RECOMMENDATION:

ANALYSIS;
On November 21, 1988, Council awarded a conitructicr- contract to Excalibur Contracting
for the construction of Marcus McCnllen Perk - Phase One. Tho constructlon of thesb
Improvements are now complete, per the approved plans and specifications and therefore,
the Director of public Works recommends acceptance of the project and requests that the
Notica of Completion be flied by the City Clerk. The following is a summary of contract

The cost of change orders will cxceed the amount thnt can he approved by the Direr,tnr of
Public Works.
PECOMMENDATiON:
Authorize the Director of Public Works to approve chansle orders totaling $90,601,00.
ANALYSIS:
On November 21, 1988, Council awarded a construction contract to Excalibur Controctinq
fnr the cnnstructlon of Marcus McCgllen Park - Phase 1. Construction of these
Improvements Is now Underway; however, the contractor Is encountering moist unsuitable
mataelel that cannot be placed and compacted per the, approvna plans. Therefors, this
material must he removed and replaced with suitable sail. The estimated cost of this
work Is $90,000+. The Director of Public Works Is Authorized to approve change orders up
to 10% of the contract amount not tc exceed a total of $50,000 without prior bop.roval by
Council. Therefore, is is recommended that Council authorize the Director of Public
Works to approve change orders totaling $901000±.

THIS AGREEMENT is made and entered into on this „r/,�L_

HUNTINGTON BEACH, a 'municipal corporation of the State of
California, hereinafter referred to as "CITY," and EXCALIBUR
CONTRACTING, INC, a California corporation, hereinafter cpferred
to as "CONTRACTOR."
WHEREAS, CITY has solicited bids for a public works projact,
hereinafter referred to as "PROJECT," more fully described as the
construction of Phase I of the Marcus McCallen Park in the City of
Eluntington peach, Califs^rnia; and
CONTRACTOR has been selected and is to perform sa9d works
NOW, THEREFORE, in consideration of the promises and
agreerents hereinafter made and exchanged, the pa,,ties covenant
and agree as folAows:
1. STATFMENT OF WORK:_ACCEPTANCE OFF RISK
CONTRACTOR shall furnish, at its own expense, all labor,
plant, tools, equipment, supplies, transportation, utilities and
all other items, services and facilities necessary to complete and
construct the PROJECT in a good and workmanlike manner.
CONTRACTOR agrees to assume the risk of all loss or
damage arising out of the nature of the PROJECT, during its
progress or prior to acceptance, from the action of the elements,
from any unfcreseen difficulties which may arise or be encountered
in the prosecution of work, and for all other ricks of any
descriptic;-, connected ,;ith the work, including, but noL '.imited

all expenses incurred by or in consequei,ce of the suspension
discontinuance of work, except such as are herein expressly
ipulated to be borne by CITY, and f.or well and faithfully
mpleting the work withi,i the stipulated time and in the manner
own and described in this Agreement, and in acccrdance with the
quiremci,-s of CITY under them for the compensation set forth in
the accepted bit; propusai.
However, the total compensation to be paid is to be computed
on the basis of the units of work as it is actually performed, in
accordance w;L6h the stipulated prices named in the Hid Shaet(s).
2. ACCEPTANCE: OF CCNDITIONS OF WORK„j_„PLANSAAND
SPECIFICATIONS
CONTRACTOR acknowledges that it is fully familiar with
all the terms, conditions and obligations of this Agreement and
the Contract Documents (as hereinafter defined), the locaLion of
the joky site, and the conditions under which the work is to be
performed, and that it enters into this Agreement based upon its
investigation of all such matters and is relying in no way upon
any opinions or representations of CITY.
It is agreed that the Contract Documents are incorporated
into this Agreement by this reference, with the same force and
effect as if: the -,%ire were set forth at length herein, and that,
CONTRACTOR and its subcontractors, if any, shall be bound by said
Contract Documents insofar as they relate in part or in ar;y way,
directly or indirectly, to the work covered by this Agreement.
"Contract Documents" as defined herein mean and include:

Chapter of the American Public Works Association and the Southern
California District; Associated General Contractors of Lhe
California Joint Cooperative Committee;
A. aid documents including the Notice Inviting Bids,
the Special Instructions to B16 tiers and the Contractor's Prcposal
(attached hereto as Exhibit "A");
E, The particular plans, specifications, special
provisions and addenda applicaL•le to the PROJECT. Anything
mentioned in the Specifications and not indicated in the Plana or
indicated in the Plans and not mentioned in the Specifications,
shall be of like effect as if indicated and mentioned in both. In
case of discrepancy between any plans, specifications, special
provisions, or addenda, the matter shall be immediately submitted
by CONTRACTOR to the Department of Public Works of CITY
(hereinafter referred to as "DPW"), without whose dec',iion said
discrepancy shall not be adjusted by CONTRACTOF., save only at its
own risk and expense.
Should there to any conflict between the terms of this
Agreement end the bid or propusal of CONTRACTOR, then this
Agreement shall control and nothing herein shall be considered as
an acceptance of the terms o,: said bid or proposal which is in
conflict herewith.
3. COMPENSATION
CITY agreee to pay and CONTRACTOR agrees to accept as

full compensation for the Faithful performance of this Agreement,
subject to any additions or deductions made under the provisions
of this Agreement or the Contract Documents, the sum of Two
Hundred Severity -Seven Thousand, Six Hundred Forty -Three and noj100

4. COMMENICEMEN`I' OF PROJECT
CONTRACTOR agrees to commence the PROJECT within ten (10)
working days After notice to proceed is issued and sht;11
diligently probecute PROJECT to completion within ninety (90)
consecut vet calendar days from the execution of this Agreement by
CITY, excluding delays provided for in Section 14 herein.
5. TIME OF THE ESSENCE
The parties hereii recognize and agree that time is of
the essence in the performance of this Agreement and each and
every provision of the Contract Documents.
CONTRACTOR shall prepare and obta:.n approval as required
by the Contract Documents for all shop drawings, details and
samples, and do all other things necessary and incidental to the
prosecution of its work in conformance with the progress schedule
set forth in tte Contract Documents, CONTRACTOR shall coordinate
its work with the work of all other contractors, subcontractors
and CITY forces working on the PROJECT, in a manner that will
facilitate the efficient completion of the PROJECT and in
accordance with Section 4 herein. CITY shall have complete
control of the premises on whirr, the work is to be performed and
shall have the right to decide the time and order in which the
various p:.rtions of the work shall be performed and tr priority

and, in general, all matters concerning the timely and orderly
conduct Qf the work of CONTRACTOR on the premises.
CHANCES
CONTRACTOR shall adhere strictly to the plans and
speciiicati.uns set fort:: in the Contract DorumEnts unless a change
therefrom is authorizo-d in writing by the DPW. CONTRACTOR agrees
to make any and all changes, furnizh materials and pirform all
work necessary within the scope of the PROJECT as the DPW may
require in writing. Under 4o condition shall CONTRACTOR make any
changes without the written order of the DPW, and CITY shall not
pay any extra charges mada by CONTRACTOR that have not been agreed
upon in writing by the D11W.
When directed to change the ►.,)rk, CONTRACTOR shall Submit
immediately to the DPW a written cost proposal reflecting thi
effect of the change. Should the DPW not agree to such rost^
proposal, the work shall be performed according to the changes
ordered in writing by the DPW and the proper cost thereof shall be
negotiated by the parties lipon cost and pricing data submitte(I by
the CONTRACTOR; thereupon, CITY will promptly iastie an adjueted
change order to CONTRACTOR and the contract price will be aljisted
upward or downward accordingly.
7. NOTICE TO PROCEEA
No work, services, mater_dl, or equipment shall be
performed or furnished under this Agreement unless and until a
Notice to Proceed has been given to the CONTRACTOR by CITY. CITY
does not warrant that the work site viil be available on toe elate
the Notice to Proceed in issues. In event of a delay in

constructed. CONTRACTOR, within ten (10) days after notice by
CITY of, any defect in the work? shall have the option to make
,appropriate repairs or replace the defective item or items, Upon

appropriate repair or replacement at CONTRACTOR'S rink and expense.
10. CALIFORNIA FAIR EMPLOYMENT AND HOUSING AM
CONTRACTOR agrees to comply with all requirements and

in the office of the City Clerk of CITY. CONTRACTOR and any
subcontractor under it shall pal not less than said prevailing
wage rates to all workers employed on this Public Works Agreement,
an required by California Labor Cade Section. 1771 and 1774. In
accordance with the provisions of. Section 3700 of the Cal+.focnia
,..abor Code, CONTRACTOR agrees to secure payment of compensation to
every employee.
12. CALIFORNIA PREVAILING WAGE LAW - PENALTY
Pursuant i;o Section 11 of this Agreement and in
accordance wit)) Section .1774 and 1775 of. the California Labor
Code, CONTRACTOR shall, as a penalty to CITY, forfeit twenty-five
dollars ($25.00) fur each calendar day or portion thereof for each
worker paid (either by CONTRACTOR or any of i.ts subcontractors)
leas than the prevailing wage rate established for that particular
craft or type of work.
13. CALIFORNIA EIGHT -HOUR LAW
California Labor Code, Article 31 ChApter 1, Part 7
(Sections 1810 et seq.) shall apply to the performance of this
Agreement; thereunder, not more than eight (8) hours shall
constitute one day's work and CONTRACTOR and each subcontractor
employed by it hereunder, Shall not require more than eight (0)
hours of labor per day or forty hourn pe: week from any one person
employed by it hereunder, except as ,stipulated in California Labor
Code Section 1815. CONTRACTOR and each subcontractor employed by

it hereunder shall, in accordance with California Labor Code
Section 1811, keep an accurate record, open to inspection at all
reraonable hours, Phowing the nave and actual hours worked each
calendar day and each calendar week by each worker employed in
connection with the PROJECT,
14. CALIrURNIA EIGHT -HOUR LAW - PENALTY
Pursuant to Section 13 of this Agreement and in
accordance with California Labor. Code Section 1811, CONTRACTOR
shall, as a penalty to CITY, forfeit twenty-five dollars ($25.00)
for each worker employed hereunder by CONTRACTOR or any
subcontractor for each calendar clay during which such worker ire
required or permitted to work more Char• eight (8) hours in any one
.1) calendar Cay or forty (40) houra in any one (1) calendar week
in violation of California Labor Code Section 1815.
15. PAYMENT OF TRAVEL AND SUBSISTENCE ALLOWANCE
,Section 1773.8 of the California Labor Coda, regarding
the payment of travel and subsistence payments, is applicable to
this PROJECT.
16. EMPLOYMENT OF APPRENTICES
Section 1777.5 of the California Labor Code, regarding
the employment of apprentices, is applicable to this PROJECT.
17. PAYROLL RECORDS
CONTRACTOR agrees to keep accurate payroll records
showing the name, address, social security number, work
classification, straight time and overtime hours worked each day
and week, and the actual per diem wages paid Lo each journeyman,
apprentice or worker employed by it in connectio,i with the PROJECT
and agreee to require each of its subcontractors to do the game,

CONTRACTOR further• agrees that its payroll records and those of
its subcontractors, if any, shall be availaLle at all reasonable
times to the CITY, the employee or his representative# and the
Division of La►bcr Standards Enforcement and Lhee Division of
Apprenticeship Standards, acid to comply with all of the provisions
of California Labor Code Section 1776, in general.
18. INDEPENDENT CONTRACTOR
It: is understood and (agreed that Lhe CONTRACTOR is, and
shall be, acting at all times hereunder as an independent
contractor and not as an employee of CITY. CONTRACTOR shall
secure, at its expense, and be responoible for any and all payment
of income tax, social security, state dLsabil.ty insurance
compensation, unemployment compensation and other payroll
deductions for CONTRACTOR and it$ officers, agents wnd employers,
and all business licensee, if any, in connection with the PROJECT.
19. LIQUIDATED DAMAGES/DELAYS
It is agreed by the parties hereto that in rasa the totnl
work called for hereunder is not in all parts and requirements
finished or completed within the number of working/calendar days
as set forth in Section 4 herein, damage will be suaLained by
CITY; and that it is, and would be, impractical and extremely
difficult to ascertain and determine the actual damage which CITY
would sustain in the event of and by reason of such delay; it is,
therefore, agreed that CONTRACTOR will pay to CITY, as liquidated
damages and not as a penalty, the sirm of Three Hundred and no/100
Dollars ($300.00) per day for each and every working day's delay
in completing the work in excess of the numoer of working/calendar
days set forth in Section 4 herein, which eum represents a

reasonable endeavor by the parties hereto to estimate a fair
comper.aation for the foreseeable losses CITY would sustain in the
event of and by reasun of such delay= and CONTRACTOR agrsess to pay
said damages herein provided, and further agrees that CITY may
deduct the amount thereof from any monies due or that may become
due to CONTRACTOR hereunder.
CONTRACTOR will he granted an extension of time and will
not be assessed damages for any portion of the delay in completion
of the work due to unforeseeable causes beyond the control and
without the fault or negligence of CONTRACTOR, including, but not
restricted to, acts of God or of the public enemy, fire, floods,
epidemics, quarantine resstric:tions3, strikes, unsuitable weather,
or delays of subcontractors due to such causes,
CONTRACTOR shall, within fifteen (15) days from the
beginning of any such delay (Unless the DPW shall grant a further
period of time prior to the date of final settlement of the
Agreement), notify the DPW in writing of the cause of the delay
and CITY shall extend the time for completing the work if, in its
Judgment, the findings of fact therein justify the delay; and the
decision of the DPW shall be conclusive on the parties hereto,
should CONTRACTOR be delayed in the prosecution or
completion of the work by the act, neglect ur default of CITY, or
should CONTRACTOR be delayed waiting for materials required by
this Agreement to be .furnished by CITY, or by damage caused by
fire or other casualty at the job site for which CONTRACTOR is not
responsible, or by the combined action of the workers, in nowise
caused by or resulting from default or collusion on the part of
CONTRACTOF, or in the event of c lockout by CITY, then the time

20. DIFFERING SITE CONDITIONS

(a) subsurface or latent physical - mdil.ions at the
job site differing materially from those indicated in this
Agreement or the Contract Documents; or,
( b ) unknown physizal conditions at the joky a i.te, of
an unusurl nature, differing materially from those ordinarily
encountered and generally recognized as inherent to work of the
character to be performed under this Agreement. The DPW shall.
promptly investigate the conditions and if it finds that such
conditions do materially so d'.ffe= and cause an increase or
decrease in the time required for performance of any part of the
work under this Agreement, whether or not changed as a result of
such conditions, an equitable adjustment shall be made and the
Agreement modified in writing accordingly;
(2) Time_. Extension No claim of the CONTRACTOR under
this Section shall be allowed unless the CONTRACTOR has given the

21. VARIATIONS IN ESTIMATCD QUANTITIES
The quantities linters in the bid schedule will not govern
final payment. Payment to the CONTRACTOR will oe made anly for
the actual quantitieh of contract i�ens used in construction of
the PROJECT, in accurctence with the plans and specifications.
Upon completion of the PROJECT, if the actual quantities used are
eiFher more than or leas than the quantities listed in the bid
schedule, the bid price shall prevail subject to Lhe provisions of
this Section. The DPW may, at its Role discretion, when warrantL-d
by the facts and circumstances, order an equitable adjustment,
upwarde or downwards, in payment to the CONTRACTOR where the
actual quantities used in const;.uction of Lhe PROJECT are in
variation to the quantities listed in the bid schedule. No claim
by CONTRACTOR for an equitable adjustmenL in price or time for
completion shall be allowed if asserted after, final payment under
this Agreement. if the quantity variation is Such are to cause an
increase in the time necessary for completion, the DPW shall
ascertain the facts and cirvumstances and make such adjustment for
extending the completion date as in its judgment the findings
warrant.
22. PROCRESS PAYMENTS
Erect, month the DPW will make an estimate in writing of
the work performed by CONTRACTOR and the value thereof. Prom each
progress estimate, ten parcen:: (101) will be deducted and retained
by CITY and the remainder, less the amount of all r•revious
payments since commencement of the work, will be Paid to

When CONTRACTOR has, in the judgment of the DPW,
faithfu:ly executed fifty percent (SW or more of the value of
the work as determintd from the bid schedule, and if t-he Dpw fihda
that satisfactory ptogress hae been and is being made, the
CONTRACTON. may be paid such aum as will far?ny the payments of each
moi,th up to ono hundred percent ( 100%) Of thO vdlue of the work
completer since the commencement of the PHo3 CT, as determined by
DPW, leas all previous payment€ and 1t),9s all previous retained
amounts. The final payment, if urencumbered, or any part thereof
unencumbered, shall be made thirty-five (35) days after the
acceptance of the work and the filing of a Notice of Completion by
CITY. Payments Rhall be madi on demanda drawn in the manner
required by law, each payment to be accompanied by a certificate
signed by the DP'r:, affirming that the work for whteh -jayment is
demanded has been performed in accordance with the terms of the
Agreement and that the amount stated in the certificate in d'•,e
under the terms of the Agreement. Partial payments on the
contract price, uha ll not be considered as an acceptance of any
part of the work.
23. WITHHEI.n CONTRACT FUNDS'..- SUBSTITUTION OF SECU&ITIES
At the request and expense of CONTRACTOR, who shall
.eta+n beneficial ownership and receive interest, if any thereon,
CITY shall permit the substitution and deposit ther.ewich of
recwrities equivalent to the amount of any monies withheld by c vy
to ensure performance under Section 22 of this Agreement.

to MY ky CONTRACTOR or may he awarded to CITY by a court of

27. WORKERS' COMAENSATICN INSURANCE
Pursuant to California Labor Cade Section 1861,
CONTRACTOR acknowIledges awareness of Section 3700 et seq. of said
code, which requires Every employer to be inxured aga2.11st
liability for workers' compensation; CONTRACTOR covenants that it
will comply with such provisions prior to commencing performance
if the work hereunder.
CONTRACTOR, shall maintain Workers' Compensation
Insurance :in an amount of not less than Five Hundred Thousand
Dollara ($500,000) bodily injury by accident, each accident, Five
Hundred Thousand Dollars ($500,000) bvdill injury b disease, each
employee, One Million Dollaru ($1,000,000) bodily injury by
6isease, policy limit; and CONTRACTOR shall, prior to commencing
performance of the work hereunder, furnish to CITY, on a Form
approved by the City Attorney, a certificate evidencing such
insurance; said certificate shall include a provision that that
insurer shall riot:i y CITY at least thirty (30) days prior to any
cancell_a,t;,on or modificatiun of said insurance policy; and
CONTRACTOR shall notify CITY at least thirty (30) days prior to
any cancellation or modification of such policy. Said insurance
shall not derogate from the provisions for inder„nitication of CITY
by CONTRACTOR cinder Section 26 of this Agreement.
CONTRACTOR shall require all subcontractors to provide
such Workers' Compensation Insurance for all of the
subcontractors' employees. CONTRACTOR shall furnish to CITY a
certificate of waivar of subragahicn under the terms of tho

Workers' Compensation Insurance and CONTRACTOR shall similarly
require all subcontractors to waive subrogation.
20. INEURANCS
CONTRACTOR ,hall carry at all times incident horeto, on
all operations to be performed hereunder, general liability
insurances, including coverage for bodily injury, property damage,
products/corpleted operations, and blanket contractual liability.
Said insurance shall also include automotive bodily injury and
property damage liability insurance, all insurance shall be
urierwritten by insurance companies in forms satisfactory tc CITY
for all operations, subcontract work, contractual obligations,
product or completed operations and all owned veniclea and
non -owned vehicles. Said insurance policies shall name the County
of Orange, the CITY and its officers, agents and employees, and
all public agencies as determined by the CITY as Additional
Insureds. CONTRACTOR sho.11 subscribe for and maintain said
insurance in mill force and effect during the life of U.i,s
Agreement, in an amount of not less than One -Million Dollars
(411000,000) cort-ined single limit coverage. If coverage is
provided under a form which inc..,iies a designated aggregate limit,
such limit shall be no less than twice the per oceur.ence limit.
In the evert o. aggregate coverage, CONTRACTOR shall immediately
notify CITY of any mown depletion of aggregate limits.
CONTRACTOR snail require its; insurer to waive its subrogation
rights against CITY and agrees to provide certificates evidencing
th^ same.
Before CONTRACTOR performs any work at, or prepares or
delivers materials to the site of conatruction, CONTRAC•roR sh*11

furnish to CITY certificates of insurance subject to approval of
the City Attorney evidencing the foregoing l.nsur&u ce coveragemt
said certificates shall provide the name and policy number cf each
carrier and policy, and shall state that the policy is currently
in torn* and will not Le cancelled without thirty (30) days
written notice to CITY. COMACTOR shall maintain the foregoing
insurance coverages in force until the work under this Agresment
is fully completed and accepted by CITY.
The requirement for carrying the foregoing insurance
shall not derogate from the provisions for indemntficstion of CITY
by CONTRACTOR under Section 18 of this Agreement. CITY or its
representative shall at all times have the right to demand the
original or a copy of all said polioleb of insurance. CONTRACVOR
shall pry, in a prompt and timely manner, the premiums on all
insurance hereinabove required.
DEFAULT AND TERMINATION
If CONTRACTOR fails or refuses to prc.:ecute the work
heeeunder with diligence, or fail" to complete the work within the
time ,specified, or is adjudged a. bankrupt or makes an assignment
for the benefit of creditors or becomes insolvent, or violates any
provision of this Pgreement or t,ie Contract. Documental, CITY may
give notice in writing of its intention to terminate this
Agreement. Unless the violation is cured within ten (10) days
after such Notice of intention has been served on CONTRACTOR, CITY
stay, without prejudice to any other remedy it may have, terminate
this Agreement upon the expiration of that time. Upon such
default by CONTRACTOR, CITY may elect not to terminate this
Agreement# in such event CITY may make gcod the deficiency in

30 ► DISPOSITZON OF PLANS, EBZ�tMATES AND OTMIR DOCOIIENTB
CONTRACTOR agrees that: upon completion of the work to be
performed hereunder, or upon earlier termination of this
Agreement, all original plans, specifications, drawings, reports,
naioul4tiona, maps and other documents pertaining to this
Agreement shall be delivered to CITY and became its sole property

31. NON -ASSIGNABILITY
CONTRACTOR shall nos sell, assign, transfer, cohvey cry
encumoer thin Agreement, or any part hereof, or any right or duty
created herein, without the prior written consent of CITY and

32. CITY BMPLOYEES AND OFFICIALS
CONTRACTOR shall employ no CITY official. nor any regular
CITY employee in the work performed pursuant to this Agreemai:t.
No officer or employee of CITY shall have any financial interest
in this Agreement in violation of California Goyernr•?nt Code
Sections 1090 st seg.
33. ATTORNEY'S FEES
if any action of law or in equity becomes necessary to
enforce or interpret the terms of this .Agreement, the prevailing
party shall be entitled to reasonable attorney's fees, coats, and
necessary d1abursements in addition to any other relief to which
that. party may be entitled. If Any actic!i is brought against
CONTRACTOR or any subcontractor to enforce a Stop Notice or Notice
to Withhold which names CITY as a party to said action or by

reason of which CITY incurs expensea, CITY sliall be entitled to
reasonable administrative acid attorney's fees, costa and
necessary diebureEmento &rising out of the processing of said Stop
Notices, Notices to Withhold, or any uimilar legal dncume nt
nacessar� to the prosecution of such action, Said obligation
shall bii provided for in the labor and materials payment bond
requited of CONTRACTOR. CITY may charge an administrative tee of
One -hundred Dollars (4100) for every Strip Notice filed in OXCOss
of two, regardless of wh':ther or not CITY is named in an action.
CITY may set aft any unreimbureed cost or expense so incurred
against any num or sums owed by CITY to CONTRACTOR under this
AgreemeanL• .
34. NOTLCES
All notices required or permitted Lereundear shall be
delivered in person or by registered or certified mail to an
authorized representative of the party to whorr. delivery is to tie

Captions of the Sections of this Agreement are for
convenience and reference only, and the words contained therein
shall in no way be held to explain, modify, amplify or aid in the
interpretation, construction or meaning of the provisions of this

The PROJECT pursuant to which i-Le wor:, covered by this
Agreement is being executed is being .3a isted by the United States
of America, and the Contract Provisions embodied in Sections 37-44

financing all or part of this work, all of the statutes, rules and

to pay all employees on said PROJECT a salary or wage at least
equal to the prevailing rate of per diem wage as determined by the

CONTRACTOA agrees to comply with all applicable federal labor

work, to give up any part of the compensation to which he is

41. CONTRAS! WORK HOURS AND SAFETY STANDARDS ACT
The CONTRACTOR eiiall comply with the proVisione of
Sections 103 and 107 of the Contract Work Hours and Safety
standards Act (40 USC 327-330) as supplemented by Department of
tabor regulations (29 CFR, Part 5), Under Section 103 of the Acto
each CONTRACTOR shell be required Lo compute the wages of every
mechanic and laborer on the basin of a standard workday of eight
(8) hours and standard workweek of forty (40) hours. Work in
excess of the standard workday or workweek is permissible provided
that the worker is compensated at a rate of not Lena than 1-1/2

in compliance with the Energy Policy and Conservation Act (P.D.

complete.
RECOPIMENDATION:
Approve the plans anti specifications fr-r the construrHon of Marcus 1,/1cCallen Park -
Phaso I and outharize staff to ro-bid the project.
ANALYSIS:
On October 20, 1986, the City Council approved the plans and specifications for the
construction of Marcus McCallen Park - Phase I and authorized staff to solicit
construction bids.
On December 15, 1906, the City Council awarded a construction rontraot to Cal -EX
Enginoerinq for the development of Marcus McCallen Park - Phase 1, However,
construction of the project •ouid not proceod, as planned, because soil materials
enr-ou,ttered during cunstruction contained non -toxic oil deposits. Therefore, on
March 16, 1907, the City Council approved the termination of the construction contract.
Subsequent to this action, Council selected SCS Engineers to do a site characterization
study In accordance with Chaster 6.5 of the California Health anti Safety Code And Til:le
22 of the California Administrative Code. The flndings of this study, as approved by Orm
County of Orarge Health Care Agency concluded that soil rernediation of the site is not
.squired. Therefore, the plans and specifications have been prepared for re -bid. The
Director of Public Works recommends approval of the documents ant. requests an
authorization tc re -hid the project.
FUNDING SOURCE:
Rcvenuea of $546,000 ore budgeted in fiscal account 790611 (McCalIon Improvements) to
cover costs of construction.
ALTERNATIVE ACTIONS:
Deny approval of plans and specifications and forego n rP-hidding of the project.
