Statement of Issue:
The Fair Labor Standards Act requires that a written agreement be in place to allow
compensatory time to be given in lieu of paid overtime. This provision is included in the
Memoranda of Understanding (MOU) between the City and the various employee
associations. The MOUs with the Police Officers Association, (POA) the Huntington Beach
Fire Association (HBFA) and the Marine Safety Officers' Association (MSOA) expire on
September 30„ 2003. This side letter would extend the agreement to provide compensatory
time in lieu of paid overtime until new MOUs are in effect.
Funding Source:
The ability to provide compensatory time results in the reduction of paid overtime.
Recommended Action:
Motion to:
Adopt Resolution No.2U)_�-A3 , a resolution of the City Council of Huntington Beach
amending the Memoranda of Understanding between the City of Huntington Beach and
the Huntington Beach Police Officers' Association regarding compensatory time.

2. Adopt Resolution No 20p"__ a resolution of the City Council of Huntington Beach
amending the.Memoranda.of Understanding between the.City of Huntington Beach and
the Huntington Beach Firefighters' Association regarding compensatory time.
3. Adopt Resolution No.abb3' a resolution of the City; Council of Huntington Beach
amending the Memoranda of Understanding between the City of Huntington Beach and
the Huntington Beach Marine Safety Officers' Association regarding compensatory time.
Alternative Action(s):
Allow the MOUs to expire; therefore ending the agreement, resulting in a "cash out" of all
current compensatory time accrued and eliminating the ability to provide compensatory time
until new MOUs are in effect.
Analysis:
The City is currently in negotiations for new MOUs with the POA, the HBFA and the-MSOA.
The adoption of this resolution will ensure the ability to continue to provide employees
compensatory time in lieu of paid overtime until new MOUs are in effect.

compensatory time,
NOW, THEREFORE, the City Council of the City of Huntington Beach resolves as
follows:

Side Letter of Agreement — Compensatory Time
Between the City of Huntington Beach and the
Huntington Beach Police Officers' Association
Effective Date: October 1, 2003
This is to memorialize an agreement between the City of Huntington Beach (City)
and the Huntington Beach Police Officers' Association (POA) to reflect agreed upon
changes to compensatory time off.
The City and POA hereby agree to extend, pursuant to Title 29 United States
Code § 207(o), the current compensatory time -off agreement found at Article IX.C.1
(Compensatory Time) in the current Memorandum -of -Understanding (MOU) past the
expiration date of September 30, 2003 subject to the following conditions:
1. The current agreement found at Article IX.C.1 (Compensatory Time) in the
current MOU will remain operative until midnight of the day, if any, that the
current labor negotiations result in impasse on any matter, or
2. Is superceded by a new agreed upon MOU; or
3. Is modified by a writing agreed to by the parties hereto.
IN WITNESS WHEREOF, the parties hereto have executed this side letter to the
Memorandum -of -Understanding this 3 O day of September, 2003.
