Statement of Issue, Funding Source, Reconwnended Action, Alternative Action(s), Analysis. Environmental Status. Attachnwnt(
Statement of Issue: Under the terms of the 1997 Disposition and Development Agreement
for Plaza Afteria (Third Block West), the Agency owes $28,329.80 to JT Development for
environmental remediation costs. This payment will be reimbursed (either partially or in full)
once the State of California pays JT Development on the reimbursement claim.

Recommended Action; Motion to:
1. Approve and authorize execution of the attached Reimbursement Agreement and
Assignment of Claim between the Redevelopment Agency and J.T. Development by the
Chairman and Agency Clerk.
2. Approve an amendment to the current fiscal year budget in the amount of t28, 329.80
3. Authorize the payment of $28,329.60 to J.T. Development Company, LLC, per the terms
of the approved Agreement.

REQUEST FOR REDEVELOPMENT AGENCY ACTION

Analysis:
A portion of the site known as "Third Block West7 was acquired from Koller-Gaurano, with the
Kolle r-G aura no's being required to expend funds held back from the acquisition escrow on
the remediation of their former property. This remediation work was commenced by
GeoRemediation under contract with the Koller-Gaurano's, with reimbursements being made
by the State of California Underground Tank Fund. At the point where the funds held back
from escrow were exhausted, the Koller-Guara no's stopped funding the remediation work,
notwithstanding the prospect of additional State reimbursement.
J.T. Development was ready to start construction of Plaza Almeria, however, remediation
needed to be completed. Section 213(8) of the 1997 DDA with J.T. Development required
the Redevelopment Agency to remediate the environmental contamination on the site prior to
conveyance to J.T. Development. The Agencys contractual obligations to J.T. Development
stood alone from the Koller-Ga ura no's obligations to the Agency to remediate the site. In
order not to delay the start of construction, J.T. Development advanced the costs of
remediation in anticipation of filing a tank fund claim with the State of California Underground
Tank Fund, reserving the fight to have the Agency reimburse J.T. Development if a
reimbursement from the State Tank Fund was not made in a timely manner.
J.T. Development requested reimbursement in February of 1998. On the advice of
GeoRemediation, the Agency asked J.T. Development to wait for what staff was told was the
pending outcome of the Koller-Gaurano's claim with the State. Later it was discovered that
the Koller-Gaurano's attorney had not filed a claim on behalf of J.T. Development as
previously agreed. Further, it was learned that the previous owners were not interested in
appealing a partial denial of their claim made by the State, which in the opinion of
GeoRemediation, was a potential detriment to J.T. Development's proposed claim.
After several months of delay and discussions with all parties involved, the tank fund claim
will be filed by J.T. Development. In the interim, J.T. Development has requested payment
from the Agency while the final claim is being prepared and processed for submittal to the
State. When the State approves the claim and payment is made, the Agency will be
reimbursed for the funds advanced.

BETWEEN THE REDEVELOPMENT AGENCY OF THE CITY OF HUNTINGTON
BEACH AND J.T. DEVELOPMENT COMPANY FOR COSTS INCURRED FOR
ENVIRONMENTAL REMEDIATION
This Agreement is made and entered into this 10day of
1998, by and
between the Redevelopment Agency of the City of Huntington Beach, a public body of the State
of California (hereinafter "the Agency) and J.T. Development Company, LLC, a California
limited liability company (hereinafter "the Developee).
WHEREAS, the Agency and the Developer are parties to that certain Disposition and
Development Agreement dated December 16, 1993 (hereinafter "the Original Agrecment") for
the redevelopment of the Third Block West area in doNNmtown Huntington Beach; and
Section 213(8) of the Original Agreement required that the Agency rcmediate the
environmental contamination on the site prior to the conveyance of the site to the Developer; and
In order to facilitate the environmental remediation, the Developer advanced the sum of
Twenty-cight Thousand Three Hundred Twenty-nine and 80/100 Dollars ($28,329.80)
(hereinafter "the Advanced Payment") to the environmental consulting firm of GeoRcmcdiation,
Inc.; and
The Developer intends to submit an application to the California State Underground
Storage Tank Fund for reimbursement of the Advanced Payment (hereinafter "the Tank Fund
Claim"); and
The Agency wishes to reimburse said sum to the Developer, and the Developer wishes to
assign its Tank Fund claim to the Agency,
NOW, THEREFORE, in consideration of the promises and agreements hereinafter made
and exchanged, the parties agree as follows:

and exchanged, the parties agree as follows:
1. PAYMENT. The Agency agrees to pay the Developer the sum of Twcnty-eight
Thousand Three Hundred Twenty-nine and 80/100 Dollars (S28,329-80) within ten (10) days
from the adoption of this Agreement.
2. ASSIGNMENT OF TANK FUND CLAIM. In return for the payment referenced in
Section I hereof, the Developer hereby assigns all its right, title and interest in and to the Tank
Fund Claim, and any proceeds therefrom, to the Agency. A copy of the Tank Fund Claim is
attached hereto as Exhibit "A."
3. TIME OF ESSENCE. Time is of the essence in this Agreement. The Developer
shall cause the Tank Fund Claim to be submitted as soon as practicable.
4. EFFECT ON HEIRS AND SUCCESSORS. This Agreement and each of its
provisions shall be binding on and shall inure to the benefit of the respective heirs, devisees,
legatees, executors, administrators, trustees, successors and assigns of the parties hereto.
5. AMENDMENTS TO AGREEMENT. This Agreement may be amended only by a
writing signed by the party against whom or against whose successors and assigns enforcement
of the change is sought.
6. EFFECT or PARTIAL INVALIDITY. If any term, provision, or application of
this Assignment is held invalid or unenforceable, the remainder of this Agreement and any
application of the terms and provisions shall not be affected thereby, but shall remain valid and
enforceable.
7. GOVERINING LANV. This Agreement shall be governed by the laws of the State of
California.

1.0 LNTRODUCTION
This report presents a summary of quarterly ground water quality monitoring and remediation
performed at 301 Main Street, Huntington Beach, California 92647 (see Figure 1, Site Location
Map). This report also makes recommendations for furth&r action to be conducted at the subject
site.
2.0 QUARTERLY GROUND WATER MONITORPiG
On December 16, 1996, GeoRemediation, Inc. (GRI) personnel performed quarterly ground water
quality monitoring at the subject site. All of the ground water monitoring wells were surveyed,
developed, and sampled. Groundwater well locations are shown onFigurc 2, Site Detail Map. The
following sections detail this activity.

In order to determine ground water elevation and the local ground water gradient, GRI surveyed
the ground water wells for depth to ground water. The results of the survey are summarized
below in Table A.

The elevation datum from well MW-2 appears aberrant due to the high differential from wells
MW- I and MW-3 and also based upon the historical ground water elevation data. Ground water
flow beneath the site is generally southeasterly. .
2.2 Well purging
Following the ground water well survey, all of the on -site and off -site wells were purged. During
well purging, approximately three casing volumes of ground water was bailed from each well
using a 3.5-inch O.D. Teflon bailer. Prior to purging each well, the bailer was decontaminated
by washing with an Alconox solution then double rinsing with tap water followed by a final rinse
with distill6d water in order to reduce the possib. ility of cross contamination. The purged ground
water and decontamination water was contained in labeled, 55-gallon drums which will be
stored at the site pending review of the analytical data to determine proper disposal.

During well purging, the parameters of temperature electroconductivity and pH were measured
after the removal of 0.0, 1.5, 2.0, 2.5, and 3.0 casing volumes of ground waier. Betwe6n the
removal of 2.5 and 3.0 casing volumes of ground water, these parameters were evaluated to
determine if equilibrium of the ground water had been established. It variations between these
two sets of reading were less than 1.0 degree Centigrade (1.8 degree Fahrenheit) for the
temperature, +/- 10% for electroconductivity, and 0.2 pH unit, the ground water well was
considered to be equilibrated. If these parameters were not met, an additional 0.5 casing volume
of ground water was removed and the evaluation repeated. The measurements of these three
parameters are summarized below in Table B.

the same manner as described previously in section 2.2. Ground water samples collected from
each well were carefully filled into two, 40 ml glass vials leaving no head space. The sample
vials were then labeled, placed in a cooler with "Blue Ice". 'At the end of the day the collected
samples were transported under strict Chain -of -Custody protocol to Del Mar Analytical (Del
Mar) in Irvine, California for analyses. Details of the laboratory analyses program are presented
below in section 2.4.
2.4 Laboratory Analyses
All of the collected ground water samples were analyzed for Volatile Fuel Hydrocarbons (VFH)
and Benzene, Toluene, Ethylbenzene, and Xylenes (BTEX) using California DHS Modified,
EPA Method 8015/8020. Photocopies of the official laboratory reports, along with the Chain-
of-Custody/Analyses Request forms, are presented as Appendix A of this report. The results of
the laboratory analyses are summarized below in Table C.

GFJ began operation of tthe soil vapor extraction/thermal oxidation and air sparging system on
December 12, 1996 Soil vapor is being extracted from vapor extraction wells VE-1, VE-2, VE-3,
VE-4, VE-5, VE-6, and VE-7 and air is being injected into sparge wells S-1, S-2, and S-3 Vapor
extraction and air sparge wells are shown of Figure 2, Site Detail Map The average influent
concentration of Volatile Organic Compounds (VOCs) measured during system pilot testing was
1768 Parts Per Million (PPM) The initial influent VOC concentration measured at system start-up
was 1300 PPM The influent VOC concentration increased to 1430 PPM then gradually decreased
to a low of 200 PPM
GRI performed a survey of the individual vapor extraction wells and adjusted the valving of the
vapor extraction and air sparge wells in order to concentrate remediation on the zone with the
highest concentrations of contamination This resulted in extracting soil vapor from vapor
extraction wells VE-1, VE-5, and VE-7 and injecting air into air sparge wells S-1 and S-3

Fuel usage� by the thermal oxidizer resulted in brief periods of system down time to refill the propane
taAk WhA provides the supplemental fuel. Cyclic operation of soil vapor extraction systems is a
normal operational pr ocedure performed normally towards the end of a soil vapor extraction project
'Aen an asymptotic reduction in the influent VOC concentration versus time is demonstrate'd. The
purpose of cycling the operation of a soil vapor extraction system is to let the soil zone return to
equilibrium wMe the system is off-line and then restart the system to determine if any residual
contaminated soil vapor has reentered thesoil zone. This cyclic operation is normally performed for
periods of one to three months with the onloff cyclemaying between one to two weeks.
The brief periods of system down time to refill the propane tank resulted in cyclic ope'ration,
although for accelerated time intervals, of the soil vapor extraction. Cyclic operation of the system
caused spikes in the influent VOC concentration when the system NNas brought back on-line. These
spikes in influent VOC concentration can be seen on a graph of the influent VOC concentration
versus time which is presented as Appendix B of this report. For the purpose of showing a
continuous line, the influent VOC concentrations have been interpolated during periods of down
time. The graph illustrates the spikes caused by cyclic operation of the system and clearly sbo%vs the

reduction in soil vapor concentrations removed by the soil vapor extraction/thermal oxidation
treatment system.
Influent VOC concentrations have dropped to a level where replacing the thermal oxidizer with
activated carbon will. provide for more economical treatment of the extracted soil vapor. GRI will
operate the thennal oxidizer through the end of January in order to insure that the influent VOC
concentrations remain low enough for economical operation utilizing activated carbon. At that time

GRI will evaluate the data and make a recommendation for either continued use of the soil vapor
extraction/thermal ox1dation system or for the replacement of the thermal oxidation system with
activated carbon.

4.0 CONCLUSIONS AND RECOMMENDATIONS
Operation of the soil vapor extraction/thermal oxidizer and air sparging treatment system has
resulted in a significant reduction in soil vapor Volatile Organic Compound concentrations. Influent
VOC concentrations have been reduced to a point where operation of the thermal oxidizer is no
longer economically efficient and the system has been taken off-line. Although the influent VOC
concentrations have been reduced, additional soil vapor extraction using activated carbon treatment
may be necessary in order to effectively and efficiently mitigate the remaining subsurface soil
contamination to a level where closure of the site as an environmental concern can be accomplished.
Ile site has been designated as a "Low Risksite'by the Santa Ana Regional Water Quality Control
Board (SARWQCB) from the standpoint of ground water contamination and the current site
conditions may now meet the City of Huntington Beach Fire Department (HBFD) Screening Level
for Hydrocarbon Clean-up.
Before the installation of a soil vapor extraction/ activated carbon treatment system, GRI proposes
that soil samples be collected to detennine the current contaminant concentrations in the subsurface
soil. GRI recommends that one soil, boring be excavated in the zone where the highest
concentrations of subsurfacc contamination were detected during previous site characterization to a
depth of 30 feet below current grade (bcg). Soil samples should be collected at five foot intervals
beginning at five feet bcg and analyzed at a State of California certified environmental laboratory
using California DHS Modified EPA Method 8015 for Volatile Fuel Hydrocarbons (VFH) and EPA
Method 8020 for Benzene, ToWine, Ethylbenzerie and Xyl�nes (BTEX). Data collected from the
soil sample analyses will then be reviewed and GRI "I consult with the HBFD and SARWQCB in
order to determine if additional mitigation of soil contaminatfoin is warranted.

This report presents a summary of soil verification sampling and quarterly ground %%mter quality
monitoring at 301 Main Street, Huntington Beach, California 92647 (see Figure 1, Site Location
h1ap). This report also makes a recommendation for closure of the subject site as an
environmental issue.
2.0 SbEL VERMCATION SANIPLr(G
In order to evaluate the effectiveness of subsuriNce soil remediation performed at the site using

soil vapor extraction, on March 19, 1997, GRI excavated a preliminary soil verification hand

strict chain -of -custody protocol. Selected soil samples were analyzed by California DHS
Modified EPA Method 8015/8020 for Volatile Fuel Hydrocarbons (VFH) with Benzene,
Toluene, Ethylbenzene, and Xylene (BTEX) Distinction. The results of the soil sample analyses
are summarized below in Table A.

Results of the soil verification sampling indicate that subsurface soil contamination has been
removed via the treatment system. The residual concentrations of VFH with low concentrations
of BTEX is indicative of natural or intrinsic bioremediation that has likely occurred at the site
during the length of time that the hydrocarbon contamination has been in the subsurface soils.
The last know use of hydrocarbons at the site was in the early 1970's
Verification soil samples from boring VB-1 were collected from the subsurface soil zone which
had previously been determined to contain high concentrations of contamination. Results of site
characterization activity performed by McLaren/Hart in April, 1994, showed �oncentrations of
VFH ranging from 1,200 to 29,000 ppm in soil samples collected from borings CPT-3 @ 20 feet

bc& and MW-2 @15 feet bcg respectively. Figure 3 shows the locations of the site
characterization sampling performed by McLaren/Hart, Groundwater Technologies, and GRL
It is GRI's opinion that the results of the preliminary soil verification samples are representative
of the s�bsurface soil concentrations. However, due to the high concentrations reported during
previous site characterization and the volume of the former soil contamination plume, GRI
recommends that additional soil verification samples be collected. The additional verification
sampling will more thoroughly investigate the previously defined soil contamination plume and
insure that high concentrations of residual soil contamination are not present in the subsurface.
Additional soil verification sampling may also be required by the City of Huntington Beach Fire
Department (HBFD). The I�BFD has an established screening level for hydrocarbon impacted
soils and may require additional data prior to development of the subject site. The proposed s6il
verification sample borings are shown on Figure 3.
3.0 QUARTERLY GROUND NVATER MONITORMG .
On May 15, 1997, GeoRemediation, Inc. (GRI) personnel performed quarterly ground water
quality monitoring at the subject site. All of the ground -,vatcr monitoring wells were surveyed,
devclop�d, and sampled. Ground water well locations are shown on Figure 2, Site Detail Map.
The following sections detail this activity.

3.01 Ground Water Survey
In order to deterrnine ground water elevation and the local ground water gradient, GRI surveyed
the ground water wells for depth to ground water. The results of the survey are summarized
below in Table B.

Based on the results of the ground water well survey, the direction of &round water flow beneath
the site is to the southeast.
3.02 Well purging
Following the ground water well survey, all of the on -site and off -site wells were purged. During
well purging, approximately three casing volumes of ground water were bailed from each well
using a 3.5-inch O.D. Teflon bailer. Prior to purging each well, the bailer was decontaminated
by washing with an Alconox solution then double rinsing with tap water followed by a flnal rinse
with distilled water in order to reduce the possibility of cross contamination. The purged ground
water and decontamination water was contained in labeled, 55-gallon drums which will be
stored at the site pending review of the analytical data to determine proper disposal.
During well purging, the parameters of temperature electroconductivity and pH were measured
after the removal of 0.0, 1.5, 2.0, 2.5, and 3.0 casing volumes of ground water. Between the
removal of 2.5 and 3.0 casing volumes of ground water, these parameters were evaluated to
determine if equilibrium of the ground water had been established. If variations between these
two sets of reading were less than 1.0 degree Centigrade (1.8 degree Fahrenheit) for the
temperature, +/- 10% for electroconductivity, and 0.2 pH unit, the ground water well was

considered to be equilibrated. If these parameters were not met, an additional 0.5 casing volume
of ground water was removed and the evaluation repeated. The measurements of these three
parameters are summarized below in Table C.

3.03 Ground Water Sample Collection
Following ground water well purging and after the wells recharged to approximately 80 percent
of their static conditions, ground water samples were collected from each well using a
decontaminated, 3.5-inch O.D. Teflon bailer. Decontamination of the bailer was performed in
the same manner as described previously in section 3.02. Ground water samples collected from
each well were carefully filled into two, 40 ml glass vials leaving no head space. The sample

vials were then labeled, placed in a cooler with "Blue Ice". At the end of the day the collected
samples were transported under strict Chain-of�Custody protocol to Orange Coast Analytical,
Inc. (Oran'ge Coast) in Tustin, California for analyses. Details of the laboratory analyses
program are presented below in Section 3.04.
3.04 Laboratory Anslyscs
All of the collected ground water samples were analyzed for Volatile Fuel Hydrocarbons (VEH)
and Benzene, Toluene, Ethylb=ene, and Xylenes (13TEX) and Mcthyl tert Butyl Ether (MtBE)
using California DHS Modified, EPA Method 801518020. Photocopies of the official laboratory.
reports, along with the Chain-of-Custody/Analyses Request forms, are presented as Appendix A
of this report. The results of the laboratory analyses are summarized below in Table D.

4.0 SUMMARY OF REMEDL4,TION
GRI performed remediation of the subsurface soil and ground water contamination via soil vapor
extraction/thermal oxidation and air sparging. The treatment system was operaied from
December 12, 1996, to February 5, 1997. Details of the operation of the treathient system were
presented in the Quarterly Ground Water Quality Monitoring Report dated February 18, 1997. As
previously reported, the influent soil vapor stream Volatile Organic Compound (VOC)
concentration were reduced from 1430 PPM to a low of 200 PPM. GRI proposed that soil
verification samples be collected and analyzed in order to determine the effectiveness of the
remediation and to determine if additional remediation would be required.
5.0 CONCLUSIONS AND RECOMMENDATIONS
Operation of the soil vapor extraction/thermal oxidizer and air sparging treatment system has
resulted in a significant reduction in soil vapor VOC concentrations. Results of the soil

verification sampling indicate that subsurface soil contamination has been removed via the
treatment system. Verificaiion soil samples were collected from the zone which had high
concentrations of co"ntamination during site characterization performed by McLaren/Hart in
April, 1994.
Due to the previous site characterization soil sample results, GRI recommends that additional
soil verification samples be collected to more thoroughly investigate the previously defined soil
contamination plume and insure that high concentrations of residual soil contamination are not
present in the subsurface. The proposed soil verification sample borings are shown on Figure 3.
The'site has been designated as a "LoNV4. Risk Site" by the Santa Ana Regional Water Quality
Control Board (SARWQCB). Recent -ground A-ater sample results indicate that there are no
detectable concentrations of Benzene in any of the groundwater monitoring wells. As shown in
Table D, ground water monitoring wells MW-I and MW-3 have historically been free of
detectable concentrations of contamination, while the concentrations in well MW-2 have
reduced from 22,000 ppb VFH and 530 ppb Benzene in November, 1995, to nondetectable
concentrations in May, 1997. A slight concentration of VFH vms reported in well MW-1 during
the -Most recent sarn
Ang, however, this result appears to be aberrant. GRI believes the existing
data show there has been a sufficient period of time with ground water contaminate
concentraiiions below the SARWQCB target level for "Low Risk" sites and that no further
quarterly ground water sampling should be required.
In addition to the SARWQCB standards for closure of the site as an environmental issue, The

City of Huntington Beach Fire Department (HBFD) has an established screening level for
hydrocarbon remediation. GRI recomme , nds that the results of recent soil verification sampling
be submitted to the HBFD for their review. Results of additional soil verification soil samoling

Subject: Final closure summary of environmental activity at the Third Block West Project
located at 301 Main Street, Huntington Beach, California.
Gentlemen:
The purpose of this document is to summarize final closure activity performed by
GeoRemediation, Inc. (GRI) at the.Third Block West project located at 301 Main �trcct,
Huntington Beach, California (see Figure 1, Site Location Map). Based on the reView of
previously submitted documents, the Huntington Beach Fire Department, Petrochemical Section,
issued a letter, dated July 16, 1997, stating that the site meets the City's cleanup criteria as
outlined in the City of Huntington Beach's Soil Cleanup Standard, City Specification 431-92,
and that the Fire Department approves the reports submitted by GRI and will support property
development permit releases. The Santa Ana Regional Water Quality Control.'Board
4. 1.
(SARWQCB) has stated that no further action wift be required with respect to peiroleurn
hydrocarbon contamination at the site. Final closure is conditional upon the proper
abandonment of the ground water monitoring wells, soil vapor wells, -and air sparge wells and
removal of all wastes from the site.
GRI performed abandonment of the ground Nvater, soil vapor, and air sparge wells on July 29,
1997, and removed the drummed soil and ground water generated during mitigation from the site
on August 13, 1997. Well abandonment permits and waste manifests are presented as Appendix
A. This completes the environmental activity needed at the site. The SARWQCB should issue a
letter of No Further Action pending the receipt and review of this summary.

1.0 P41RODUCTION
This report presents a surnmary of additional soil verification sampling activities
recommended in the above referenced report at 301 Main Street, Huntington
Beach, California 92647 (see Figure 1, Site Location Map). A brief outline of
issues remaining to be addressed at the subject site is also included.
2.0 SOI1L VERWICATION SAMPLING
The results of the first soil verificaflon boring showed that some residualpetroleurn
hydrocarbon contamination still exisited in the soils beneath the subject site. The
investigated area is shown on Figure 2 as VB-1. Marginal concentrations of Total
Petroleum Hydrocarbon (TPH), Toluene M, Ethyl Benzene (E), and Xylenes
were detected. Benzene (B) was not detected in any sample. The purpose of this
investigation was to determine if the remaining concentrations extend a significant
distance north and west onto the subject site.
On June 17, 1997, VD-2 was excavated west of VB-1 and VB-3 was iiexcavated
north of VB-1 (see Figure 2). 'Both borings were to be excavated to 30'below

current grade (beg) but significant caving was found in VB-3 and the boring was
terminated at PSI b.cg after sampling at that point. The sarnple submitted to the
laboratory was errantly label 3D feet. The appended boring logs describe the soils
found during these excavation. Soil samples were collected at five foot intervals,
sealed, and placed in a cooler with Blue Ice. The samples were submitted to
Orange Coast Analytical in Tustin, California for analysis by EPA Method
8015m/8020 for the determination of Volatile Fuel Hydrocarbons With BTEX
Distiction. None of the stated analytes were found in concentrations higher than
the Detection Limit. Copies of the laboratory report and chain -of -custody are
attached.
3.0 ACTMMS REQUIRED FOR rROJECT COINIPLETION
It is anticipated that the above results will be sufficient to satify the requirement of
the Regional Water Quality Control Board and the City of Huntington Beach Fire
Department. Once acknowledgement of the closure of the site from these agencies
is received, final activities can be initiated. Two procedures will to be
implemented: Abandonment of all Vapor and Water Wells; and Disposal of all Soil
Cuttings, Well Development Water and Process Condensate from the site.
4.0 LZIRTATIONS
This investigation was conducted and this report prepared using a degree of care
and skill ordinarily exercised, under similar circumstances, by reputable Soils
Engineers, Geologists, and Environmental Scientists practicing in this or eunilar
