Statement of Issue, Recommendation, Analysis, Funding Source, Alternative Actions:
Statement of Issue:
A condition of approval for the Seacliff Phase IV Project is participation
in fifty percent of the cost of a traffic signal by the Huntington Beach
Company.
Recommendation:
Adopt Resolution No.i �- autho-izing execution of the Agreement for
the installation of a traffic s-gnal at the intersection of Goldenwest
and Palm Avenue.
Analysis:
The City has determined that it's in the public's interest to install
the traffic signal as soon as possible, cherefore, an Agreement is
needed for the sharing of the cost pending the actual construction of
Seacliff Phase IV Project. The cost of the traffic signal is estimated
to be approximately $615,vu0.
Alternative:.
Assume the entire :-ost of the traffic signal.
Funding Source:
The City's share of the cost can be charged to Special Gas Tax Funds.
THIS AGREEMENT, made anc' entered into this Q day of-
1979, by and between the Huntington Beach
Company, a California corporation, hereinafter called "COMPANY"
and the City of Huntington Beach, a municipal corporation of
the State cf California, hereinafter called "CITY"

WHEREAS, the intersection of Goldenwest Street and Palm
Avenue lie within CITY, and
Engineering studies indicate that installation of a traffik,
signal is warranted at the above named intersection for improved
traffic safety and efficiency, and
One of the final conditions of approval for Tentative Tract
Maps 10067, 10065 and 10069 for S eacliff Phase IV project, is the
installation of a traffic signal at the above named intersection.
The coati of such installation shall be evenly divided by COMPANY
and CITY.
f`• x, , THEREFORE, in consideration of the covenants and con-
ditions :herein contained, the parties hereto agree as follows:
1. CITY shall prepare plans and specifications, p^ovide
engineering and contract administration, for the installation of
a traffic system at the intersection of Goldenwest Street and Palm
Avenue,.

2. CITY shaV advertise for bids, purs nt to California
State law.
3. CITY'S Department of Public Works shall supervise the
performance of said work.
4. The co t cf the installation of the traffic signal system
is estimated to be approximately sixty-five thousand dollars
($65,000). The COMPANY shall pay fifty percent (50%) of the actual
costs but not to exceed thirty-five thousand dollars ($35,000). The
CITY steal' .,.y fifty percent (50%) of the actual costs and all
costs beyond COMPANY'S thirty-five thousand dollars ($35,000)
maximum contribution.
5. COMPANY shall pay its proportionate share forthwith upon
the issuance of a building permit for the Seacliff Phase IV project_
6. CITY shall require the contractor who receives the bid
to keep an exact accounting of the expenditures on the traffic
signal project.
7. Upon completion of the installation of the traffic
signal system at the intersection of Goldenwest Street and Palm
Avenue, the maintenance of said system shall be performed by or
under the direction of CITY. The cost of said maintenance shall
be borne by CITY.
IN WITNESS WHEREOF, the parties hereto have executed this
Agreement on the day and year first above written.
