5. Bid Bond. CONTRACTOR further agrees that his pro-
nosal shall be accompanied by a bidder's security in an amount
equal to 10 percent of his bid in accordance with California
Government Code sections 37931 et seq.
6. Qond s . The bond or bonds vequi red to be furnished
to CITY under this contract covering CONTRACTOR10" faithful per-
formance, the cost of labor and materials expe0ed, and CONTRACTORtS
one-year warranty must be furnished to and accepted by CITY prior
to commencement of any work hereunder. All bonds must he in the
amount stated in the special provisions incorporated herein, and in
such form t:s is acceptable to the City Attorney.
7. Warranty. All word; performed in accordance with
these plans, standard specifications, and special provisions in-
cludinU, but riot limited to, workmanship, installation, fabrica-
tions, material and structural, mechanical, or electrical facili-
ties shall be warranted for a period of one year c�mamencing with
the filing of the notice of completion and acceptance of the con-
tract by CITY unless specific areas are to bu warranted longer as
provided .1n special Provisions.

ADDENDUM "A"
TO PUBLIC WORKS CONTRACT
THIS ADDENDUM AGREEMENT to that certain agreement
numbered CC-564 and dated March 1, 1982
by and between the CITY OF HUNTINGTON BEACH, a municipal
corporation of the State of California, therein called
"CITY" J. and Grissom & Johnson, Inc. ,
a California Corporation , therein called
con arto_r - , is hereby ;,codified and amended,
effective on the date shown below as follows:
The parties hereto agree as follows;
1. INDEMNIFICATION, DEFENSE, HOLD HARMLESS:
CONTRACTOR shall defend, indemnify and hold harmless CITY,
its officers, agents, and employees, from and against any and
all ltability, ,judgments, damages, costs, losses, claims, in-
cluding Workers' Compensation claims, and expenses resulting
from or connected with CONTRACTOR'S negligence or other tort--
ious conduct in the performance of this agreement.
2. WORKERS' COMPENSATION:
CONTRACTOR shall comply with all of the provisions of
the Workers' Compensation Insurance and Safety Acts cf the
State of California, the applicable provisions of Division
1f and 5 of the State or Federal acts of laws applicable.
CONTRACTOR shall. furnish to CITY a certificate of Worker's'
Compensation innirranca. The insurer shah not cancel or

modify the policy without thirty (30) days' prior written
notice to the CITY. In the alternative, the CONTRACTOR may
show proof of a certificate of consent to self -insure issued
by the Director of Industrial Relations according to Califor-
nia Labor Code Section 3800.
3. INSURANCE:
CONTRACTOR shall obtain a policy of comprehensive bodily
injury and property damage liability insurance, and maintain
such policy in effect for the period covered by this agreement,
providing coverage for bodily injury and property damage in the
minimum amount of $300,000 combined single limit per occurrence.
The policy shall namn, as additional assured, CITY and its officers
and employees, while actirig within the scope of their duties,
against all claims, suits, or other actions of any nature brought
for or on account of any injuries, damage or loss, including any
deaths arising out of or connected with the work of CONTRACTOR
under this contract. CONTRACTOR shall furnish CITY a certi-
ficate of insurance rrom the insurer that the insurer shall

shall secure at its ex0ense, and be responsible for any and
all payment of income tax, social security, State disability
insurance compensation, unemployment compensation and other
payroll deductions for CONTRACTOR and its officers, agents
and employees, and all business licenses, if any, in connection
with the services to be performed hereunder.
5. All forms of insurance offered to the CITY must be
approved by the City Attorney prior to conmencement of any
work by the CONTRACTOR.

We are transmitting four (4) copies of a contract for the modification of traffic
signals, signs and striping at Bolsa Avenue and Graham Street, Project CCw564,
in the City of Huntington Beach. The contract was awarded to your firm at the
regular meeting of the City Council held Monday, March 1, 1982.
Will you kindly execute the contracts and have all signatures notarized on all
copies. It is required for a corporation that the President and Secretary of the
corporation sign the contracts and also sign the hold harmless clause on all
Certificate of Insurance. After signing, return to this office together with the
Labor and Materials Bond equal to fifty percent (50%) and Performance Bond in the
amount of one hundred percent (100`G) of the contract price.
A guarantee for the project shall be furnished to the City and may be included as
part of the Faithful Performance Bond. There shall be express wording in the
Performance Bond if such bond includes the guarantee or warranty of the Labor and
Materials for a one year period commencing with the filing of the Notice of
Completion and acceptance of the contract by the City. The guarantee amount shall
be for the full amount of the Performance Bond. Release of the Performance Bond
shall not apply to the guarantee and warranty period. If the guarantee and warranty
is not included in the Performance Bond, a separate bond must be furnished to the
City.
Also enclosed are two sets of a Certificate of Insurance in duplicate. This
insurance form is the only one that will be accepted by the City of Huntington Beach.
Pleasa return one set with the bonds and executed contracts.
Folloving approval of the bonds and insurance, the City will execute the contract
and return a copy to you.

In response to the request of the Public Works Department, a Financial Impact Report
is hereby submitted relative to the additional request for funds necessary to fully
fund the traffic signal modification at the Graham/Bolsa intersection. it has been
suggested that the low bid for the contract will require an increase of $ 5,965
over .and above the original City estimate.
There is an unencumbered balance in Account 745320 of $22,150.75 which may be used
to fund this project.

Notice is hereby given that the City Council of the city of Huntington Beach,
California will receive sealed bids for the Modifications of traffic signals, signs and
striping at the Intersection of Balsa Avenue and Graham Street in the city of
Huntington Beach, California in accordance with the plans and specifications and
special provisions on file in the office of the Director of. Public Works. Documentu
will be available on January 19, 1982. A charge of $10.00, not refundable, will be
required for each set of specifications and accompanying drawings.
DIRECTOR OF PUBLIC WORKS ESTIMATE
Work Item Quantity
1. A city furnished controller to provide six (6) phases Lump Sum
including left -turn phases on Balsa and separate
phases for Graham St. and the entrance into your
facilities. By comparison, the existing controller
provides only two (2) phases, one for Graham and one for
Balsa, both directions.
2. Install the necessary poles and hardware for the left.. Lump Sum
turn phases an Balsa.
3. Install the necessary underground conduit, wiring and Lump Sum
pullboxes.
4. Install pedestrian Indications for all directions. Lump Sum
5. Install internally Illuminated street name signs Lump Sum
indicating "Graham Street" and "McDonnell Douglas"
(or other suitable name).
6. Install new loops on Graham Street and on the Douglas Lump Sum
entrance side of the Intersection.
In accordance with the provisions of Section 1773 of the Labor Code, the State of
California, Director of the Department of Industrial Relations shall determine the
general prevailing rate of wages, applicable to the work to be done; copies of the
latest general wage rate determinations are an file at the office of the City Clerk
and. the office of the Director of Public Works of the City of Huntington Beach,
California.
Plans and specifications, together with proposal form, may be obtained at the office
of the Director of Public Works, City Hall, Huntington Beach, California.
No, bid will be received u,-less it is made on a blank form'furnished by the Director of
Public Works. The special attention of prospective bidders is called to the proposal
requirements, setforth In the specifications, for full directions as to the bidding.

The above quiamtities are approximate only, boing`given as a basis for the comparison
of bids, and the city of Huntington Beach does not express or by implications agree
that the actual amount of work will correspond therewith but reserves the right to
increase or decrease the amount of any class or portion of the work, as may be
deemed necessary or expedient by the Director of Public Works.
All'bids will be compared on the basis, of the Director of Public Works estimate of the
quantities of work to be done.
Each'bid shall be made out on a form to be obtained at the office of the Director of
Public Works, Development Wing, 2000 Main Street, Huntington Beach, Califomia;
shall be sealed and filed with the City Clerk at the Civic Center, Second Floor
Administration Building, 2000 Main Street, Huntington Beach, California, on or,
before 10:00 am of Thursday, January 28, 1982 and shall be opened by a committee
composed of the City Clerk, the City Attorney and Director of Public Works or their
authorized representative and the results of said bidding will be reported to the City
Council of said City of Huntington Beach at their regular meeting to be held on
Monday, the 16th of February, 1982, at the hour of 7:30 PM in the City Council
Chambers In the Civic Center of said City of Huntington Beach, and shall be acted
upon by said City Council at the regular meeting of- February 16, 1982.
The City of Huntington Beach, California reserves the right to reject any or all bids,
and to accept the bid deemed for the best interest of the City of Huntington Beach,
California.

Statement of Issue:
The existing traffic signal at Bolsa Avenue and Graham Street has
become ineffective and insufficient for present day traffic demands.
The plans and specifications have been completed and the project is
ready to be advertised.
Recommendation!
That the City Council approve the plans and specifications for this
project and authorize the Department of Public Works to advertise
for bids for the construction of traffic signal modifications at
this intersection.
Analysis:
Plans and specifications have been ampleted by the City staff and are
ready for bid. The modifications included the addition of separate
left turn phases for eastbound and westbound traffic (Bolsa Avenue).
The :modifications will provide separate split phases for Graham Street
along with new vehicle detection. Internally illuminated street name
signs will be installed as part of this project.
Funding:
City Funds (Gz ,; Tax Funds) - $17, 750.00
McDonnel Douglas Astronautics Co. - $17,750.00
Total $35,500.00

THIS AGREEMENT, made and entered into this day

("ORPORATION, A Maryland corporation qualified to do business in
California, hereinafter called "COMPANY" and the CITY OF HUNTINGTON
BEACH, a municipal corporation of the Stater of California, herein --
alter called "CITY".
WITNESSETH:
WHEREAS, the intersection of Bolsa Avenue and Gvaham Street
lie within CITY, and
Engineering studies indicate that modification of the
traffic signal is warranted at the above named intersection for
improved traffic safety and efficiency, and 0

COMPANY and CITY.
NOW, THEREFORE, in consideration of the covenants and
conditions herein contained, the parties hereto agree as follow;::
1. CITY shall prepare plans and specification, provide
engineering and contract, administration, for the installation of a

14. The cost of installation of the traffic signal system
is estimated to be approximately thirty-five thousand five -hundred
dollars ($35,500). The COMPANY shall pay fifty percent (50%) of
the actual costs but not to exceed seventeen thousand seven hundred
t'it'ty dollars ($17,750). The CITY shall pay fifty percent (50%)
of' the actual costs and all costs beyond COMPANY'S seventeen thou-
sand seven hundred fifty dollars ($17,750) maximum contribution.
5. COMPANY shall pay its proportionate share within
thirty (30) calendar days upon billing by the CITY.
6. CITY shalt require the contractor who receives the
bid to keep an exact accounting of the expenditures on the traffic
signal. project..
7. Upon completion of the edification of the traffic
signal system at the intersection of Bolsa Avenue and Graham Street,
the maintenance of said system shall be performers by or under the
direction of CITY. The cost of said maintenance shall be borne
by CITY.

in response to the Public Work3 Department, I am hereby submitting a Financial Impact
Report relative to the requested funding to accommodate the traffic signal modifications
at the Bolxa/Graham intersection- It has been suggested that an appropriation in the
amount of $17,750 would be sufficient to cover the City's share of the project's
financing.
Adequate monies are available in the Gas Tax Fund for this purpose. Should the City
approve this request, the balance in the Gas Tax Fund will be reduced to $384,071.
