and expense, constructed a storm drain, hereinafter referred to ae +:ccili-
ties, to serve AuiAer's aubdtvision Tract No. 5792 and adjecetit properries
District 9, and said facilities have been constructed in conxr-)rmity with the
plans and specificttio'ns approved by the Director of PMblic Works of City,
and b&va been dedicated to City; and City desires to reyai �irse Builder for a

portion of the cost of the const ruction of said facilities as +p:•ovided by the
ordinance code,
NOW, THEREFORE, in considerbtton of the premises and agreements herein
contained, the parties hereto ogrea ss follows
Builder !:as constructed, aL a total cast of $88,007.56 a stcrm drain
anC 4ppurtenances to serve Tract 5792 and cdjacent properties. (See Exhibit
11A11 attached hereto and made a part hereof for a nisp of the area served)
and ht;s dedicated said facitiLien to City.
The refund to oe paid to Builder under this agreement -1a as follows:

No refund shall be rltode by City to Builder until the Director of publif
Wore shall certify in writing, to the yinante Director that luil.dst is

entitled to a refund by reason of connection having been made to facilities
is accordance with the Huntington Beath Ordinance Codev and that City has
received the fee for such connection.
City shall nct he liable for rayment of refund by reason of its failure
to collect or receive from any person or entity the drainage fee. However,
City agrees from an adm'.nistratire, legislative or quasi judicial procedure
to protect the interest of developers, either individuals or ent►_ties, who
have previously constructed similar facilities, by the collecting fees, either
prior to or concurrent with the development, of any property (served by the
facility constructer) under this agreement, If a developer who de,'el.cps property
served by the facility construesteal by Build,,x is required as a condition of
development to construct additional facilities, City may allow said developer
credit toward the per eereage fee consistent with this said agreement; and no
Nees shall be due Builder by reason of .such construction City further a;rees
to furnish a copy of this agreement to the developer of any properties served
by tha facilities described herein.
In the event City sloes not require a developer to deposit U.-e drainage
fe. with the City prior to or concurrent with development, City will provide an
agreement with said developer that said devel.lpLr is obligated, not only to
the City, but to Builder, and to developer., who have pre.viously ccntributed
to the coot. of construction of facilities constructed hereunder to deposit said
fee Cll.-y; said 3grerment will further provide that in the event that it

Euild'ar or developers, who have previously contributed to the cast of such
azilities, to enforce the rights of th,.� parties thereuiader, that the prevailing

Gentlemen:
T)oyle Development Company constructed th,', subject storm drain.
Fees in the amrunt of $24,629.41 have been collected from developers
in this drainage district and said sum is refundable to the developer
per the conditions of the agreement. This is the full balance of
this agreement.
It is requested that sum be reimbursed per the enclosed resolu-
tton and the check be made payable to Doyle Developmont Company and
the check be returned to this office for transmittal.
