HUNTINGTOri BEACH a runicipol corporation o- the State of
California, hereinafter referred to as "L ICENSEE," and HARLO
LEBARD, hereinafter referred to as "LTCENSOR." -,:
WHEREAS, LICENSER is the owner of cert n real property
located on California street in the Cite of Huntington Yieach as,
more particular1l described in red in E hibit "A" hereto, and;
LICENSEE and LICENSUR desire to make street improvements upon
LICENSEE'S prop, along the front of LICEI SOR` S property.
NOW, ' H:IREFORE, it is agreed ar, follows
1. LICENSOR grants to LICENSEE a license to enter upon.
LICENSOR.'S property fog^ the n` rpose of constructing street
improvements along thy- front of said property as shavn in Exhibit
2 LICENSEE shall indemn y and hold LICENSOR harmless from
and against any aril all claims for injury to persons or property
arising out of or in connection With the aforementioned work.
3. It is fu chef agreed and understood that, excepting the
f, improvements to be constructed, LLCENSEE shall restore the
e property to its original, condition to the reasonable satisfaction
of LICENSOR upon completion of the aforementioned work.
4. LIrCZNS0E rhail pay a sum of money to LICENSEE according
to the cost tsti. sates in Exhibit "B"' hereto. LICENSEE hire
contractor -to perform ..he improvements. If the total actual cost
of cr astructing the im-nrovemente is less than the Grans Total

STATEMENT OF 1SSUB;
j'he Ca_ty and przvite owners along California street wish to participate
in street improvements.
RECOMIKEN )ATIONS
1. AdoVp F4 ative Declaration 83-54.
2. Approve agreements for participation in street improvements with
Mr. LeBard and .14s. Kitrzey.
3.. Approve plans and specifications and authorize call for bids.
ANALYSIS -
Ne CRF desires to complete the street improveanents on California Street
fronting manning Park.. These improvements uvere deferx,d );rom a previ_'ts
contract as a danotrous traffic condition would have been created due
to tYe LeBard house that was just north of the Park sita and sat within
the future street right of Wray at Claliforzxia Street,
Mr, zeB d has naw demolished the rld house, is bu:ldi.ng a new residence
and has provided the City with a street easement deed to clear a clouded
title. des. Ximzey, oC*mer of five lots on the: west side of California
Street: opposite the LeBard and City* prop:rties, is also building addi-
tional units of the rear of her residence. Both pa. -ties are obligated
for street improvements as a,condition of development. Mr. LeBard
also has a previous obligation on an adjacent devel.opme zt for sheet
improve ants that -were deferred by prior Council action.
As these street improvements ark: connecting, it is: recommended that the
City award one contract for al:, three pa -,,ties' world.. Each party would
-,)ay their agreed share. Deposits from Mr. LeBard and Ms icinzey would
be placed, with the City prior to the award of the contract
