Budget preparations it was determined that funding be provided for contracting of park maintenance relative to additional work- load and levels of existing service. RECOMMENDATION: Authorize call for bids for park maintenance. ANALYSIS: Revenue limitations have restricted budget funding for park maintenance which have caused a negative effect on levels of service provided. Addi- tional new parks have impacted the park maintenance service and required more funding. The purchase of new equipment and hiring of additional em- ployees require a first year c'it considerably greater than contracting. Also, the staff finds it advisable to establish a record of park maintenance contracting to compare cost and quality of work as it relates to City provided maintenance. FUNDING SOURCE: Funding for contracting is provided in the 1981/82 F.X. Budget in the amount of $70,000.00. ALTERNATIVE ACTION: Do not contract park maintenance. Proposal Requirements Examination of Specifications, General Requirements and Site of fork The bidder shall examine carefully the site of the work contemplated and the proposal plans, specifications and contract forms therefore. It will be assumed that the bidder has investigated and is satisfied as to the general and local conditiom to be encountered; as to the character, quality and quantities of the work to be per- formed and materials to be furnished; as to the character of equipment and fadli- ties needed preliminary to and during the prosecution of the work; and as to the requirements of these specifications. GR-2 • It is mutually agreed that submission of a proposal shall be considered prima facie evidence that Ow bidder has made such examination. No verbal agreement or conversa- tion with any officer, agent or employee of the City either before or after the exe- cution of this contract shall effect or modify any of the terms of obligations herein contained.. Caripetency of Bidders and Payment for Plans and Specifications Plans, specifications and proposal forms will be issued only to those contnictors who can qualify as competent bidders. DM sal Form All pr%osals must be made upon blank forms to be obtained from the office of the Director of Public Works at the Civic Center, Huntington Beach, California. The bidder shall submit his proposal on the form furnished him. Proposals submitted on forms other than the one issued to the bidder will be disregarded. All proposals must give the prices proposed both in words and numbers, of which words will prevail over numbers, and must be signed by the bidder with his address and telephone number must be shown. If made by a firm or partnership mustbe shown. If made by a corporation the proposal must show the name of the ,State under the laws of which the corporation was chartered, the name of the corporation, and the names, titles, and business addresses and telephone numbers of. the President, Secretary and Treasurer. Proposal Guarantz All bids shall be presented under sealed cover and shall be accompanied by cash, a cashier's check, certified check, or bidder's bond made payable to the City of Hunt- ington Beach, for an amount equal to at least ten percent (101) of the amount of said bid, and no bid will be considered unless such cash, cashier's check, certified check, or bidder's bond is enclosed therewith. Withdrawal of Proposals Any bid may be withdrawn at any time prior to the hour .fixed in the notice to con- tractors for the opening of bids, provided that a request in writing, executed by the bidder or his duly authorized representative, for the withdrawal of such bid, is filed with the City Clerk. Public Opening of Proposals Proposals will be opened and read publicly at the time and place indicated in the notice to contractors. Bidders or their authorized agents are invited to be present. Rejection of Proposals Containing Alterations, Erasures or IrrelulgritLes Proposals may be rejected if they show any alterations of form, additions not called for, conditional or alternative bids, incomplete bids, erasures, or irregularities of any kind. Any mistakes and their subsequent corrections shall be initialed by she bidder. The right is reserved to reject any or all proposals. (fit-3 Dis% a� lificati of Bidders More than one proposal from an individual, a firm, a partnership, a corporation, or � an association under the same or different names will not be considered. Reasonable ground for believing that any bidder is interested in more than one proposal for the stork contemplated will cause the rejection of all proposals in which such bidder is interested. If there is reason for believing that collusion exists among any or all bidders, any or all proposals may be rejected. Proposals in which the prices are obviously unbalanced may be rejected. Award and Execution of Contract c Award of Contract The right is reserved to reject any and all proposals. The award of the contract, } if it be awarded, will be to the lowest responsible bidder whose proposal complies with all the requirements prescribed. Thereafter no payment shall be made upon such contract to the contractor or any assignee of the contractor until such further or additional bond has been furnished. Execution of Contract The contract shall be signed by the successful bidder within ten (10) working days after award and returned together with the contract bonds, to the City Clerk's office. Work shall coma ce within 20 working days, after the contract has been a- warded. No proposal shall be considered binding upon the City until the complete execution of the contract by the contractor and the Catty. GR-4 Failure to Bxscute Contract Failure to execute a contract and file acceptable bonds as provided herein within the time specified for thep,icable contract category shall be just cause for the annulment of the award and the forfeiture of the proposal guaranty. Scope of Work Work to be Done The work to be done consists of furnishing all labor, materials, methods and processes, equipment, tools and machinery, except a:: otherwise specified, which are necessary and required by the contract documents. Legal Relations and Responsibilities .�.- --� General Compliance with Law The contractor sha"Ll keep informed and observe, and colrpiy with, and cause all of his agents and employees to observe and comply with, all prevailing Federal, State and Municipal Laws, Ordinances, Rules and Regulations which in any way affect the cc:'liuct of the work of this contract. If any conflict arises between provisions of the plans and specifications and any such law above referred to, then the contractor shall notify the City at once in writing. The contractor shall protect and idemnify the City or any of its officers, agents, and employees against any claim or liabili- ty arising from or based on the violation of any such law, ordinance, rule or regu- lation, whether by himself or his agents and employees. Registration of Contractor Prior to the award of contract, the contractor shall be licensed in accordance with the provisions of Article 1 to 9 inclusive of Chapter 9, Division 3 of the Business and Professions Cade of the State of California and Amendments thereof, providing for the registration of contractors, defining the term contractor; providing a method of obtaining licenses to engage in the business of contracting and fixing the fees for such licenses; and prescribing the punishment for violation of provisions thereof, as amended. Permits and Licenses The contractor shall procure all pewits and licenses, pay all charges and fees, and give all notices necessary and incidental -to the due and lawful prosecution and com- pletion of the work. California Fair Employment_ Act_ The contractor shall utilize fair employment practices in accord6ace with California Labor Code Section 14-10 et seq. Prevailing Wage The contractor s.iall forfeit as penalty twenty-five ($25.00) dollars for each laborer, workman or mechanic employed for each calendar day or portion thereof, should such laborer, workman or mechanic be paid less than the general prevailing rate of wages stipulated for any work done by him, or by any subcontractor under him in violation of the provisions of the Labor :ode, particularly Section 1700 to 1781 thereof, both inclusive, providing for the payment of not less than the general prevailing rate of wages for legal holiday and overtime work on public work, providing for the ascertain- ment of such general prevailing rate by the public body awarding the contract, pro- GR-S viding for the keming of records of the wages paid all workers engaged in public work and the inspection of such records by the proper officials, providing any worker is paid less than the.. said rate and for a stipulation to this effect in the contract, and providing other penalties for violation of the provisions. Hours of Labor The contractor shall forfeit, as penalty,, ,twenty-five ($25.00) dollars for each laborer, workman, or mechanic employed in the execution of the contract by him, or by any sub- contractor under him for each calendar day during which said laborer, workman, or mech- anic is required or permitted to labor more than eigist (8) hours in.violati.on'of the provisions of the Labor Code, particularly Section 1810 to 1816 thereof, both.inclusive, relating to the hours of labor on public works, by requiring cm.tractors to file with the awarding body a verified report as to the nature of any extraordinary emergency when their employees are permitted to work over eight (8) hours per day, together with the names of said employees, and the hours worked per day making failure to file said report within thirty (30) days prima facie proof that no extraordinary emergency existed, also making it a misdemeanor for any contractor or subcontractor on public work, or agent thereof, to fail to keep an accurate record showing the name of and the actual hours worked by each workman employed by him in connection with public work. Apprentice on Public Works The contractor shall utilize apprentices ,N public works in accordance with California Labor Code Section 1777.5. Accident Prevention Precautions shall be exercised at all times for the protection of persons (including employees) and property. The safety provisions of applicable laws, buildings and cons- truction codes shall be observed. Machinery equipment, and other hazards shall be guarded or eliminated in accordance with the safety provisions of the California Industrial Accident Commission, Federal and California OSHA, State Industrial Safety and the 'manual of Accident Prevention in Construction" published by the Associated General Contractors of America, to the e;:ter,': that such provisi.uns are not in the contravention of applicable law. Rest- ons ability for Damage The City of Huntington Beach, the City Council, appointed or elected officials, commission , boards, any City employee or servant shall n.)t be liable for any loss or damage to the work performed pursuant to the contract or any part thereof, or for any material or equipment used in performing the work, or for injury or damage to any person or persons, either workmen or the public, or for damage to property adjoining the property on which the work is being performed from any causes whatso- ever during the progress of the work or at any time before final acceptance by the City. The contractor shall idemnify and save harmless the City of Huntington Beach, the City Council, appointed or elected officials, commissions, boards, City employees or servants from any suits, claims or actions brought by any person or persons for or on account of any injuries or damages sustained because of or arising out of the performance of the work contemplated or in consequence thereof. The City Council may retain so much of the money duce the contractor as shall be considered necessary for payment of the claims and attorney's fees until disposition has been made of such suits or claims for damages. F-W Public Liability and Prvperiy Dwnage Inxnmce The contractor shall furnish to the City and maintain during the life of the contract a public liability policy in which the City is named as an additional insured. The policy shall also hold harmless the City, its officers and employees while acting within the scope of their duties; against all claims arising out of or in connection with the work to be performed. Such policy shall provide coverage at least as broad as that provided in the Standard Form approved by the National Burcau of Casualty Underwriters together with such tndorsftments as are required to cover the risks involved. Prior to the commencement of work under the contract, cn7denre of insurance shall be fuinished on a form provided by the City, and no other form will be accepted. In addition, the contractor shall furnish evidence of a commitment by the insurance company to notify the City of the expiration or cancellation of any of the insurance policies required herem-der not less than 30 days before any change in coverage, expira- tion or cancellation is effective. The contractor will be required to secure the payment of Worker's Compensation to his employees in accordance with the provisions of Section 3700 of the Labor Code. Prior to the commencement of work, the contractor shall. sign and file with the City a certification of the following form: "I am aware of the provisions of Section 3700 of the Labor Code which requires every employer to be insured against liability for Worker's Compensation or to undertake self-insurance in accordance with the Provisions of that cods, and I will comply with such provisions before commencing the performance of the work of this contract. Said certification is included in the contract, and signature and return of the contract as provided in Section 3-1.03, 'Execution of Contract', shall constitute signing and filing of said certificate. The cost of this insurance shall be included in the prices bid for the various items of work and no additional compensation will be made therefore. Provisions, Attach- ments, ?notice Inviting Bids, the Proposal, the c.wposite of which shall hereinafter be referred to as the Specifications. i I . SUITLEN 'ARY 1. Definitions Whenever the words defined in this section, or prounouns used in their stead, occur in any of the Contract Documents they shall have the meaning herein given: AWARD BID - the bid awarded by the City as a basis to enter into a contract for the proposed work. BIB - An offer to furnish the necessary servicr,3 and materi- als and to perform the work called for',V the Contract Documents. SURPZN - Any firm or corporation executing a Surety iced or Baids payable to the City securing the performance of the Contract either in whole or in part. t, iPRi RIN ENMT - Park, Tree and Landscape Maintenance Superintendent of the City of Huntington Beach or his designated repre- sentative. 2. Sc2peof Work The Contractor shall perform all work necessary to complete the Contract in a satisfactory matuvr. The areas to be maintained -1- am shall include turf areas, ground cover areas, trees, shrubs, play equipment, park furniture, restrooans, sand play areas, drain lines, sidewalks, driveways and aprons, ditches, catch basins, gutters, curb drains, irrigation systems, lighting systems and park accessories. Beach areas to the high tide line are excluded from park maintenance areas. 3. Term of Contract The term of the agreement shall be for a period of one year from the date stated in the Notice to proceed, but the City reserves the right to terminate the agreement unilaterally at any time upon thirty (30) days written notice to the con- tractor. This contract can be renewed for one year increments by mutual agreement. If negotiations are still in progress at the end of any one year term previously agreed upon, the City and the Contractor shall continue performance as required herein on a month -to - month basis until either a new agreement is entered into or the City terminates the relationship in accordance with the provisions contained in the above paragraph. During such period of month -to -month operation while negotiations are in progress, the Contractor shall be obligated to continue per- formance for at least thirty (30) days after written notice to the City of its decision to terminate the relationship and the City shall be obligated to give consideration to the Contractor for such additional performance at the usual rate of payment as provided herein. 4. Level of Maintenance a. All work shall be performed in accordance with the highest park maintenance standards at established frequencies so as to maintain the aesthetic level of th. parks with that of similar parks in the City. Standards and frequencies may be modified from time to time as deemed necessary by the City for the proper maintenance of these parks. b. Weekly inspections of all areas included in the contract shall be made by the City. The results of each inspection shall be recorded and retained for reference. Sixteen (16) hours shall be allotted monthly for inspection and contract supervision by the City. The Contractor shall compensate the City for all time required for inspection and super- vision in excess of the above specified time, providing that: 1) the excess tiro is, in the rpinion of the City, required due to an inadequate level of maintenance; 2) that the Contractor has been informed of the deficiencies within five (5) days after the weekly inspection; 3) that the Contractor has failed to correct said de- ficiencies with five (5) working days after notification. Corpensatlon shall be charged at a rate including actual time, mileage and fringe befit costs u!curred by the City. -2- c. If, in the judgment of the City, the level of maintenance is less than that specified herein, the City shall, at its option, in addition to or in lieu of other remedies provided herein, withhold payment from the Contractor in an amount specified under "Penalties - Non -Conformance to Contract" as specified in Section 17 of these Supplemental General Requirements, until services are rendered in accordance with specifications set forth within this document and providing no other arrangements have been made between the Contractor and the City. Notices and penalties for non-performance are set forth as follows: 1) Deficiency Notice: The Contractor is required to correct deticiencies with the time specified by the City. 2) Withholding of Pa Mt: Provided work under the ley ficiency Notice has not been completed, payment for subject deficiency shall be withheld until deficiency is corrected, without right to retroactive payments. d. The Contractor's representative shall contact the City on a regular basis for notification of special mainten- ance item(s) requiring correction. e. The Contractor shall provide a foreman and maintenance crew at the park sites weekly during normal working hours as deter- mined by the City. All of the Contractor's maintenance person- nel shall be supervised by a qualified, English speaking, foreman in the employ of the Contractor. The Contractor must employ sufficient personnel to perform all work as scheduled and approved by the City. S. RAVorting The Contractor or his representative shall meet Ath the Superin- tendent or his representative on a regular monthly basis and at such other times as may be required by the City to review the per- formance of the agreement and to discuss any problems or matters as determined by the City. 6. Records The Contractor shall keep accurate books and records concerning all of his employees or agents. Tire Contractor will provide a weekly maintenance report and -cork schedule to be submitted to the Superintendent, as outlined in Attachment "B". The Contractor shall also permit the City to inspect and audit its books and records at any reasonable time. -3- On or before the first day of the last month of this contract, the Contractor shall submit an annual report on the cost and quantities of labor, materials and sup- plies used in the performance of his obligations as required in these specifications. 7. Fmerge�c Services The Contractor shall provide the City with the names and telephone numbers of at least 'two (2) qualified persons who can be called by City representatives when emergency maintenance conditions occur. during hours when the Contractor's normal work force is not present. Such work will be performed for an additional consideration. The City shall call for such assistance cmly in the event of a genuine and substantial emergency. The Contractor shall provide a maximum of one -hour personnel respalse tines upcii notification. 8. Working Time Limits All work specified shall be performed betmwn the hours of 7:00 a.m. and 5:00 p.m. and between the days of Mon- day and Friday. 9. Park Out of Use In the event any of the park area is unusable for any reason, including acts of nature or vandalism, the City may declare, for the purpose of maintenance, than an emergency condition exists and that it is out of use. The City and the Contractor will then jointly determine what changes in the normal level of maintenance, if any, may be necessary, including additional hours of labor and materials to be used. The normal consideration to be paid to the Contractor under the terms of this con- tract on a pro rata basis during the period of such an ?mergency shall be diminished or increased only if there is a change in the overall level of service ren&-red by the Contractor as determined by both parties. Any increase in consideration to the Contractor shall be calculated on the basis of additional actual cost plus 15% profit. A decrease in consideration shall be calculated on the basis of the value of labor and materials which the Contractor does not have to expend as a result of an emergency condition. If the parties are unable to agree on any aspect herein, an arbitrator shall be appointed b} them jointly ro resolve the issue. Notwithstanding, any provisions contained else-Awre in this agreement, the City reserves the right to perform any repair or construction -4- work it deems advisable, including normal routine maintenance contemplated by this contract, with its own labor and equipment or through a third party. 10. Materials to be provided by Contractor The Contractor at his own cost and expense shall furnish all necessary equipment, supplies and materials of good quality and in the amounts necessary to fulfill this contract and to accomplish an acceptable and professional level of maintenance. These supplies and materials shall include, but not be limited tu: a. All necessary gas, oil and spare parts for all equipment. b. All necessary top dressing, seed, fertilizers, chemicals, amendments, tree stakes, fasteners and rodent control devices. c. Parts necessary for the repair, replacements and maintenance of all irrigation systems. d. Parts necessary for the repair, replacements and mainten- ance of all park furniture, accessories and play equipment. e. Paints, stains, materials and tools necessary to maintain surfaces so treated. f. Trees, shnibs and ground cover plant replacements. Tie Contractor shall secure the City's approval of the type of each supply, material or equipment prior to its use or installation on park facilities. The City will provide water at each park site at no cost to the Contractor. 11. Contractor Insurance Contractor shall not commence work under this contract until all required insurance has been approved by the City. Contractor shall not allow any subcontractor to commence work until all similar required insurance has been approved by the City. Fire, theft and vandalism insurance policies shall be obtai.nej by the Contractor and secured, in the name of the City, in an amount sufficient to provide full coverage on all park futilities, plant materials and equipment. Insurance policies carried by the Contractor and Sub -contractors shall bear an endorsement or shall have attached a rider providing that in the event of cancellation or proposed cancellation of such policies for any reason whatso- ever, the City shall be notified by registered mail. 12. Consideration Total consideration to be agreed upon by the City and the Contrac- tor for the one-year term of the contract shall be divided into twelve (12) equal monthly payments, and each payment shall be made on or about the fifteenth (15th) day of each calendar month commencing the first month following the effective date of the contract except for cause as outlined in these Supplemental General Requirements. -5- 13. Advertising No advertising of any kind or description, bill posters, printed, painted or by the use of any other method or application legible to human sight, small appear on any buildings, stfExtures, fences, play equipment, park furniture or accessories, trees, canopies, posts or signs except valid and authorized legal notices required to be placed thereon and except as may be specifically authorized in these Supplemental General Requirements. 14. Administration Responsibilities The Contractor shall recognize the Director of Public Works as the contract Administrator of the City. Direct contact for the work shall be with the Park Supervisor. Contract administration chain of comiand shall then be directed in an upward route to the Superintendent and on to the Director of Public Works. Requests or demands by other departments shall be courteously listened to and referred to the Superintendent for determination of justifica- tion or establishment of priorities. No work shall be performed which is contrary to the contract level of ser-rice without author- ization from the Superintendent. 1S. Park I!Trovements The construction of sidewalks, turf areas, play equipment and irrigation system installations, when necessary, may be done by the Contractor and shall be on a negotiated price basis, provided, however, that the City shall have the option to take bids for the accomplishment of such work and may award the bid to the lowest responsible bidder. 16. Recovery of Attopey's Fees Should actioi he instituted to enforce any of the terms and provi- sions of the contract, the prevailing p&rty in suLh action shall be entitled to recover such reasonable attorney fees as may be affixed by the Court. 17. Qzlifications of Contractor In order to be eligible to enter into this contract with the City, the bidder shall: a. Have been engaged successfully in the maintenance of ground cover and turf areas for park -type use for a period of at least three (3) years at the time of the awarding of this contract. b. Agree to employ an English speaking foreman on a regular basis to supervise the work at the park sites. c. Be recognized by the City as well qualified to perform park maintenance on the basis of experience, expertise, equipment and financial stability. d. Provide references, company or agency with address and persona]. contact of a minimum of six (6) current landscape contracts for landscape maintenance; thine (3) of which must be of relatively similar size, level of service and cost as this specified mork or greater than this project. IM w e. Provide Contractor's Or:�-rizational Data. 1) Organization chart inclusive of executives and descending to on -site foremen. 2) Brief description of conq)any personnel and training procedures. 3) The Contractor shall provide a qualified, English. speaking foreman or supervisor to oversee the k,)rk force. A listing of guaranteed size of work force by job classification shall be provided to the City prior to beginning work. 18. Loss City -owned property whether real or personal, which is damaged or destroyed through vandalism or fire or which disappears through an unknown source or as a result of Contractor's performance or lack thereof, shall be the responsibility of the Contractor. 19. Service of Notice The delivering of any notice, instruction, claim or protest, or other written communication, personally to the Contractor or Superintendent or to the City shall constitute service thereof upon the Contractor, or the City, respectively. The depositing in a postpaid wrapper directly to the official address of the Contractor, or the City, in any post office mail box regularly maintained by the post office, or any notice, in- struction claim or protest, or other written comrrn ni.cation, shall be deemed sufficient service thereof upon the Contractor, or the City, respectively, except as noted in Part II, Section 11, of these specifications. The date of said sz vice shall be the day following the date of such mailing. 20. On -Site Storage The storage of tools, equipment or materials within the project area, public right-of-way or easements is prohibited. 21. Personnel Attire and E Lni nt The Contractor shall require each r,f his employees to adhere to basic Public Works standards of working attire. These are basically uniforms, with the Contractors coMany name or insignia clearly visible, proper shots and other gear required by State Safety Regulations, and proper wearing of the clothing. Shirts shall be worn at all times, buttoned and tucked in. Blue uniforms are not acceptable. Contractor shall display the name of his firm on any vehicles used by the Contractors employees to carry supplies and equipment. The fizz name shall be W letters large enough to bo easily legible from a distance of ormt-hunrdre-d (100) feet. -7- 22. Chemical Control Contractor shall comply with all rules and regulations of the Department of Food and Agriculture, the Department of Health, the Department of Industrial Relations and all other agencies which govern the use and application of chemicals required in the performance of the work. Chemicals shall include but shall not be limited to fertilizers, herbicides, insecticides, fungi- cides, rodenticides, germicides, nematocides, bactericides, inhibitors, fumigants, defoliants, desiccants, soil sterilants and repellents. Contractor shall apply spray chemicals when air currents are still; preventing drifting onto adjoining property and prevent- ing any toxic exposure to persons whether or not they are in, or near, the project. Contractor shall submit a schedule outlining date, location and work to be performed, four (4) days prior to the week of work. Said schedule shall be submitted to the Superintendent. 23. Coordination Contractor shall cordinate wnrk with the Superintendent to prevent conflict with City programs and activities. The Superin- tendent's office is located at 17581 Gothard Street, Huntington Beach. He may be reached by telephone at (714) 5'6-5480 or 53b-5220. 24. Water Conservation Contractor shall, whenever possible, minimize the use of water during maintenance operations. Watering equipment shall be kept in good working order; water leaks shall be repaired.promptly; and washing of equipment, except when necessary for the safety of and for the protection of equipment, shall be discouraged, In no case shall the Contractor use water to rinse or flush chemicals of any kind from equipment onto the park site and/or drainage or sewage systems. 25. Sound Control uire:wnts Contractor shall comply with all County and local sound control and noise level rules, regulations and ordinances which apply to any work performed pursuant to the Contract, and shall make every, effort to control any undue noise resulting from the operation. Each internal cem bstion engine used for any purpose on the project or related to the project, shall be equipped with a muA^fler of a type recommended by the manufacturer. No internal combustion engine shall be operated on the project without said muffler. Said noise level requirement shall apply to all equipment on the proj- ect or related to the project including but not limited to trucks, transit mixers, or transient equipment that may or may not be owned by the Contractor. The vse of loud sound sipnals shall be avoided in favor of light warnings except those required by safety- liras for the protection of the public or Contractor's personnel. -8- 26. 27. 28. Inclement Weather Contractor shall not work or perform any operations during inclement weather which may destroy or damage ground cover or turf areas. The Contractor shall contact the Superintendent for the determination of non -operation conditions. Contract Documents Contract documents shall consist exhibits, plans, bonds, insuranc and all submittals required. Plans e of the specifications and certificates, the contract One set of reduced planting and irrigation plans for each park are provided as part of the contract documents for the Contrac- tors general reference. The Contractor shall be respensible for verifying in the field,areas, quantities and facilities for accuracy. Full scale blue line prints of the irrigation and planting plans will be made available to the Contractor upon ree,uest, for a fee of $10.03 per set per park. 29. Exhibits Exhibits consist of Exhibit A, Deficiency Notice; end Exhibit B, Weekly Maintenance Report. 30. Penalties an3 Non -Conformance to Contract Should the Contractor fail to correct deficiencies or eliminate public nuisances with twenty-four (24) hours after receipt of a Deficiency Notice (Exhibit A), City forces shall be called out to complete the work. Such work shall be done on a force account basis with an additional call -out charge of $75.00 per hour for each call -out. It also should be noted that there is a minimun of two-hour charge for labor on any call -out. Call -out of City forces during off -duty hours, resulting from improper programming of irrigation controllers shall result in Contractor being charged at the regular 'Outside Charge" .ate. 31. 1teplacements Any replacement materials shall be of the same type, size, manufacture or variety as specified on the park construction plans miless otherwise determined by the Superintendent. Replace- ments shall conform to the provisions of the City of Ifiartii►,gton Beach Landscape and Arboricultural Standards and Specifications. Should any material as originally specified prove to perform unsati3factorily for the given situation, tho Contractor shall bring this to the attention of the Superintendent for a determim- tion before any replacement is undertaken. -9- 32. Air Polution Contractor shall comply with all air pollution control nitles, regulations, ordinances and statutes which apply to any Iwork performed pursuant to the Contract and shall not discharge smoke, dust or any other air contr dlmts into the atmosphere in such quantity as will violate the regulations of any legally constituted authority. Material to be disposed of shall not be burned. III. SPECIAL PRMISIONS TRAFFIC AND DETOURS GENERAL Contractor shall provide all labor, materials and equipment to install barriers, guards, lights, signs, temporary bridges, flag- persnns; advising the public of detours and construction hazards, and on completion of the work promptly remove all signs and warning devices. Contractor srsall be responsible for compliance with ad- ditional public safety requirements which may arise during landscape installations at the park site. Contractor shall notify the City of Huntington Beach. Police, Fire and Engineering Departments twenty-four (24) hours in advance of closing, or partial closing, or of reopening any street or public thoroughfare. RESPONSIBILITY Should *.he Contractor appear to be neglectful or negligent in furnish- ing waning and protective measures, the City may direct attention to the existfince of a hazard, and the necessary warning and protective measures shall be furnished and installed by the Contractor, at the Contractor's expense. HAULING Spillage resulting from hauling operations on or across public thoroughfares shall be immediately removed at Contractor's expense. When entering or leaving roadways carrying public traffic, the Contractor's equipment, whether empty or loaded, :'fall in all cases yield to public traffic. IV. TURF MA TENANCE 1. _Maw�i.na and Edging Turf areas shall be mowed, edged or trimmed as needed. Turf areas consisting of cool season grasses shall be mowed before reaching four (4) inches in height and shall be mowed no lower than two (2) inches in height. Turf areas consisting of warm season grasses shall be mmmied according to the season. During dormancy seasons the warm season grasses shall be mowed as needed to keep the grass at .11" to 3/41, in height. During the growing season the warm season grasses shall be moved to keep the grass at 3/4" in height.. The City may request the Contractor to vary mowing heights for special events and conditions as directed by the Superintendent. -10- The Contractor shall submit a motoring schedule of days and times for each designated park site. The Contractor shall maintain the schedule as closely as possible unless a change is authorized or directed by the Superintendent. Turf clippings and debris shall be lifted the same day of.each mowing,.; trimming or edging operation and shall be removed from the par', site. Turf shilh be trimmed to the edge of sidewalks, curbs, mawIstrips , retainini walls, posts, valve boxes, controllers, light standards and any paved surface. Turf shall be kept trimmed or sprayed with a contact herbicide for a sufficient distance from sprinkler heads to ensure proper sprinkler coverage anti for a distance of eighteen (18) inches from all tree trunks. Contractor shall exercise care not to spray tree trunks with any chemicals or injure the tree trunks with any chemicals or injure the tree trunks with mechanical equipment. 2. Watering An autornatic irrigation system is provided for the Contractor's use to maintain optimum soil moisture content to ensure healthy, vigorous growth but shall not be intended as the only means of irrigation. Should there be an interruption of electrical power or malfunctioning of the controller or control valves for more than two (2) consecutive days, the Contractor shall be required to water by other means if necessary to prevent deterioration of the areas involved. The Contractor shall be responsible for providing control and monitoring irrigation operations to provide sufficient water for optimmo growth with a mm.inimmnin of water run-off. Unnecessary flooding or excessive watering shall be corrected as quickly as possible. 3. Fertilization Cool season grasses shall receive five (5) pounds of ammonium sulfate, 21-0-0 per 1,000 square feet per application in early March, early May and early October. In late November the cool season grasses shall receive one application. of six (6) pounds of complete fertilizer, 16-16-6 plus trace elements per 1,000 square feet. Warm season grasses fertilization shall be as follows: Adalayd grass shall receive two (2) pounds per 1,000 square feet of ammonium sulfate, 21-0-0 pc.. :}pplication in early February, March April and May. In early October and November the Adalayd grass shall receive fire i:, ; ;)otmds of complete fertilizer 16-16-6 plus trace elements per 1,000 square feet: per application. Hybrid Bermuda grasses shall receive six (6) pou,4:-, of complete fertilizer 16-16-6 plus trace elements per 1,000 feet per applica- tion in early October, November, January and March. In early April May, July and late August hybrid Bermuda grasses shall receive two (2) pounds of ammonium sulfate, 21-0-0 per 1,000 square feet per -l.l- application. Water thoroughly the day before fertilizing and thoroughly again immediately after application of any fertilizer. The early October application shall be applied imeediately after the aerofication and thatch re,zbval operations. 4. Insect, Disease and Pest Control Contractor shall provide complete insect, disease and pest control as necessary or as directed by the Superintendent. Contractor s'nall obtain the Superintendent's approval forty-eight (48) houzs prior to the use any chemical., mechanical or any other method of control. S. Weed Control All vegetation shall be sprayed and removed for a distance of eighteen (18) inches from tree trunks to form tree wells. Any additional weed control in turf areas shall be as needed or as directed by the Superin- tendent. Need control required and approved within turf areas by the Superintendent shall be paid for as extra work except tree well spraying. 6. Soil Aemfication Turf areas shall be aerofied four (4) times a year as directed by the Superintendent. Aerfication shoul.? be accomplished just prior to fertilizer application. The entire turf areas shall be aerated with a self-propelled machine that removes cores of soil 3/4" in diameter by four (4) to six (6) inches long, spaced no more than six (6) inches apart. Soil shall be moist to a depth of at least: six (6) inches before aerofying. Aemfication shall be done immediately after the thatch removal operation required in early October. 7. Thatch Removal Thatch shall be removed with a vertical r er,or approved equal, once a year in early October from all turf areas as directed by the Superinten- dent. Care shall be taken to avoid unecessary or excessive injury to the turfgrass stand. Sweep or rake the dislodged thatch from the turf areas and remove from the park site. Ater the thatch is removed, turf shall be aerofied, fertilized and watered. V. SFM B AND GROUND COVER MAINThWCE 1. Pruning and Trimming Ground cover shall be kept trimmed to the edge of sidewalks, light fixtures, driveways, m wstrips, retaining walls and buildings. Ground -bill N, (1) foot from fences, property lines, trees and ....+ l+a.. 111 I. ground cover be allowed to climb walls, fences, light fixtures, buildings, shrubs and trees. ShnjbF shall be selectively pruned to a distance of one (1) foot from fences, buildings, driveways, sidewalks, trees, retaining walls and sprinkler heads. In no case shall hedging or shearing be allasmd prior to approval of the Superintendent. The Contractor shall pnme where necessary to maintain safe vehicular and pedestrian visibility as directed by the Superintendent. -12- VI. 2. Watering See Part 1V, Section 2. 3. Fertilizing Ground cover and shrub areas shall be fed between February and April with a complete fertilizer, 16-16-6 plus trace elements at the rate of 275 pounds per acre or approximately six (6) pounds per 1,000 square feet. Water thoroughly the day before fertilizing and thoroughly again immediately after the application of the fertilizer. Wash all plant food off foliage. 4. Insect, Disease and Pest Control See Part IV, Section 4. S . Weed Control A pre -emergence and post -emergence program shall be maintained by the Contractor for the entire duration of the contract. Ground cover and shrub areas shall be weeded before any weeds reach four (4) inches in height. Pre -emergent herbicide shun be applied in early March and again in early September according to the manufacturer's recommenda- tion each year in all ground cover areas. Post -emergent herbicide shall be applied as needed; as directed and the type approved by the Superintendent depending upon the type of ground cover involved. Serious pest weeds, such as Bermuda grass and Bindweed shall be spot treated with a portable sprayer or wick wand as needed with an effective herbicide and applied per manufacturer's recommendations. Water shall not be applied to treated areas for forty-eight (48) hours after each application. Sprayed weeds shall be left in place for a minimum of seven (7) days. If kill is nut complete, a second application shall be applied as above. After a complete kill, all dead weeds shall be removed from the park site. h'utsedge shall be treated a minium of once per month until complete control is achieved as specified above and as directed by the Superintendent. TREE MUNI`F?MCE 1. Training and Trimming The Superintendent shall be notified prior to any trimming. Trees of twenty (20) feet in height or less shall be shaped, trimmed and pruned. Trees shall be thinned out, headed -back and shaped a minimin of once v. year. Any dead or damaged branches shall be removed back to a lateral branch. No stubs will be permitted. The Contractor shall restrict gratith through pruning to maintain safe road visibility, vehicle and pedestrian clearances, equipment accessability and to prevent or eliminate hazardous situations. 2. Watering See 'mart N, Section 2, of there specifications. 3. Ferlilizinn Trees shall be fed %n early March with a complete balanced fertilizer 16-16-6 plus trace elements at the rate of six (6) pounds per (1) inch of trunk diameter measured one (1) foot above the ground. Fertilizer shall be broadcast around the drip line of the trees and watered thoroughly. -13- . j 4. Trees provided with PVC vents shall be pumped with a portable pimping device to prevent standing water at lower levels of the root zone as needed. Weekly inspection of these vents shall be made by the Contractor and if necessary, corrective action taken immediately. S. Tree Staking and Tying Trees shall be staked in accordance with Stmidard 703 revision of the City's Standard Plans, dated July 17, 1981. Stakes and ties shall be placed in such a manner that no trunk chafing occurs. Guys and ties shall be checked periodically to prevent girdling and/or restriction of growth. VI 1. WOOD CHIP MCii AREAS MAINTENANCE 1. General Wood chip areas shall be kept evenly spread at a uniform four (4) tn six (6) inch depth. Contractor shall remove weeds and debris as required herein. 2. Rerplenishment Once per year the City will furnish wood chips to the park site for replenishment. The Contractor shall spread the wood chips ev--nly over the entire wood chip mulch areas to a unif6 m depth. The Contractor shall remove vegetation, branches, logs, paper and other debris from the wood chips and dispose of any objectionable material off the Park site. Any work involved in the spreading of wood chips replenishment operations will be paid by the City as extra work covered elsewhere in these specifications. 3. Weed Control Weeds shall be either pulled or sprayed and removed from non -vegetative areas before reaching four (4) inches in height. Serious pest weeds shall be treated as specified in Part V, Section 5, of these specifications. No sterilants of any kind are to be used in these areas. VIII. DEOMMSED GRANITE AREAS MAIN'TENANCF 1. General Decomposed granite areas shall be kept in a neat and clean condition, free from weeds and debris. 2. Resurfacing Once per year the City will require that the decomposed granite areas be resurfaced. Contractor shall resurface the area by filling in low c►r worn areas with new decomposed granite to eliminate ponding of water. Ihe decomposed granite shall be placed to a minimum thickness of four (4) inches and compacted with a roller. After rolling the area shall be smooth and raked and watered thoroughly to provide maximam compaction. Work involved in the resurfacing operation shall be paid for as extra work covered elsewhere in these specifications. 3. Weed Control See Part VII, Section 3, of these specifications. -14- A . IX. SAND MAY AREAS MAINTENANCE 1. General Sand play areas shall be kept free of weeds, litter and debris. Sand shall be kept in a reasonably levelled condition as directed by the Superintendent to prevent the development of large holes or the exposure of equipment footings or foundations. 2. Weed Control Ileeds shall be removed by physical means as ineeded except serious pest weeds shall be treated as specified in Part V, Section 5, of these specifications. X. PLAY MIPPIFNI', PARK FURNII ME AND ACCESSORIES AND FACILITIES MAINTENANCE 1. General Contractor shall be responsible for custodial maintenance of play equip- ment, park furniture and accessories and facilities including but not limited to light standards and fixtures, walks, play courts, benches, restrooms, picnic tables, fountains, play apparatus and trash receptacles. Custodial maintenance shall include such items as light bulbs, miscel- laneous paper sanitation products -replacement; as well as sweeping, cleaning, mopping and hosing down of restroom facilities, replacing missing screws, bolts and fasteners, handles, and any other minor items net: -scary for safe and proper operation of a facility or equipment. Graffi`.i shall be removed as soon as discovered by painting with a match- ing col-)r of the marked surface or by sand -blasting, whichever is approved by the Fuperintendent. Contractor shall report any major deficiency or the need of replacement for pry item herein listed to the Superintendent. The %4Rrintenden: will then determine the extent of the removal or replacement, if any. Contractor will be reimbursed for expenses in excess of five hundred ($500) dollars, annually for replacement and repair of play equipment, park furniture and accessories and facilities due to normal wear and tear. Prior -to reimbursement, the payment, if miy, :hall be verified by the Contractor's written expense statement, together with a filed insurance report, if applicable, and be subject to City audit. Where public safety is affected, the Contractor shall make immediate repairs without prior approval but shall report :such repairs within twenty-four (24) hours of repair completion, to the Superintendent. Contractor shall repair damaged and remove or replace all inoperable equipment which occurs from vandalism, fire or disappearance. XI. IRRIGATION SYMBIS MAINPM4CE 1. General Contractor shall maintain and keep in proper operating condition, at all times, irrigation heads, control valves and automatic cantrollers. Contractor shall sequence controller to each station manually during each visit to the park site to checkout the function of all facets of the cyst.-i During the check-out, the Contractor shall adjust heads for correct coverage, unplug clogged heads and flush lines where necessary to free lines of rocks, mud and debris, and replace or repair damaged equipment or pipe lines as needed. Any repairs or replacements shall be with originally specified equipment pieces or parts of the same size and qujultity. Contractor shall monitor and program the controller for the correct amount of time necessary to ensure the necessary amount of water for optimum growth with minimum water run-off. Contractor shall be responsibile for the control of the irrigation systems during inclement weather conditions and shall limit the use of water concurrent with the weather situation to the satisfaction of the Superintendent. All work involved in the maintenance of the irrigation systems as specified herein shall be included in the contract price and no additional compensation will be made therefore. XI I. CLEAN UP 1. General After Contractor has completed all operations as specified in these specifications, he shall remove and dispose of all clippings, cuttings trimmings, weeds, leave,, paper, trash and other debris exi :sting or due to his operations from the park site, at the end of each days work. Trash receptacles shall be emptied once a week. Trask removal and disposal shall be included in the contract price for the maintenance contract. Contractor shall sweep clean all walks, driveways, court game pavement areas, gutters, parking lots and other areas adjacent to work locations once per week. The use of water is prohibited for cleaning purposes unless no other means is effective or unless otherwise specified. Contractor shall be responsible for the periodic inspection and cleaning of all catch basins, drain lines and curb drains within a park site. Any damages resulting from the Contractors negligence of these inspections and/or lack of co.•rective measures shall be the Contractor's sole responsibility.
