E. iartge fi Public Works Submitted by ,Department _ _ Date Prepared August 23 , 1978 Backup Material.Attached Yes No Subject Agreement to Defer Street Improvements City Administrator's Comments I Statement of Issue, Recommendation,Analysis, Funding Source,Alternative Actions: a� Statement of Issue: The uncertainty at this time of the ultimate alignment of Main O . north of Yorktown Ave. suggests deferment of street improvements, Recommended Action: It .is recommended that the City Council approve and authorize the execution r of an _,agreement between the City and the Huntington Beach Co. deferring the =` required street improvements on Main St. along the frontage of Seacliff Office Park Building No. ? and in addition waive the required bond or cash deposit. Analysis: v Ordinance Code Section 9730.4 requires street improvements to he constructed prior to the Certificate of occupancy being issued for a new structure Ordinance Code Section_9730.6 (b) authorizes exceptions to Ordinance Code Section 9730.4 where practical difficulties arise. Because the ultimate alignment of Main :St. remains in question at this time, it appears reasonable to defer the required street improvements until, a precise plan of street alignment is ,adopted for this section of Main Street. Additionally, ordinance Code Section 9730.6(b) (2) authorizes a waiver of the required: bond of cash deposit far deferred street improvements if so directed by the City Council. The recommended agreement, contains this bond or cash deposit waiver on the premise that the Huntington Leach Co. is not likely to w be 'short of cash to construct the improvements when requested to do so. Alternatives Deny the agreement and require the street improvements to be constructed at this time along the present alignment of Main_ St._ on the assumption that the present alignment will be the ul.timatc alignment. -Fundinq Sourcta: T- ere are r}c. xpe:sditure of C4 ty funds invol'�.ed in, the recommended action. NNW q' 3 AGREEMENT THIS AGREEMENT, made and entered into this 1510 day of 1975, by and between the City of Huntington ;3each, a municipal;`corporation of the Gtate of California, here ,nafter referred to as 'CITY, and Huntington Beach Company, '.a California corpoxation,: hereinafter referred to, as (OWNER. RECITALS: 1. CITY regLires the 'dedicati..or of right of way and public improvemeuts pursuant to the provisions of Sections 9730.E at�c3 9730.4' of CITY' s 'Ordinance Code as a condition to said develop- ment of the following described parcel: Parcel l of Parcel Map eeeor" rt Book 121 Pages 13 & 19' of Parcel. The off,-site public improvements required t- CITY to be completed by OWNER along ruin Street (ap-scoximatel, 50 feet) abu.t;.in;g the above-described parcel, are: eight (8) inch curb and gutter along the easterly side of Main Street, six (6) inch curb only along the easterly side of the median, eight (3) foot wide sideu,l.k, all paving ;to tie in with existing pavi.-kg and new ctix�i and gutter and/or new pairing for the easterly half of Main Street an extend or modify, if necessary, the northerly, drive approach; but excluding landscaping and irrigation within the 3 median; ;a 3.- OWNER has made said dedication and CITY has estimate'_ the cost of construction of said public improvements, including the incidental expenses, excluding engineering and cost of preparing _ plans thereof, to be $12.,000. 0.0.; and `3 4 OWNER desires a time extension, in accordance with E .B. DELAYED CONSTRUCTION: City shall grant a time extension to delay the cunstructign of the required off--site improvements in accordance ltla Huntington Beach Ordinance Code Section 9730.60) along the frontage of the above--described parcel due to the pending xealignment 'of Main Street. 2. COST OF Oi=P-SITE CONSTRUCTION: The work which OWNER is obligated to perform has been estimated to cost $12,000,..00. 3. SECURITY FOR DELAY: Owner .requests the Huntington Beach City Council waive all consideration for a security guarantee of said improvements in accordance with City Ordinance, Section 9730.6 (b)., Said waiver is hereby granted, s 4. EXTENSION PERIOD: If, in accordance with Paragraph 5 r below, _notice has not been recei•=red by Owtier from City's Director of Public Works within two (2) years of the date of exec%jtion' of this agreement, then Owner shall commence the permanent impro-*e- ments, outlined in Paragraph 2 of the Recital to this agreement, on the e:cisting `Main Street alignment at Owner's sole cost. Owner shall then no louger be obligated to construct any additional s improvements on Main Street if it is realigned. 5. NOTICE TO CONSTRUCT: Within thirty (30) days of the date; 'r written notice is given to OWNER by CITY' s Director of Public Works, OWNER shall prepare plane and specifications for said t, off--site improvements and submit to the CITY for approval. Once said approval is given and all permits are granted to OWNER then OWNER shall commerce construction of said improvements along the frontage of said parcel. within ninety (90) days of issuance of said permits'. r 2.
