NOW, THEi EFORE, in consideration of the convenants and Agree- ments herein contained, being done and peformed by the parties hereto, it is hereby agreed as follows: I. By my signature hereunder, as Contractor, I certify that I am aware of the provisions of Section 3 6b of the Labor Code which require every employer to be insured against liability for Workmen's Compensation or to undertake self-insurance in accordance with the provisions of that code, and I will comply with such provisions before commencing the performance of the work of this contract. II. Contractor agrees to receive and accept as full compensa- tion for furnishing all materials and for doing all the work contemplated and embraced in this agreement, the unit prices con- trac tor submitted in his proposal which was accepted by the City Council. A copy of .said proposal is attached hereto and incorporated herein by reference and made a part hereof. Contractor further agrees that said payment by City shall i`Aclude all payments for all loss or damage arising out of the nature of the work aforesaid, or from the action ,of the elements, or from any unforeseen difficulties or 'obstruc�- tions which may arise or be encountered in the prosecution or the work until its acceptance by the City, and for all risks of every description consequence the suspension or discontinuance of word .an or r, connected he work, also for all expenses incurred onsequen ` p k and for , well and faithfully completing the work, ant: the whole thereof, in the man,nerofntheeng ineer ts and specifications, and the require- ments9neerunder them. VI. Performance Bond and Labor and Material Payment Bond. The contractor agrees to furnish, prior to the execution of the contrac�, bonds, covering the faithful performance of this contract and the payment of all obligations arising thereunder in such form and amount as the City may prescribe. VII. California Fair Employment Practice Act. The contractor agrees to utilize fair employment practices in accordance with California Labor Code Section 1410 et seq. Analysis In 1976, based on a re solution of request from the City, the improvement. of Springdale Street was included in the Orange County Arterial Hidhway Financing Program (AHFP). This City/County Cooperative Project includes curb, gutters, street paving and traffic signal modification on Springdale Street from 300 feet south of Bolsa Avenue to Glenwood Drive. It a.Lso includes the final portion of the bike trail along Springdale Street between Marina High SchaoL and the north City Limits. The administration Agreemc .L designates that the project will be constructed under the AHFP procedure and that the City will be the contracting agency.
