ANALYSIS: The following in a summary of the contract cost and explanation of additon to contract quantities. Contract Sid Price $291,951.70 Total Contract Price to Date $345,196.40 The addition to contract quantities was a result of a tree removal petitic'n that arrived after the job was bid, and to correct past needs of citizens whose complaints were on record and field reviewed. FUNDING SOURCE: They funding for the project was from four sources in the approved 1986-87 budget. Account 740870 - Street Maintenance funds from Gas Tax funded the local street improvements. Account 510632 - Street Maintenance Capital Outlay funded the arterial parkway fill-ins. Under no condition shall CCUNTRACTOK make any changes without the written order of the DPI, and CITY shall not Fray any extra charges made by CONTRACTOR that have not been agreed upon in writing by the DPW. 5. When directed to change the work, CONTRACTOR shall submit immediately to the DPW a written cost proposal reflecting the effect of the change. INDEMNIr ICATIO!^_DEFE;NSE:, HOLD HARMLESS CONTRACTOR hereby agrees to protect, defend, indemnify and khold and save harmless CITY, its officers, agents and employees against any and all liability, claims, judgments, costs and demands, however caused, including those resulting from death or injury to CONTRACTOR'S employees and damage to property, arising directly or indirectly out of the obligations herein undertaken by CONTRACTOR, or out of the operations conducted by CONTRACTOR, regardless of the active or passive nature of any 12. 0 negligence by CITY, sieve and except those which arise out of the sole negligence or sole willful misconduct of CITY. CONTRACTOR will defend any such suits at the sole cost and expense of CONTRACTOR when requested by CITY, and any costs of defense or attorney's zees incurred by CITY in enforcing this obligation will be reimbursed to CITY or may he awarded to CITY by a court of competent 3urisdiction. 19. Said insurance shall not derogate from the pro- visions for indemnification of CITY by CONTRACTOR under Section 18 of this Agreement. 13. • n CONTRACTOR shall require all subcontractor, to provide such Workers' Compensation Insurance for all of the subcon- tractors' employees. CONTRACTOR shall furnish to CITY a certificate of waiver of subrogaLion under the terms of the Workers' Compensation Insurance and C014TRACTOR shall similarly require all subcontractors to waive subrogation. 20. INSURANCE CONTRACTOR shall carry at all times incident hereto, on all operations to be performed hereunder, bodily injury and property damage liability insurance policies including automotive bodily injury damage liability insurance, under -written by insurance companies in form:, satisfactory to CITY for all operations, subcontract work, contractu.il obligations, pruduct or completed operations and all owned vehicles and non -owned vehicles. Said insurance: policies shall name the CITY, its officers, agents ana e;nraloyees an(i all public agencies as determined by the CIT: as Additional In:surt?ds. CONTRACTOR shall subscribe for and maintain saiu in-surance policies in full force and effect during the life of this Agreement, in an amount of not leas than One -Million Dollars ($1,000,0000) combined single limit coverage. CONTRACTOR shill require its insurer to waive its subrogation rights against CITY and agrees to provide certifi.-ates evidencing the same. Before CONTRACTOR performs any work at, or prepares or delivers materials to the site of construction, CONTRACTOR shall furnish to CITY certificates of insurance subject to approval of the City Attorney evidencing the foregoing insurance coverages; 1.4. 11 said certificateri shall provide the name and policy number of each carrier and policy, and shall state that the policy is currently in force and will not be cancelled without thirty (30) days written notice to CITY. CONTRACTOR shall maintain the foregoing insurance coverages in force until the work under this Agreement is fully completed and accepted by CITY. The requirement for carrying the foregoing insurance shall not derogate from the provisions for indemnification of CITY by CONTRACTOR under Section 18 of this Agreement. CITY or its representative shall at all times have the right to demand the original or a copy of all said f>ol•.c:ies of insurance. CONTRACTOR shall pay, in a prompt ana tirr,ely manner, the premiums on all insurance hereinabove• required. 21. DEFAUL AND TERMINATION If CONTRACTOR fails or refuses to prosecute: the work hereunder wit-h diligence, or fails to co;;plete the word: within the time specified, or i:� ad judge--d it bankruF_,t or makeo, an assignment for the benefit ut creditors or becomes insolvent, or violates any provision of this here►'ment or the Contract Documents, CITY may give notice in writing of its intention to terminate this Agree- ment. Unless the vioiation is cured within ten (10) days after such Notice of Intention i,as been served on CONTRACTOR, CITY may, without prejudice to any other remedy it may have, terminate this Agreement upon the expiration of that time. Upon such default by CONTRACTOR? CITY may elect not to terminate this Agreement; in such event CITY may make good the deficiency in which the default 15. consists and deduct the resulting costs from the progress payments than or to become due to CONTRACTOR. 22. DISPOSITION OF PLANS, ESTIMATES AND OTHER DOCUMENTS CONTRACTOR agrees that upon completion of the work to be performed hereunder, or upon earlier termination of this Agree - vent, all original plans, specifications, drawings, reports, calculations, mays and other documents pertaining to this Agree- ment shall be delivered to CITY anti become its sole property at no further cost. 23. [x] Yes [ ) New Policy or Exception (MSC-263) Statement of Issue, Recommendation, Analysis, Fundinq Source, Alternative Actions, Attachments: STATEMENT OF ISSUE: Plans and Specifications and 14otice Inviting Sealed Bids have been prepared for the reconstructions and improvements of various local streets, arterial highways, Central Park trails and public facility sites in pursuance of maintenance programs. REC CMMENDA TION : Approve the Plans and Specifications and autho►:ize the City Clerk to advertise for bids. ANALYSIS: The subject contract will provide for improvement of asphalt and concrete facilities in several areas of the City, and is miscellaneous in nature by combining several type projects. Total parkway tree removals and street facility repairs will occur in response to petitions, on Encino, Alta Vista, Sailfish, Lister, Carolyn, Katherine, and Garfield. Selected tree removals and curb/gutter repairs will occur on Dundalk and Wicklow, also petitioned for removals however lacking in the 75% percentage required by Council Policy to warrant total removals. Parkways along McFadden, Edinger, and Heil will be excavated and filled in with concrete sidewalk in response to citizen requests; and depending on the bids, others may be added to maximize use of the funding allocation. The Central Park trails, lying west of Golden Hest, are to be capped with an asphalt concrete overlay for safety of the various types of users. Filially, two fire stations sites, Murdy and Magnolia, are to have asphalt driveway areas removed and replaced by reinforced concrete. The estimate for the project is $301,000.00. FUNDING SOURICE: The funding for the project will be from four sources in the approved 1986-87 budget. Account 740870 - Street Maintenance funds from Gas Tax will fund the local street improvements.
