FRANZ, Deputy City Adminis ra SUBJECT: SIDE LETTER OF AGREEMENT BETWEEN THE CITY OF HUNTINGTON BEACH AND THE HUNTINGTON BEACH FIRE ASSOCIATION (HBFA)* �O , q1 � — ?a Statement of Issue, Funding Source, Recommended Action, Alternative Action(s), Analysis, Environmental Status, Attachment(s) Statement of Issue: To identify issues of agreement that had been reached during the 1993-94 negotiations, which were not issues at impasse. Fundinq Source: Funding provided in the 1995-96 budget. Recommended Action: To approve. Resolution # CrG - 0 adopting the side letter, of agreement between the City and the HBFA. Alternative Action(s): To not approve the side letter of agreement and request the parties renegotiate. Analysis: The attached side letter of agreement was prepared to memorialize items of tentative agreement between the City and the HBFA prior to declaring an impasse on a new Memorandum of Understanding for 1993-94. It is the intent of both the City and HBFA that these items be incorporated into any future Memorandum of Understanding. To assure that purpose this side letter has been prepared to include: 1. Compensatory Time - This side letter will authorize staff positions to receive compensatory time off at the time and one half rate required by existing law. 2. Vacation Accrual - Authorizes current employees to accumulate vacation up to 342 hours, which is equal to 20 shifts. Association Business - Increases the time authorized for Fire Association business from 375 to 400 with a 150 accrued carry over to the following year. 4 - 6. Fire Controller - Items 4 through 6 pertain to changes involving Fire Controller special pay and a title change to the Leadworker classification. Although these changes were agreed to for the applicable period, they would cease on July 1, 1996, the date the City discontinued fire dispatching operations. 7. Uniforms - Moves the language regarding departmental uniforms from the M.O.U. to Departmental Policy C-2. 8. Pay out of Rank - Allows Paramedic Captains, when working as a Captain, to be paid as a Paramedic Captain; Paramedic Engineers, when working as Engineers, to be paid as Paramedic Engineer; and Paramedic Firefighters, when working as a Firefighter, to be paid as Firefighter except when ordered to work, then paid as Paramedic Firefighter. Side Letter between City and HBFA 0020199.01 -2- 07/30/96 9:48 AM RESOLUTION NO. 9 6- 7 0 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH APPROVING AND IMPLEMENTING A SIDE LETTER OF AGREEMENT WITH THE HUNTINGTON BEACH FIRE ASSOCIATION WHEREAS, the City of Huntington Beach ("City") and the Huntington Beach Firefighters Association ("HBFA") entered into a Memorandum of Understanding ("MOU") regarding salaries, benefits and working conditions, which expired on September 30, 1993; and The City and the HBFA subsequently met and conferred on a new MOU; and After protracted negotiations and meetings, an agreement was reached on a number of amendments to the prior MOU, but an impasse was reached on six (6) issues; and Both the City's and the HBFA's positions were presented to a hearing officer; Joseph F. Gentile, who ruled on the six (6) impasse issues on February 17, 1995; and After additional meetings, the City and the HBFA could not reach a final agreement, and subsequently, pursuant to City Resolution No. 96-7, the City Council unilaterally adopted as the terms and conditions of employment for the HBFA recommendations one (1) through five (5) of the hearing officer; and In adopting Resolution No. 96-7, the City did not expressly memoralize the amendments to the prior MOU which the City and HBFA had agreed upon prior to submitting the remaining impasse issues to the hearing officer; and The purpose of this Resolution is to restate the terms and conditions of employment of the HBFA as unilaterally adopted by the City Council pursuant to Resolution No. 96-7; 1 SF/s: PCD: Resolut: H BFAside 8/7/96 - 94 RLS 96-544 LI El NOW, THEREFORE, the City Council of the City of Huntington Beach does resolve as follows: Section 1. On February 5, 1996, pursuant to Resolution No. 96-7, the City Council unilaterally implemented the terms and conditions of employment for the HBFA. These terms and conditions of employment are set forth in the following documents: 1. The Memorandum of Understanding with the Huntington Beach Firefighters Association which expired on September 30, 1993, as amended by the Side Letter of Agreement with the Huntington Beach Fire Fighters Association, attached hereto as Exhibit A. 2. Recommendations one (1) through five (5) of the hearing officer, which are attached to City Resolution No. 96-7. The purpose of the side letter of agreement is to memorialize those items in which the City and H.B. F.A. have reached a tentative agreement prior to declaring impasse on a new Memorandum of Understanding. It is the intent of both the City and H.B.F.A. that these items be incorporated into any future Memorandum of Understanding between the City and H.B.F.A.. 1. Compensatory Time (p.17, Article VII, Sec D, 2b) b. Ex Staff Personnel - For all staff personnel positions, in lieu of compensation by cash payment for overtime as provided in this article, such employees may, at their option, and with approval of the Fire Chief, be compensated by compensatory time off at a -straight tom rate an nn hn, ,r fnr #ter basis time and one half for each overtime hour worked. [To become effective May 4, 1996] 2. Vacation Accrual (p.32, Article X, Al) • Vacation allowance shall not be accumulated in excess of three hundred twenty {32-A) forty two (342) hours. Association Business (p.35, Article X, A5) Association Business - During the term of this M.O.U., authorized representatives of the ASSOCIATION shall be entitled to receive up to a total of three-four hundred (400) seventy five (3 75) collective hours without any loss of compensation per contract year to be utilized for lawful ASSOCIATION activities. In addition, up to one hundred fifty (150) unused hours may be carried forward to the next fiscal year. 4. Title Change (M.O. U.) All Fire Controllers and Fire Controller Shift Supervisors shall obtain Emergency Medical Dispatch (EMD) certification within one (1) year of their date of hire. After receiving EMD certification, Fire Controllers and Fire Controller Shift Supervisors shall receive monthly one hundred twenty dollars ($120) compensation as long as their certification remains current. Pay out of Rank (Article VII. D1b, page 16) (Add to paragraph D1b) Paramedic Captains, when working as a Captain, will be paid as a Paramedic Captain. Paramedic Engineers, when working as an Engineer, will be paid as a Paramedic Engineer.
