were smiled to youv office in January, 1982, regarding a rental agree-
ment or, City-ewned property at 19071 Huntington Str between the City
and Harald Pugh. You will rate on the first page or the -agreement that
the City agrees to pay all possessory interest taxes. This agreement
was originally sent to you in error. Please correct the necessary
records so that the tax bill will no lcnger go to Mr. Pugh but will

a ?municipal corporation, hereinafter referred to as "CITY" and individual
HAROLD PUGH., here; na.fter referred to as "TENANT".
WHEREAS, "CITY" owns property in the vicinity of Huntington
and Garfield known as the Water Operations Yard, and
A single family residence is located on a portion of the
property, and "CITY' is desirous of renting said residence on a
month -to- month basis:
NOW, THEREFORE, parties hereby agree as follows;
1. DESCRIPTION OF PREMISES CITY hereby rents undo+° :ns

months' rent upon execution of this lease. If at any 'lane during
the tex:r hereof, TENANT fails to perfo m any of the conditions of
the lease, or causes dar+age to the premises, or ,fails to leave the
dwelling in a reasonably clean condition upon termination, then
CITY may appropriate and apply any portion of the last month's
rent neces..,;ary to make the rf.-Aairs or clean the premises.
MAINTENANCF: shall maintain premises, including
landscaping, in gcon, If 'I"ENAUT fails to maintain the
pz-einizes, CITY may, at Its option, perform necessary maintenitnee
and bill TENIJIT for the cost of services rendered, and TENANT
shall reimburse CITY for the cor,' thereof within ten (10) days
after receipt of billing.
6. INDEMNIFICATION: During the term of this tenancy, TENART
agrees to indemnify, defend, and save CITY harmless feom any and
all claims arising from any act, orvlssion or negligence of TENANT
or his agents or employees arJsJnC from any accident, injury or
damage whatsoever caused to any person ov property occurring in,
on or about tle leased premises, and from, any and all cost,
expenses or liability inn erred in connect' -on with any such claim
or proceeding.
7. ALTERATIONS DURING TERM OF TENANCY: TENANT shall not
make any alterations to the premises without the written consent
of CITY, and shall use toe premises for residence purposes only.

9. COMMENCEMENT OF TERM: The tenancy under this agreement
shall commence on February 1, 1982.
10. L7MITED DURATION OF TENANCY IN TERMINATION NOTICE:
Either party may terminate this lease by thirty (80) days written ,.
notice to the other party. In executing and entering this tenancy,
TENANT has been informed and is aware that said tenancy will only
be for an interim period, and that the maximum duration of the

lease will be until such time as CITY develops, sells or conveys <
the subject property for other purposes. TENANT will
not be entitled to relocation,or other assistance, or reimbursement
upon the termination of this lease.
11. UTILI'. S: TENANT sham, pay and be responsible for all util—
ities servicing the property.

The city owns a small house at 19071 Huntington St, adjacent to the stater
>,ivision hper}tions Yard. This house has been rented 1,y Harold Pugh since
1971, However, no formal rental agreement exists. Thi.7 matter was brought
to staff's attention by the City Auditor and we have propared the attached.
Rental Agreement.
The Agreement calls for a rental amount of. $200 per mor,th which is market
value for a 600 square foot house with no garage and minimal yard space.
