W I T N E S S E T H;
1. HUNTINGTON BEACH COMPANY, a California corporation,
hereinafter referred to as "Lessor," does hereby lc3se, let and damise
unto the CITY OF HUNTINGTON BEACH, hereinafter referred to as "Lessee,"
for a term of two (2) years from the date hereof, and month to month
thereatter unless sooner terminated as provided herein, land described
as follows:
A parcel of land situated in Uie Nor''11west (�uarcer of
Section 11, T. 6 S., R. 11 W., S.B.B.&M._, ih the City
of Huntington Beach, California; Namely, the South
130' of tl° :,a North 160' of Block No. 908, Weslc..y Park
Section as shown on a map recorded in Book 4, Page_1,7
of Miscellaneous Maps, Records of Orange County,
Cal ifornia,
- for the sole purpose of parITIng automobiles thereon'. The parking lot
area is 132.1' x 1301, consisting of 17,173 square feet and is
delineates% on the attached Exhib4.t A.
After one (1) year from the date hereof either party
shall have the aright zo terminate this lease by giving the other party
hereto sixty (60) days written notice of intention to terminate same.
2. Lessee shall ;day in advance Eighty-five dollars ($85.00)
per month as rental for the land hereby leased.

the terms or observeiice of the conditions herein contained, Lessor a,ay
at its option ror,E.hkith terminate this lease and re-enter and take
possession of said premises and remove and exclude. Lessee and all of ris
property and all other persons therefrom, Lessee agree; to quit and
deliver 'up said premises to Lessor peaceable and quietly at the expiration
or any sooner termination of this lease in as good order and condL
as the same are now, normal depreciation; excepted.

4. Lessor shall have no obligation of anv` chid in or about
said -premises. Lessee shall not make any additionst improvements or
alterations to said premises without the written consent of Lessor
thereto,, and agree :r ) commit no waste during the life of this lease,
and r;essee hereby waives any right Lessee may have to make repairs at
vt e; opens- of Lessor.
5. Lessee agrees that he will within sixty (60) days from
receipt of a written notice of termination from Lessor cr at the
termination of this Tease remove from stud premises all asphalt paving,
posts, etc.- placed on said premises by the City of Huntington Beach
pursuant to the terms of that certain lease. between the parties hereto
dated November 15, 1964 and .all of Lessee's property placed on said
.premises pursuant to -the terms of this lease and leave said premises in
a clean condition.
6. Lessee shall pay when due all taxes levied upon any
improvements or equipment places, upon said premises by Lessee.
7. Lessor shall not be liable for injury to or death of
person or for the damage to property of any kind on account of any
condition of said premises or on account of anything occurring thereon
d,iring Lessee's occupancy thereof and Lessee shall indemnify and bold
Lessor harmless from and against any and all loss, cost, damage, expense
or liability to any person or persons for death, personal :Lnju ray or
damage to property including all damage to Lessor's property in any way
arising out of Lessee'-s uce or occupancy of the demised premises and/or
the r:rans of ingressandegress thereto during the term of -this lease.
Lessee will include the demise premises within its. overall property and
public liability insurance ooverage.

STATEMENT OF ISSUE GS
The City has been leasing a 20,000 sq. ft., impro-�L:d parking lot on the southeast corner
of Lake Street and Memphis Avenue for $85 per month from the Huntington Beach Company.
Due to disuse by city residents, as well as lessor's plans to build on this property,
termination of the lease appears necessary.
E'IV'DA.'%'ION
(::T!erfminate the $85 per month Lease with the Huntington Beach Company7andthorize removal
asphalt paving by Public Works.
ANALYSIS
The parking lot across from the Lake Park Clubhouse was originally leased from the
Huntington Beach Company as parking for employees of the old city ,yard complex a,
Memphis Avenue snd Alabama Street- This complex was evacuated when the nevi city yard
was completed on Gothard Street.. However, the parking lot lease was retained to satisfy
public park use needs and lease payments were transferred :from Puublic Works to Recreation
and Parks, 4 three-month survey of subject lot has determined it is not used heavily
daring the fall, winter and spring.

Company to the City or use of a 17,178 square foot area of _
land which was developed by the City for employee parl�ing at
the old oity yard, �- hereby submitted for renewal fcr the
same dollar amount ($85 per ,month) as a parking lot for th
public. This lot lies' diagonally across the street from
Lake Park Clubhouse and the adjacent group picnic area..

the renewal of the "old city yard parking lot" lease between
the City and your company for a two year period, for the purpose
of providing public off-street parking.
