STATEMENT OF ISSUE
The attached preliminary design plan for Huntington Beach Community
Park was prepared by Landscape Architect , Alan 'Ribera and approved
by both the Community Services Commission and the Huntington Beach
Union High School District; also, the city and district wish to
enter into an agreement to jointly design, develop, operate and
maintain the seven acre city and five acre district-owned portions
of the future community park.
RECOMMENDATION
Approve the joint development agreement for Huntington Beach Community
Park with the Huntington Beach Union High School District and also
approve the Schematic master plan of tile park and submit it to
Cardoza-DiLallo for completion of construction drawings and specifi-
cations according to terms of current c-->Ztract.
ANALYSIS
This proposed community park to be jointly designed, developed,
operated and maintained by the city and HBUKSD has been in various
planning stages for several years. As soon as the •seven &-cre city
portion of the twelve acre site has been dedicated by Manaion Proper-
ties, design and development can proceed. Tba district has offered
to maintain the entire twelve acre developed site on a regular basis
except that city and district will each be responsible for their own
util:_tj costs in exchange for Huntington reach High School use of the
community park facilities during days school is in session. The park
is scheduled in the city's carital ;mpY•avement budget to be developed: t
in 1982-83.

JOINT DEVELOPMENT - COMMUNITY PARK AGREEMENT
BETWEEN CITY AND DISTRICT
THIS AGREEMENT, hereinafter called "Jrint Development Community Park
Agreement," made between the CITY OF HUNTINGTON BEACH, a municipal corporation
of the State of California, hereinafter called "CITY," and the HUNTINGTON BEA_ -i
UNION HIGH SCHOOL DISTRICT, a political subdivision of the State of California,
hereinafter called "DISTRICT,"
WITNFS5ETH:
WHEREAS, CITY and DISTRICT are mutually interested in providing adequate

facilities for the recreation of the people of the city of I iuntington Beach; and
CITY and DISTRICT desire to undertake mutual effort to provide the maximum
feasible public use of their respective facilities in the accomplishment of this goal;and
It is recognized that through a cooperative agreement between CITY and

DISTRICT which provides for the joint use of each agency's facilities, the community will
be afforded greatly increased opportunities at costs much below what would otherwise be
necessary; and
The community can benefit not only from the sharing of facilities but also from
mutual cooperation in the planning, dr..velopment and implementation of recreational
facilities; and K
Both CITY and DISTRICT desire to use the aforesaid property from which to
conduct a community park and recreational. program. It is in the best interes'i1 of CITY
and DISTRICT that an agreement be entered into for use of the aforesaid property for
park and recreational purposes as hereinafter set forth.

1.
THEREFORE, CITY and DISTRICT agree as follows:
1. DISTRICT owns five (5) acres (hereinafter called Parcel "A") of a parcel
of land comprising approximately twelve (12) acres (hereinafter called '112 acres") of
triangular shape on the northwest corner of Seventeenth and Main Streets, and CITY owns
the remaining approximate sev-.n (7) acres (hereinafter called Parcel "E") of said twelve
acres. The legal description and map of Parcel "A" and roadwey easement: through Parcel
"A," and Parcel "B" is attached hereto, marked Exhibit "A" and Exhibit "S," respectively,
and by this reference made a part hereof and incorporated herein.
2. That subjeect to conditions hereinafter sot forth, CITY and DIS 'RIC
hereby do agree that said approximate twelve acres shall be used for park and
recreational purposes. Said 12 acres and a legal description for roadway easement
through Huntington Community Park is set forth on the map attached hereto, marked
Exhibit "C," and by this reference made a part hereof.
3. CITY and DISTRICT s!iall, through mutual ^ooperation, design, develop,
operate and maintain the new community park/school athletic field as a joint venture on
said 12 acres.

4. CITY and DISTRICT shall snare the costs of designing, developing, and
operating the community park/school athletic field on a pro-rata oasis detarmined by the
percentage of property that is owned by each agency, closely approximating

seven-twelfths (7/12ths) for CITY and five-twelfths (3/12ths) for DISTRICT. Attached
hereto and incorporated herein is Exhibit D indicating design of park and construction cost
estimate. DISTRICT shall maintain the 12 acre site; however, CITY shall pay 7/12th of
the total costs of the water consumed in operating the community park/school athletic
F field. CITY and DISTRICT shall pay for their respective use of electricity in the lighting
of the community park/school athletic field.
r 5. CITY and 'DISTRICT shall work jointly in the planning of tha programs to
ensure that the community park/school athletic field is utilized in the best interescs of

6. CITY and DISTRICT shall consult with each other and mutually approve
construction and planning of the proposed facilities. CITY and DISTRICT shall mutually
agree to the type and specification of equipment and facilities to be placed o, Raid site.
7. CITY shall have the responsibility for the efficient operation of a
jointly-approved program. The facilities stealk be open on equal terms to all residents of
CITY and DISTRICT. Use of facilities by UiTY and DISTRICT shall be without a fee, and
any operating expenses shall be borne seven-twelfth;, (7/12ths) by CITY and five-twelfths
(5/12ths) by DISTRICT.
8. That neither DISTRICT nor any officer or employee the;rnof shall be
responsible for any damage or liability occurring by reason of anything done or omitted to
be done by CITY under or in connection with any work, authority or jurisdiction delegated
to CITY under this agreement. It is also understood and agreed that, pursuant to
Government Code Section 895.4, CITY shad' fully defend, indemnify and hold DISTRICT
harmless from any liability imposed for injury (as defined by Government Code Section

810.8), occurring by reason of anything done or omitted to be done by CITY under or In
connection with any work, authority or jurisdiction delegated to CITY under this
agreement.
9. That neither CITY nor any officer or employee thereof shall be

be done by DISTRICT under or in connection with any work, authority or jurisdiction
delegated to DISTRICT under this agreement. It is also understood and agreed that,
pursuant to Government Code Section 895A. DISTRICT shall fully defend, indemnify and
hold CITY harmless from any liability imposed for injury (as defined by Government Code
Section 810.8), occurring by reason of anything done or omitted to be done by DISTRICT
under or in connection with any work, authority or jurisdiction delegated to DISTRICT
under this agreement.

10. Each agency shall provide adequate personnel to supervise its activities,
when operating at the other's facilities. Supervisors so assigned must be acceptable to
both agencies. Supervisors, while conducting activities at the other's facilities, shall
r abide by the rules of conduct of the owner agency and shall cooperate with the owner
agency's representative in this regard.
11. This Joint Development - Community Park Agreement shall be for an
indefinite term. However, this agreement may be terminated by either party at any time
and for any reason upon ninety (90) days written notice to the other party at the following
addresses: "CITY", 2000 Main Street, Huntington Beach, California; 'DISTRICT",
(Education Center), 10251 Yorktown Avenue, Hunti, ;ton Beach, California.
12. IN WITNESS WHEREOF; the parties hereto have caused this Agreement to
be executed by their duly authorized officers on theS day of 4
