the above reference project. This project was one of three emergency repair projects brought
about from the heavy winter rains of January 1995- To save cost and expedite emergency

Statement of Issue: John S_ Meek Company, Incorporated, has completed the Prince Park
Emergency Bulkhead Repair work; Cash Contract 1021.
Fundinq Source: Unexpended Fiscal Year 1994-95 salary savings. However, the City
anticipates to receive full reimbursement for construction expenditures from the Federal
Emergency Management Agency (FEMA). Preliminary information from the State Office of
Emergency Services indicates that FEMA has approved the funding for the reimbursement.
Recommended Action:
1. Accept the improvements of Cash Contract 1021, Prince Park Emergency Bulkhead
Repair, and authorize the City Clerk to file the Notice of Completion, and
2. Approve the total project cost of $112,134.

On September 18, 1995, Council authorized the Director of Public Works to expend a
maximum of $120,000 for the Prince Park Emergency Bulkead Repair.
Shortly thereafter, two of the requested six marine contractors contacted by staff submitted
bids for the construction repair. Summarized below are the two bids submitted to the City of
Huntington Beach:

Staff is requesting authorization to allocate and expend Unappropriated Undesignated
General Funds for the emergency repair of the Prince Park Bulkhead damaged in last
winter's storms.

Alternative Action(s):
Deny the request and forego the emergency repair of the bulkhead. Direct City staff to
maintain the park as usual and to monitor the bulkhead movement_ However, this action
may allow the bulkhead and park hardscape to undergo further distress and the situation
to worsen, possibly leading to complete bulkhead failure

Analysis:
The channel bulkhead adjacent to Prince Park on Trinidad Island, Huntington Harbor,
moved approximately 4 inches seaward as the result of last winter's storms_ Because of the
storms, the Governor declared a state of emergency. Consequently, the Federal Emergency
Management Agency (FEMA) began to accept storm related damage claims_ City staff
submitted a damage claim for the Prince Park Bulkhead repair, and to date FEMA has yet to
take final action on the claim In the interest of public safety and to avoid a more serious
situation, staff recommends that the City not wait for FEMA funding before proceeding with
emergency repairs. A timely construction repair to the bulkhead is crucial_
City staff hired Moffatt & Nichol Engineers, a focal marine engineering consulting firm, to
design a bulkhead repair based upon the results of an underwater investigation The plans
and specifications are complete, and emergency bids are currently being obtained from
qualified contractors. The consultant estimate for emergency repairs is $120,000
In accordance with HBCMC, section 3 02.190. Exempt and Emergency Procurement and in
the interest of expediting the emergency project, staff is requesting authority to proceed with
the work, pending receipt of bids. A maximum budget of $120,000, allocated from the
General Fund is also requested.
It should be noted that FEMA representatives have given preliminary indications that such
emergency repairs would be considered ineligible for reimbursement if the City elects to
proceed with repair efforts prior to final FEMA action on the damage claim_ The City,
however, has notified FEMA in writing that FEMA delays have left the City with no other
choice. The City has also asked Congressman Rohrabacher to intervene with FEMA on the
City's behalf.
Environmental Status:
The recommended action does not constitute a project" as defined by State CEQA
guideline, California Admin Code §15378, nor as defined by the California Environmental
Quality Act, California Pub Res_ Code §21065 Therefore, the recommended action is not
subject to provisions of CEQA_

As required by Resolution 4832, a Fiscal Impact Statement has been prepared
for the proposed appropriation of $198,449 to provide required funding for three
separate Emergency Storm Repairs, all of which emanated from the January
1995 heavy rains..
Upon approval of the City Council, the balance of the unreserved, undesignated
General Fund including the Economic Contingency Fund would be reduced to
$3,758,000, prior to the anticipated reimbursement from the Federal Emergency
Management Agency (FEMA). .
The above balances will be further reduced by the amount of the Settlement
Claims, Repayment Claims and contingent legal costs related t the Orange
County Bankruptcy. These amounts may excee01,000,000 ' the General
