RECOMMENDAT-014 Approve the attached resolution and direct the Mayo. to execute same. ANALYSIS The lease of the city -owned parking lot at Pacific Coast I3ilhway and Fifth street with Mr'. Eldon Hagstad, Owner' of the El Don liquor store, will terminate on June 19, 1980. We propose not to renew: the lease but to incorporate the lot into the business parking meter zone, _nstall five parking meters (in surplus), and charge ten cents an hour with an hour limit. A RESOLUTION OF THE CITY COUNClfj OF TEE CITY OF HUNTINGTON BEACH ESTABLISH114G PARKING METER ZONES, PRESCRIBING THE PARKING TIME ALLOWED IN SUCH ZONES, THE 14OURS DURING WHICH SUCK DEPOSITS ARE REQUIRED, AS PERMITTED BY CHAPTER 1C.60 OF T�iE I-IU14TI14GTON BEACH MUNICIPAL CODE WHEREAS, Chapter 10.60 of the Huntington Beach Municipal, Code provides that the City Council, by resolution, may estab- lish parking meter zones and may designate the parking time allowed followipg deposit of coins as provided in said chapter,, and the hours during which such deposits are required., NOW, THEREFORE, the City Council of the City of Huntington ; Beach does hereby resolve as follows: SECTION 1. Business ones (a) The boundaries of the business zones shell be as follows: 1. Within Plain Street right-of-way from Pacific Coast Highway to Orange Avenue. 2. Within Fifth Street ,right-of-way from Pacific Coast Highway to Orange Avenue. 3 • Within Walnut Avenue right-of-way from T,iird' Street to Fifth Avenue. 4. Within Olive Avenue right-of-way from Thivd Street to Fifth- Avenue. i (b) Twelve -minute meters and sixty -minute meters shall oe placed within such zones in specific locations to be determined by the Director of Community Servitses, (c) Coins shall be placed in such meters from 9'a.m. to 6 p.m. daily, including Saturdays, Sundays and holidays /ahb 6/9/8G. SECTION 2. RESIDENTIAL ZONES (a) The boundaries of the residential zones shall be as follows: 1. Within Lake Street right--of-way from Pacific Coast � Highway to Atlanta Avenue. 2. Within Second Street right-of-way from Pacific Coast Highway to Orange Avenue. 3. Within Third Street right-of-way from Pacific Coast highway to Olive'Avenue. y Within Walnut Avenue right-of-way from Lake Street to Third Street. Within Olive Avenue right-of-way from Lake Street to_1,hird Street.' (bl Sixty -minute meters, 120-minute meters and twelve-hour meters shall be placed within this zone in specific locations to be determined by the Director of Community Services. (c) coins shall be placed in such meters from 6-a.m. through 6 p.m. daily, including Saturdays, Sundays and holidays. SECTION 3. RECREATIONAL Z:.NES (a) The boundaries for the recreational zones shall be as follows: ZONE 1 Within Pacific Coast Highway right-of-way from Beach Boulevard to Goldenwest Street. ZONE 2: On the ocean side of Pacific Coast Highway right-of-way from Goldenwest Street to a paint which is 6,100 feet northwesterly of said Goldenwest Street. (b) Within Zone 1 twelve-hour meters shall be installed to show legal parking for a period of one (1) hour after deposit of two twenty-five cent coins (c) Within Zone 2 uwelve--hour meters shall be installeo to show legal parking for a period of one (1) hour after deposit of a twenty-five cent coin. (d) Sixty -minute meters, 120-minute meters, and twelve- hour meters shall be placed within this zone .in other specift,s s locations to be determined by the Diref, for of Community Services. (e) Coins shall be placed in such meters from 6 a.m. a 2, 737 �v T through 12 midnight daily,; including Saturdays, Sundays and j holidays. SECTION t Resolutions No. 3527,- 36•73, 3709 and 4742, and all other resolutions inconsistent herewith are hereby repealed. ARTICLE XI At all times during the term LESSEE shall at his cost and expense keep and maintain said LEASED PREMISES and all improvements thereon and all ADJOINING PREMISES appurtenant thereto in good order and repair and safe condition, and the whole of the land, improvements and landscaping in a clean, sanitary, orderly and attractive condition, and shall otherwise observe and comply with the terms of this lease and all laws, ordinances and regulations from time to time applicable to said LEASED PREMISES. ARTICLE XII If during the term hereof any imprcvement erected pursuant to this agreement by LESSEE on the 'LEASED PREMISES and ADJOINING PREMISES or any part thereof shall be damaged or destroyed, LESSEE shall at his cost and expense repair or restore the same according to original plans thereof or such qualified plans as shall be previously approved in writing by the LESSON... Such work, .repair or restoration shall be commenced within thirty (30) days after the damage or loss occurs and shall be completed with due diligence, but no longer than the remainder of the term of this agreement then remaining. All of LESSEE's improve- ments and all subsequent additions thereto and alterations therein or replacements thereof shall become and remain a part 5. w 1 of the leased land, subject to the use and occupancy of the LESSEE and none of the same shall be encumbered, transferred, removed or materially altered except as otherwise provided in this lease. Upon the expiration of the term or any other termination of this lease, all the improvements upon the LEASED PREMISES shall become the property of the LESSOR without payment of any consideration therefor. ARTICLE XIIS In addiiton to the rental LESSEE shall pay and. dis- charge all t,-xes, general and special assessments and taxes of any description which during the term of this lease may be levied upon or assessed against the ;Leased land and all other improve- ments and other property thereof or belonging to LESSOR or LESSEE and .for which either of them may become liable, inal+ading any possessory interest tax. ARTICLE XIV LESSEE shall at all times during the term hereof at his own cost and expense procure and continue in force bodily injury, liability and comprehensive insurance, and property damage liability insurances which policies shall. name LESSOR as an additional insured. Such insurance at all times shall be in amounts not less than the limits designated in Exhibit "Brr hereof which is attached hereto and incorporated by reference herein as though fully set forth in this Article XIII. LESSEE further agrees ;o save and hold harmless LESSOR in accordance with the terms of Exhibit "Brr hereof and agrees to furnish evidence of each such compliance in such form or forms as may be required by LESSOR. 6, r. Belsito, City Administrator Dear Mayor Pattinson and City Council Members: Subject: Lease agreement between the City of Huntington Beach and Eldon Bagstad. The attached lease agreement is between the City of Huntington Beach and Eldon Bagstad, who is presently owner of the El Don Liquor Store, which is located on the corner of Pacific Coast Highway and Fifth Street. This property is in a blighted area and is nonproductive at this time. Several man-hours are being spent in maintaining the vacant property. The lease will provide Mr. Bagstad with parking for the personswhopatron- ize his place of business. This will bring this lot into productive use and will eliminate the need for the City to continually spend man-hours cleaning and maintaining the vacant property. It will also lend to the aesthetics of the surrounding area. The lease is for a three year period. i'+lr. Bagstad is required to improve he property within sixty days after the execution of this lease at his. own expense, which is estimated at $5,000. Anytime during the three year lease the City has the option to revoke this lease with the understanding that the City will reimburse Mr. Bagstad for the undepreciated investment of the lease. When the lease expires in three years, Mr. Bagstad will have the option to lease the premise on a month -to -month tenacy upon the payment in advance of a fair and reasonable monthly rental amount which will be determined at that time.
