HomeMy WebLinkAboutGILBERT APPLEGATE - 1969-01-071 A'GEEEIIE N T 2 3 THIS AGREEMENT entered into by and between the CITY OF 4 HUNTINGTON BEACH, a municipal corporatiDii, hereinafter callL.:d CITY, 5 and GILBERT APPLEGAT7, an individual, 2330 Locust Avenue, Long 6 Beach, California, 90806, hereinafter called APPLEGATE, W I T N E S S E T H: 8 WHEREAS, CITY, at public auction held by the Tax Collector of 9 the County of Orange on the 21st day of November, 1968, purchalad 10 one hundred percent (100%) of the leasehold interest in mineral 11 rights on city -owned property located on. Nineteenth Street and 12 thereby obtained the leasehold rights to other property located on 13 Shipley Street, to wit: the Talbert property, and 1•4 It is the desire of CITY to abandon the wells on sa'_d city 15 property and Talbert property, and remove the tanks, pumping units, 16 all surface equipment and a small house from said properties, and 17 CITY has received bids and determined that the bid of GILBERT 18'I APPLOA E is the lowest responsible bid, 191 NOW, THEREFORE, for and in consideration of the promises and 20 agreements hereinafter set forth, the parties hereto agree as :21 follows: 22 1. APPL:GATE shall abandon the wells to State of California 23 standards remove tanks pumping units, rods, tubing, including 24 all surface equipment, and small house from the properties herein- 25 after described, provided that such abandonment and removal shall 26 not include the cleanup of said properties, removal of the con 27 crete slabs, concrete tie downs, oil cake, or the removal of any 28 sumps on the properties. 29 2. The abandonment of the wells on the above -described prop- 30 erty shall be performed in compliance with the rules and regu- 31 latiors e ` the Division of Oil and Gas of the State of California 32 and any applicable city ordinances. 1. i 2 11 1 3• The wells which shall be abandoned and the equipment 2 which shall be 'removed by APPLEGATE are located on the following 3 described property: 4 Lot 16 and the north one-half of Lot 22, Block 1704, Tract 51, and Lots 10, 16 and 5 18, Block 618, Huntington Beach Seventeenth Street Tract, Huntington Beach, California. 6 7 4. APPLEGATE shall receive all tubing, rods, miscellaneous 8 equipment and casing recovered from the wells on said properties 9 and any and all proceeds from the sale thereof'. � 10 5• APPLEGATE shall forthwith furnish to CITY a��bond to 11 guarantee performance of this agreement in the amount of One 12 Thousand and no/100ths Dollars ($1,000.00). 13 6. The work of abandoning said wells, pursuant to this agree- 14 ment, shall be completed within forty-five (45) days after the 15 execution of this agreement. 16 7. APPLEGATE shall furnish to CITY proof of workmen's com- 17 pensation coverage and public liability insurance, having limits 18 of $100,000--200,000 bodily injury and $50,000 property damage, 19 which said liability insurance shall name the City of Huntington 20 Beach additional insured, and a certificate of such insurance 21 shall be delivered to CITY for-thwith. 22 8. Upon execution of this agreement, APPLEGATE shall pay to 23 the City of Huntington Beach as consideration for the execution 24 of said agreement the amount of One Thousand Two Hundred Sixty-six 25 and 12/100ths Dollars ($1,266.12). 26 9.
