TINGTON BEACH, SEAL BEACH AND WESTMINSTER, all being municipal corporations in the County of Orange, California, hereinafter collectively referred to as "CITIES". I%IIEREAS, CITIES, by virtue of a joint powers agreement are the owners of a fire training facility located at 18701 Gothard Street, Huntington Beach, California; and WHEREAS, the DISTRICT, through Santa Ana College, intends to provide a vocational educational program for the benefit of selected, eligible students of the DISTRICT, under the State plan for Vocational Educational and the Federal Vocational Edu- cational Act, as amended, and through this agreement with the CITIES to provide use of fire academy facilities and equipment in order to prepare such students for the vocation of fireman; I and WHEREAS, the DISTRICT also intends to maintain a constant attendance of no more than thirty-five (35) students per day in this program. The enrollment pattern may consist of any combi- nation of half-time or full-time students with a maximum of eight (8) student hours per day; and WHEREAS, the CITIES represent that, as the owners, a' -equate facilities for fire science instruction can be accommodated in addition to the regular training requirements of the CITIES. ti NOW, THEREFORE, in consideration of the conditions, covenants, terms, agreements, and recitals contained herein, it is mutually agreed as follows: 1. CITIES shall provide a classroom with thirty-five (35) 1 student stations, an office with a telephone,desk, and chair, 2 all utility costs, a drill tower, and one fully -equipped, 3 triple combination pumper for eight (8) hours per day for thirty-five.(35) days during each Academy period. I 5 2. The DISTRICT shall pay to the CITIES On a monthly 6 basis Fifty ($50.00) Dollars per day for each academy day 7 certified to the DISTRICT for use of facilities and equipment 8 during the preceding month at the CITIES' Training Center. 9 3. The CITIES shall submit and certify monthly statements 10 and billings to Santa Ana College, 17th at Bristol, Attention: 11 Dean of Applied Arts and Science, and the end of each month 12 on the forms provided by DISTRICT. 13 4. DISTRICT and CITIES mutually agree to hold harmless 14 ,each other, their officers, agents, and employees from all 15 losses, cost, expense, claims or liability for injury to'any 16 person, or damage to any property arising out of, or in any i 17 manner connected with, the performance and operation of the i 18 terms of this Agreement due to the sole ngeligence of the 1g DISTRICT or CITIES. 20 5. Notwithstanding the actual date of execution by the 21 respective parties, this Agreement shall become effective May 17, 22 1976, provided that all four member CITIES to the referenced 23 .joint Powers Agreement execute this Agreement.. This Agreement 24 shall terminate 19�, unless terminated as 25 provided herein or unless extended by written amendment hereto, 26 executed by the same parties to this Agreement. 27 6. The agreement for rental of Joint Powers Training Center has been approved and ratified by the Cities of Seal Beach, Westrunster and Fountain Valley with Huntington Beach as General Administrator of the Training Center yet to sign. • RECOMMENDATION Recommend approval of the attached rental agreement with revenue to be applied to a revolving account for building facilities maintenance and upkeep and specific expenditures as directed by the Net 6 Fire Chiefs. A special account for this purpose has been established through the Finance Department.
