's detailed
fee proposal to furnish the services detailed in his proposal.
The consultant shall state in the fee proposal the number of hours allotted in its fee
amount for attending meetings with City Staff. Additional hours beyond that which
is stated in the fee proposal, must have City prior authorization.
The Consultant shall prepare progress billings, reflective of the project schedule and
the scope of work completed, by line item and description.
VI. PROPOSAL REQUIREMENTS
Although no specific format is required by the City, this section is intended to provide some
guidelines to the Consultant on features which the City will look for and expect to be
included in the proposal.
1. Content & Format,
The City requests that proposals submitted be organized and presented in a neat
and logical format and be relevant to these services. Consultant's proposals shall
be clear, accurate, and comprehensive. Excessive or irrelevant material will not be
favorably received.
Proposals shall contain no more than 20 typed pages using a 10 point minimum font
size, including transmittal/offer letter and resumes of key people, but excluding
tables, charts and graphs exhibits. The purpose of these restrictions is to minimize the
costs of proposal preparation and to ensure that the response to the RFP is fully
relevant to the project. The separately submitted Fee Proposal should contain only
enough pages to clearly respondwith the information that is requested in the RFP.
A primary component of the proposal to be submitted will be information setting
forth the experience and qualifications of the Consultant. The Consultant will either

be a single firm or group of firms which have developed a team structure for the
project.
The proposal should include the following:
• Page numbering.
• Index/Table of Contents.
• Team Organization including an organization diagram.
• Approach to the Project
• Descriptions of similar projects by key staff to be used on this assignment.
• Brief resumes of key staff.
• Project schedule.
• Transmittal/offer letter.
2. Scope of Services
A description of the work program that will be undertaken shall be included in this
section. It should explain the technical approach, methodology, and specific tasks
and activities that will be performed to address the specific issues and work items
identified in the RFP. It should also include a discussion of constraints, problems and
issues that should be anticipated during the contract, and suggestions for approach
to resolving problems.
3. Statement of Qualifications
The information requested in this section should describe the qualifications of the
firm, key staff and subconsultants in performing projects within the past five years
that are similar in scope and size to demonstrate competence to perform these
services. The projects listed shall be those that the key staff named for this project
were responsible for performing services. Information shall include:
• Names of key staff that participated on named projects and their specific
responsibilities.
• The client's name, contact person, addresses, and telephone numbers.
• A brief description of type and extent of services provided.
• Completion dates (estimated, if not yet completed).
• Total costs of the projects.
A sample format for presentation of the above prescribed information is included as
Attachment "D" for the consultant's reference.
There should be included in the section brief resumes of key personnel who will
provide these services demonstrating their qualifications and experience. Resumes
should highlight education, experience, licenses, relevant experience, and specific
responsibilities for services described.
4. Project Team
The purpose of this section is to describe the organization of the project team
including subconsultants and key staff. A project manager shall be named who

shall be the prime contact and be responsible for coordinating all activities with the
City. An organization diagram shall be submitted showing all key team members
and illustrating the relationship between the City, the project manager, key staff,
and subconsultants. There also should be a brief description of the role and
responsibilities of all key staff and subconsultants identified in the team organization.
5. Project Schedule
A project schedule shall be included which identifies in graphical format the
timetable for completion of tasks, activities and phases of the project which
correlate with the scope of work for the project. The schedule should identify
important milestones and decision points. There should be a brief discussion of any
key assumptions used in preparing the timetable and identification of critical tasks
and/or events that could impact the overall schedule.
6. Fee Proposal
A Fee Proposal shall be submitted in a separate, sealed envelope and marked as
"Fee Proposal" along with the name of the project. The information and detail
included in the fee proposal shall conform to the provisions of Section V, Fee
Proposal Requirements, of this RFP.
A work program together with a breakdown of labor hours by employee billing
classification together with the cost of non -labor and subconsultant services shall be
included with the fee proposal. The labor breakdown shall be compiled based
upon a listing of work tasks that correlates with the consultant's defined scope of
work for the project proposal. This information will be used by the City staff to
evaluate the reasonableness of the fee proposal and may be used in negotiating
the final fee amounts for the contract agreement.
The fee proposal of the three top ranked consultant will be opened at the
conclusion of the consultant evaluation and selection process. Fees will not be used
to determine the ranking of the consultants. The Fee Proposals of those consultants
not ranked in the top three will be returned to them unopened upon award of a
contract to the selected consultant.
The city will negotiate the final fee with the top ranked consultant.
Reimbursable expenses shall not be allowed unless negotiated prior to a contract.
Price escalations during the contract term are not normally allowed, and must be
negotiated prior to execution of contract.
7. Statement of Offer & Signature
The proposal and separate fee proposal shall each be signed by an individual
authorized to bind the consultant and both shall contain a statement that the
proposals are a firm offer for a 60-day period from the due date of the proposal.

VII. GENERAL REQUIREMENTS
1. Insurance Requirements
The consultant shall furnish, with the proposal, proof of the following minimum
insurance coverage. These levels of coverage are required to be maintained for
the duration of the project:
A. General Liability Coverage - $1,000,000 CSL (Combined Single Limits) per
occurrence (note: If provided coverage is under a form which includes
designated general aggregate limit, the aggregate limit must be no less then
$1,000,000) .
B. Professional Liability Coverage - $1,000,000 per occurrence (note: A "claims
made" policy is acceptable).
C. Worker's Compensation Coverage - $100,000 bodily injury by accident, each
accident; $100,000 bodily injury by disease, each employee; $250,000 bodily
injury by disease, policy limit.
The above detailed coverage shall not be subject to any deductible or self -insured
retention, or any other form of similar type limitation. In addition, the insurance
certificates must conform to the required wording of the City's Risk Manager. A
sample certificate is included as Attachment "E". The consultant is directed to the
cancellation portion of the 'certificate. It is imperative that this portion of the
consultant's insurance certificate be identical to the wording contained therein.
The consultant is encouraged to contact his insurance carrier during the proposal
stage to ensure that the insurance requirements can be met if selected for
negotiation of a contract agreement.
2. Standard Form of Agreement
The consultant will enter into an agreement with the City based upon the contents
of the RFP and the consultant's proposal. The City's standard form of agreement is
included as Attachment "F".
The consultant shall carefully review the agreement, especially with regard to the
indemnity and insurance provisions, and include with the proposal a description of
any exceptions requesting to the standard contract. If there are no exceptions, a
statement to that effect shall be included in the proposal.
3. Disclaimer
This RFP does not commit the City to award a contract, or to pay any costs incurred
in the preparation of the proposal. The City reserves the right to extend the due
date for the proposal, to accept or reject any or all proposals received as a result of
this request, to negotiate with any qualified consultant, or to cancel this RFP in part
or in its entirety. The City may require the selected consultant to participate in

negotiations and to submit such technical, fee, or other revisions of their proposals as
may result from negotiations.
4. Assigned Representatives
The City will assign a responsible representative to administer the contract, and to
assist the consultant in obtaining information. The consultant also shall assign a
responsible representative (project manager) and an alternate, who shall be
identified in the proposal. The consultant's representative will remain in responsible
charge of the consultant's duties from the notice -to -proceed through project
completion. If the consultant's primary representative should be unable to continue
with the project, then the alternate representative identified in the proposal shall
become the project manager. Any substitution of representatives or subconsultants
identified in the proposal shall first be approved in writing by the City's
representative. The City reserves the right to review and approve/disapprove all key
staff and subconsultant substitution or removal, and may consider such changes not
approved to be a breach of contract.
Vill. CONSULTANT EVALUATION & SELECTION PROCESS
The City's consultant evaluation and selection process is based upon Qualifications Based
Selection (QBS) for professional services. The following criteria will be used in evaluating the
proposals using a point value system (100 points possible) based upon the weighting
indicated below.
1. Grasp of the project requirements including identification of critical elements and
key issues. (10 points)
2. Technical approach and work plan for the project, including innovative approaches.
(25 points)
3. Qualifications and experience of project manager and other key individuals. (3C
points)
4. Results of reference checks. (15 points)
5. Clarity of Proposal. (10 points)
6. Compliance with proposal requirements including the 20 page limitation. (10 points)
The City may elect to interview a short list of qualified firms or only the top rated firm based
on the proposals submitted for the project.
A penalty of up to 10% will be assessed for failing to follow instructions. In addition, a 20%
penalty will be assessed for failing to comply with instructions regarding the 20 page
proposal limitation.
The City staff will negotiate a contract with the best qualified firm for the desired consulting
services at compensation which the City staff determines is fair and reasonable to the City.
Should the City staff be unable to negotiate a satisfactory contract with the firm considered
to be the most qualified, negotiations with that firm shall be formally terminated. City staff
will continue the negotiation process with the next most qualified firms in order of their
evaluation ranking until an agreement is reached and a firm is selected and an agreement
is executed.

' Scope of Services
' Description of the Work
The following itemization details the method of approach proposed for this project. These efforts will
' parallel your description of the scope of work as defined in the Request for Proposal. It will be extremely
important to strategize the composition of a project "committee," consisting of empowered representatives
of each City constituency. Opportunities for input will encourage an "inclusionary" process to ensure that
' all participants feel adequately represented. Partners Brian Paul Dougherty and Betsey Olenick Dougherty
contribute extensive experience in the facilitation of meetings and forums, and will both be actively
involved in this process.
' The proposed approach is as follows:
Team Orientation & Coordination
The initial step in the design process will be to meet with the appropriate City representatives for the
purpose of:
❑ understanding the expectations and development anticipated;
❑ developing a clear definition of the prepared program, design criteria and program objectives;
❑ refining a detailed project schedule;
' ❑ discussing budget limitations; and
❑ visiting the pier site, obtaining and reviewing all documentation of existing conditions.
' We believe the key to the success of this project is effective and thorough communication between the City
and all members of the design team to identify and resolve issues, thus allowing the necessary services to
proceed quickly and efficiently. We understand that our responsibilities include not only asking and
answering questions, but listening carefully. We perceive two major issues to be: interface with pier
utilities, of which we are very familiar; and the issues of site access during the peak visitor's season.
This phase includes intensive coordination/interface and progressive regular meetings with City
' representatives. Initially, the meetings will establish the guidelines and specific criteria to direct the team's
efforts. Thereafter, these meetings will provide a continuum to receive information, clarify input, inform
staff of progress and direction, generate information and allow the City the opportunity to review and
comment on concepts and recommendations. Meetings will be attended by the Partner -in -Charge and/or
' Project Manager who will be directly responsible for execution of the design documents.
Regularly scheduled in-house meetings will be held with members of the A/E team. Schedules and technical
' items will be reviewed and action will be taken as necessary to maintain adherence to an established
schedule.
' City Provided Services
The City shall designate representatives, authorized to act in the City's behalf with respect to the project. A
representative committee will be appointed, each person empowered to make decisions on behalf of their
' respective constituent group. The City shall also furnish the A/E team with all necessary reference data,
which includes, but is not limited to the following:
' ❑ funding limitations and phasing requirements;
❑ project requirements including program, constraints, and special criteria;
❑ preliminary building plans and elevations as previously developed;
❑ overall schedule goals with critical dates;
❑ site survey information including the location of all existing utilities and improvements.

' The City shall be responsible for the review of documents submitted and render decisions pertaining thereto
in a reasonably prompt manner, so as to avoid unreasonable delay in the orderly progress of services in
' order to meet schedule goals.
Design Development Phase
' This stage involves delineating the previously developed schematic designs into refined plans, reflecting
input from City representatives and other empowered and interested parties. Cost implications will be
discussed at this time. The architectural solutions will illustrate:
' ❑ successful response to the project program goals;
❑ adjacencies and interior/exterior circulation patterns;
' ❑ solutions to life safety and structural safety issues;
❑ the coordination of City -provided interior improvements;
❑ the aesthetic supportive articulation of space;
❑ visual and physical security measures;
' ❑ compliance with Title 24, and ADA; and
❑ compatibility with long-term maintenance and operations procedures.
The design development documents will clearly delineate the solutions in three dimensions. They will be
' presented for all four buildings, along with a statement of probable construction costs, to the City as
determined, for final approval prior to the development of construction documents. All required
presentations and approvals will be accomplished prior to proceeding with construction documents.
Construction Document Phase
' The construction document phase is a time of intense production on the part of the architectural and
engineering team. The Tower Zero and Pier Restroom buildings will proceed at this time with an option to
go forward with the concession buildings now or at a later date. The scope of work is as follows:
' ❑ submittals made at 65% and 100% completion;
❑ 95% drawings, specifications, and calculations submitted for plancheck;
❑ detailed estimate of probable construction cost submitted;
' ❑ 100% construction document backcheck and approval; and
❑ preparation for bid.
' Following approval, the City will prepare for the bid period. Documents are anticipated to be distributed
through the City, however those services can be provided by Dougherty + Dougherty.
Bid Phase
' The architectural and engineering team will respond to questions during the bid or negotiation period and
will issue addenda as required. Services include:
❑ response to telephone/FAX inquiries;
❑ issuance of addenda as required;
❑ attendance at the bid opening; and
' ❑ assistance in assessing the bids.
Please note that full bid period services can be made available to include printing, distribution and record -
keeping as an additional service.

' Construction Phase and Project Closure
' The architect will work closely with the City to build a partnering relationship with the selected contractor.
The architect will also coordinate finishes, colors, and the critical interface between construction and
furniture (FF&E) schedules. Typical construction period services include:
' ❑ attendance at regular meetings with minutes;
❑ responses to Requests for Information/Clarification;
❑ issuing of Requests for Proposal and Change Orders as required;
' ❑ review of submittals and shop drawings;
❑ maintenance of all logs;
❑ . review of Pay Requests;
❑ preparation of punch lists;
❑ issuing Certificate of Substantial Completion; and
❑ review and issuing of record drawings (mylar and electronic media).
Dougherty + Dougherty will follow through construction completion until all parties are satisfied that the
project is indeed complete and all guarantees and warranties are in place. We will also work with the City
to facilitate move -in and post -occupancy evaluations.

Statement of Qualifications

Brian Paul Dougherty, FAIA Partner in the firm of Dougherty + Dougherty, specializes in the planning and
design of contemporary educational, institutional, military, commercial, and health care facilities, in both the
public and private sector. His direct involvement in the life of a project includes design, management,
coordination and representation.
Prior to the formation of Dougherty + Dougherty, Mr. Dougherty was a Designer/Project Manager with
William L. Pereira & Associates. Projects include several buildings for Golden West College, Huntington
Beach, California and the UCI Medical _Center in Orange, California. As a former Director with Danielian
Associates, he contributes a background in planning projects. He joined Dougherty + Dougherty in 1981,
and continues to be personally responsible for all aspects of design, construction, and office management.
He will serve as Partner -In -Charge and will be personally responsible for this project. He has previously
served as Partner -in -Charge to projects for the City of Huntington Beach, and will be personally responsible

Neill Noble, AIA
Dougherty + Dougherty (WBE) Architect - Project Manager
Neill Noble, AIA, brings over thirty-five years of experience in architecture to the firm, including
his work for the California State Division of Architecture, the United States Army Corps of
Engineers and principal of the former firm of Anthony and Langford. As project manager, Neill
provides leadership and management of all design aspects of the project, from inception through
completion. His responsibilities include defining and organizing concepts established during the
programming phase, developing all phases of design, supervising the preparation of construction
documents, providing construction administration services, and maintaining on -going client
communication.
In more than twenty-five years of architecture in the private sector, Neill has been the project
architect and chief of design on over 150 major projects throughout Southern California; many of
which have received Honor and Merit Awards from the American Institute of Architects, California
Building Officials, and the Los Angeles Beautiful Society.
Neill has served the Orange County Chapter of the American Institute of Architects (AIA) as
Chairman of the Public Speaking Committee and has also served on the AIA Awards Committee.
Neill will serve as Project Manager for the proposed pier building projects.

A Mechanical Engineer since 1978, Mr. Vu's early experience includes design and engineering for
heating, air conditioning and ventilation systems for institutional and industrial buildings. Projects
included energy studies using computer programs to simulate weather conditions, actual building
construction, up -grade building construction and energy management control systems, power plant
steam piping system.
Mr. Vu has been associated with Dahl, Taylor & Associates, Inc. since 1981. He has been
responsible for all phases of HVAC&R, plumbing, environmental protection, fire protection and fuel
storage systems design for electronic telephone switching facilities, computer centers, public utility
customer service centers, data processing centers, vehicle maintenance facilities, hospitals, fire
stations, schools, post offices, and court buildings. He specializes in electronic microprocessor -based
energy management control systems and energy consumption analysis.
In 1991, Mr. Vu became President and Chief Executive Officer. In addition to being responsible for
the day -today technical and business management of the firm, he remains Principal -in -Charge of

Mr. Swann will be the Lead Electrical Engineer for the project. His responsibilities Mr. Swann will
lead the project electrical engineering team from pre -design through construction completion and will
be responsible for the overall electrical scheduling, design and coordination. Site adaptation of
drawings and calculations will be made as necessary for points of connection, and compliance with
the National Electrical Code.
Mr. Swann has over 14 years of experience in the field of electrical engineering. He has led electrical
design teams from conception through master planning, construction documents and construction
completion. He has been responsible for client relations, financial progress, scheduling and staffing.
His responsibilities encompass feasibility studies; conceptual, preliminary and final design; technical
specifications and cost estimates for power, distribution, lighting and signal systems, including life
safety, fire alarm, security, CCTV, telephone, data, paging, intercom and hospital signal systems.
At Dahl, Taylor & Associates, Inc., Mr. Swann is the Principal Electrical Engineer in charge of
managing the Electrical Engineering Department. He is responsible for assuring that clients' electrical
design requirements are met, from project inception to final approval and system commissioning.

If the City Council approves this action (total appropriation $68,026),
the estimated unappropriated, undesignated Pier Fund balance at
SWP,mber 30, 98 will be reduced to $1,593,000.

The city is moving forward with a Request for Council Action to award a professional
services consulting contract for the Huntington Beach Pier Buildings Project. The city
currently has an Assembly grant for $98,500 that we have to begin expending before the
end of the year. Therefore, this expense is covered by related new revenues. We need
to move forward expediciously in order to get the preparation plans underway in order to
qualify for the grant. Additional grants will be used to pay for actural construction of the
pier buildings including the rest room and Tower Zero.
