GARFIELD AVENUE STORM PIRAIN - HUNTINGTON BEACH -FOUNTAIN VALLEY COOPERATIVE PROJECT -
APPROVED - The City Clerk presented a communication from the Director of Public Works
regarding a proposed cooperative project between the City and the City of Fountain
Valley which would resolve a ponding water problem -n a portion of Garfield Avenue,
west of Brookhuist Street.
On notion by Shenkman, second Gibbs, Council approved an estimated expenditure of
$2,500. from Gas Tax Funds for said project as a cooperative effort with the City of
Fountain Valley. The motion was passed by the following loll call vote:
AYES- Fartlett, Pattinson, Gibbs, Siebert, Shenkman, Wieder.
NOES: None
ABSENT: Coen
On motion by_ Pattinsoni, second Wieder the regular meeting of th,2 City
Council of the City of Huntington Beach adjourned at 11:30 P.M.
to� Tuesday, June 6, 1976 at 7:30 r.M._ in the Room B-$, Civic Center .

CONTRACT AGREEMENT
THIS CONTRACT is made and entered into by and between
City* of Huntington Beach
Ci:y of Huntington Reach
hereinafter referred to as the "City" and
Johnston PJAP Cop arr.
Contractor
hereinafter referred to as the "Contractor"
IT IS HEPEBY AGREED BEI'WEEP1 THE PARTIES AS FOLLOWS:
First, Contract Documents - The complete Contract includes all contract
dccuments, to wit: a. 11otice In0 ting Sealed Proposals; b. Instruc-
tions to Bidders; c. Bid Proposal; i. Specifications; e. Plans for
the Existing Pump Station - provid.:d as reference information only;
f. The Contract Agreement; g. Ail modifications incorporated in the
foregoing documents before execution of. the Contract Agreement.
Second, The Work - The Contractor agrees to furnish all tools, labor, materials,
equipment, transportation, services. and supplies necessary to perform
and complete in a good and workmanlike manner the installatio4i of the
third pumping unit: in the Banning Avenue Trump Station. laid work
will be done in conformity with these specifications, the equipment
manufacturer's specifications, and all other Contract Documents which
are on file at the City Engineer's Office, City Hull, City of Huntington
Beach.
Third, Payment - The City agrees to pay and the Contractor agrees to accept
the 'lump stun amount st ted in the =yid Proposal upon completion of the
work. The oregoing shall be accepted by the Contractor as full and
final compensation for all work done under this Contract.
Fourth, Commencement and Completion of the Work - The Contractor agrees to
begin Pnd complete the work within the time specified in the Bid
Proposal.
Fifth, Guarantee - The Contractor agrees to guarantee all work against faulty
workmanship, and all materials and equipment for a period of one year
after completion of this Contract.

Sixth, Insurai.,:e - The Contractor agrees to carry Public Liability Insurance
and Property Damage Insurance in the following amounts:
Public Liability - $100,".00 per person
injured in one accident.
$300,000.00 for more than one
person injured in one accident.
Property Damage - $50,000.00 for one occurrence.
Said insurance will be kept in force for the duration of this Contract.
IN WITNESS WHEREOF, this Contract is e:�vcuted by the duly authorized
agent(s) of the Ci;.y and the Contt�a:tor on the date set before the nine of
each.

Dear Council Members:
Garfield Avenue Storm Drain
H.B. - F.V. Cooperative Project
Due to roadway settlement, a portion of Garfield Avenue west
of Brookhurst St. has been plagued with a ponding water problem,
and has been the target of numerous complaints. Street reconstruc-
tion has been attempted on two occasions, neither of which being
successful. The most viable solution woald be to extend an
existing storm drain to the low point at an estimated cost of
$7,500.
The City of Fountain Valley is currently designing a storm
drain facility to serve properties immediately north of Garfield
Avenue. Its location is such that a lateral connection could be
made to serve the problem area. Estimated cost for the lateral
would be $2,500. Thus a savings of approximately $5,000 will be
realized by going with a coorerate project now as opposed to going
sEparately in the future. Since the problem is directly related
to street drainage, it can be funded through gas tax.
Therefore, it is hereby requested that you approve the ex-
penditurF_ of funds for the above project as a cooperative effort
with the City of Fountain Valley.

Dear Mr. Miller:
On Friday, August 26, 1966 at 5:00 o'clock P.M.; we opened the
bids received for the addition of a third pumping unit in the su "ect
pump station. The results were as follows:
Cascade Pump Company $44,700.00
Johnston Pump Company a44,300.00
It is recommend:d that the City accept Johnston Pump Company's
bid and that we be authorized to transmit a contract to them for
signature.
We anticipate Kaufman and Broad to proceed with their Tract 62.78
in the near future. Said tract will generate approximately $40,000,00
into the subject drainage di.strict fund. This money would immediately
be transferrer to the drainage fund toward payment of this contract.
The remaining $4:300.00 would be repaid when additional developmcnt
occurred in 'District 7C; howevez , there are no immediate pla4:5 of deve).--
opmnet except Tract 627$.

plans and specifications for the Ba.nni ng Avenue Pump Station equip-
ment.
It is further requested that your Honorable Body, pursuant
to Section 1211 (second paragraph, last line) of the City Charter,
deem that an urgent necessity exists and waive the requirement for
advertising. Additionally it is requested that the Mayor and Clerk
be authorized to execute the contract in behalf of the City upon
the recommendation of the Director of Public Works. Bids will be
received, opened and reviewed on August 26, 1966.
