STATEMENT OF ISSUE:
General Telephone Electric (GTE) Inc., policy requires that a Bill of Sale be executed by the
City at the completion of a pertinent construction project.
RECOMMENDED ACTION:
Execute the attached GTE Bill of Sale.
ANALYSIS:
On April 1, 1991, the City Council awarded a contract to Clayton Engineering, Inc., to
construct the Main Street Alley Improvement Project located within the Demonstration Block
bounded by Main Street to the east and 5th Street to the west, Olive Avenue to the north and
Walnut Avenue to the south. One item of construction consisted of the undergrounding of all
utility lines within the subject project.
On April 20, 1992, the City Council accepted the subject improvements and authorized the
City Clerk to file a Notice of Completion. Consistent with GTE standard policy, the
execution of the attached GTE Bill of Sale shall assign all rights, title, and interest in
telephone property located with the public right-of-way to GTE.
Said telephone property consists of all or any part of the following facilities placed by the
City within the subject limits of construction: underground conduit, manholes, pull boxes and,
appurtenances for the transmission of electric energy for communication purposes.
FUNDING SOURCE:
No expenditures for this item.
ALTERNATIVE ACTION:
Deny execution of the GTE Bill of Sale and resume all legal responsibility and
encumber all maintenance costs for the subject telephone property.
