I NOW# THEREFORE, in consideration of the convenants and agree- ments herein contained, being done and peformed by the parties hereto, it is hereby agreed as follows: I. By my signature hereunder, as Contractor, I certify that I am aware of the provisions of Section 3700 of the Labor Code which require every employer to be insured against liability for workm. n's Compensation or to undertake self-insurance in accordance with the provisions of that code, and I will comply with such provisions before commencing the performance of the work of this contract. 1I. Contractor agrees to receive and accept as full compensa- tion for furnishing all materials and for doing all the work contemplated and embracedin this agreement, the: unit. prices con- tractor submitted in his proposal which was accepted by the City Council. A copy of said proposal is attached hereto and incorporated herein by reference and made a part hereof. Contractor further agrees (.� that said payment by City shall include all payments for all loss or damage arising out of the nature of the work aforesaid, or from the action of the elements, or from any unforeseen difficulties or obstruc- tions which may arise or be encountered in the prosecution or the work until its acceptance by the City, and for all risks of every description connected with the wor}:; also For all expenses incurred by or in consequence of the suspension or discontinuance of work and for well and faithfully co-npleting the work, and the whole thereof, in the manner and according to the plans and specifications, and the require- mentc of the engj veer under the;. The contractor agrees to furnish, prior to the execution of the contract, bonds, covering the faithful performance of this contract and the payment of all obligations arising thereunder in such form and amount as the City may prescribe. !i VII. California Fair Employment Practice Act. The contractor agrees to utilize fair employment practices in accordance with California Labor Code Section 1410 et seq. Hartge, Director of Public Works , f DATE: November 7, 1977 SUBJECT: Natural Gas Service to the Terry Park Recreation Building; CC-301 STATEMENT: The Southern California Gas Company requires that the City enter into a contractual agreement prior to the installation of in extended gas service line to the new Terry Park Recreation Building. RECOMMENDED ACTION: Approve the contract and authorize the Mayor and City Clerk to sign on behalf of the City. ANALYSIS: The Terry Park Recreation Building presently under construction requires the installation of a gas service line. Due to the setback of the building, the length of gas service line required is greater than the Southern California Gas C:,mpany will install at their coat. The additional lengyh of gas service line will be installed at the cost of the park contractor, however, the Southern California Gas Compr.ny's policy requires %hat a contract agreement be entersd into between the owner and the gas company to establish respective responsibilities. The City Council has approved change orders 1, 2, 3 and 8 for $39,272.35 and authorized an increase in the contract~ price accordingly. Approval is needed for change ordercv 4 thru 7.. Recommended Action Approve change orders 4-7 t.otal i.n(i S2215. 75, and authorize this increase in the contract price. Analysis In July, 1977, the six parks contract: was awarded to J. D. Crosby Co., Inc. for the bid price of $1,390.000. Adc'ed to this amount is $41,488.10 for the cost of eight change. orders. The total price to date, therefore, is $1,431,488..10. Four of these change orders have been approved by the City Council.t change orders 1,2,3, for $30,519.35 on FebruAry 6, 1978 and change order No. 8 for $8753 on June 19, 1978. The change orders involved in the recommended action are as follows: Change Order. No. 4 Fire retardant asbestos roof covering was installed under the wood shingle roof of the recreation building at Terry Park as required by the Building Code. The installation of this roof covering was not nhown on the project plans. The total cost of this change is; $925.75. Change Order No. 5 Because of structural requirements, the cvncrete design nix for the footings and walls of the handball courts at Marina Park was i.ncreaned from the 5 sack design infix to 6. This change was requested by the contractor and structural engineer. The total cost of this change is $1080.
