HUNTINGTON BEACH COMPANY, a California corporation, hereinafter referred to as "Lessor," does hereby lease, let and demise unto the CITY OF HUNTINGTON BEACH, hereinafter referred to as "Lessee," for a farm of eighteen (18) months from the date hereof, and month to month thereafter unless sooner terminated as provided herein, 'land described as follows: Those portions of Blocks 3001, 30029 3101, and 3102 of East Side Villa Tract as shown on a map recorded in Book 4 Page 65 of Miscellaneous Maps, records of Orange County, California, more particularly described as follows: Parcel ;. the south 96 feet of Blocks 3101 and 3102. Parcel 2 the north 4 feet of Block 3002. Parcel 3 the north 270 feet of Block 3001. Parcel 4 the west 50 feet of the north 270 feet of Block 3002. The parcels are leased for materials storage and construction purposes for the Overmyer Reservoir Unit No, 3 project. After one (1) year from the date hereof either party shall have the right to terminate this lease by giving the other party hereto sixty (60) days written notice of intention to terminate same. 2. Lessee shall pay a monthly rate of One Hundred ($100.00) Dollars as rental for the land hereby leased, payable quarterly. 3. If default should be made in the performance of any of the terms or observance of the conditions herein contained, Lessor may at its option forthwith terminate this lease and re-enter and take possession of said premises and remove and exclude lessee and all of his property and all other persons therefrom. Lessee agrees to quit and deliver up said premises to Lessor peaceable and quietl-., at the expiration or any sooner termination of this lease in a= good order and condition as the same are now, normal depreciation excepted. 4. Lessor shall have ro obligation of any kind in or about said premises, after completion of surface clearances paid for under City Purchase Order Number 6382 -hall not make any additions, improvements or alterations to said premises witho4k- -itten consent of Lessor thereto., and agree to commit no waste during the life o.: this lease; and lessee hereby waives any right Lessee may have to make .repairs at the expense of Lessor. 5. Lessee agrees that he will within sixty (60) days from receipt of a written notice of termination from Lessor or at the termination of this lease remove from said premises all of Lesseets property placed thereon pursuant to the terms of this lease and leave said premises in a clean condition. 6. Lessee shall pay when due all taxes levied upon any improvements or equipment placed upon said presses by Lessee. 7. Lessor shall not be liable for injury to or death of any person or for the damage to property of any kind on account of any condition of said premises or on account of anything occurring thereon during Losseets occupancy thereof and Lessee shall indemnify and hold Lessor harmless from and against any and all loss, r cost,damage, expeD.zse or liability to any person or persons for death, personal injury or damage to property including all damage to Lessors property in any way arising out of Lessees use or occupancy of the demised premises and/or the means of ingress and egress thereto during the term of this lease. Lessee will include the d nai.7e premises within its over-all property and public liability insurance coverage. Y 8. This lease is personal to the Lessee and the Lessee shall not sell nor assign same. Due to the depth and limits of the construction, it was known additional s room was necessary and the lease was arranged for prior to the contract bid and award. It is recommended -that your Honorable Body approve the document and authorize the Mayor and Clerk to execute the lease, y and direct the Clerk to return one copy to this office and one copy to the Huntington Beach Company.
