AGREEMENTFOR
GEOLOGIC AND SEISMIC SAFETY STUDY
THIS AGREEMENT, made on the Az _day of
1973 b and between the CITY OF HUNTINGTON BEACH, a municipal oration

(hereinafter referred to as CITY), and LRIGI-ITON-YEN $ ASSOCIATES, a
California Corporation (hereinafter referred to as CONSULTANT):
W I T N E S S E T H:
WHEREAS, CITY has determined that the public interest requires
a geologic and seismic safety study upon which to buse the City's General
Plan; and
WHEREAS, CITY has determined the public interest requires the
land use, conservation, open space, and seismic sa:-ety elements (among
other) of the General Plan be firmly, based on soun(I geologic, soils, and
seismic data analyses; and
WHEREAS, CONSULTANT is qualified to undertake and complete such
analyses and is willing to undertake the same;
NOW, THEREFORE, the CITY and CONSULTANT in consideration of the
mutual convenants and agreements hereinafter contained, do hereby agree,
each with the other, as follows:-
I. OBJECTIVES
The objectives of the study shall hereinafter be described
as four principal areas of resoarch concentration., including the identifi-
cation and analyses of

1. The distribution and character of local geologic, soils,
and seismic conditions, including the structure of local geologic formations,
the location and character of recent and active faults, and surficial con-
ditions such as landslide areas, areas susceptible to erosion, and areas
containing expansive/collapsible soils.
2. The area's relative susceptibility to seismic hazards due
to the proximity of recent and active faults, the likelihood of major
-earthquakes, and the probable maximum magnitude of such act-1
3. The relative susceptibility of specific -localized areas
to seismic hazards, including their potential susceptibility to surface
ruptures from faulting, to ground shaking, and to soil liquefaction.
4. fine distribution, and character of local geologic, sills,
and seismic conditions in relation to the development and/or use of land
throughout the community. Specific criteria shall be developed by which
to assess and regulate the type, design and location of buildings and
land uses within various geo-physical areas of the City.
II. SCOPE: OF STUDY
The work to be done by CONSULTANT in this study is set out
in Exhibit "A", attached hereto and by this reference made a part hereof.
III. STUDY AREA
The study area will be defined as all lands lying within
the corporate Limits of the City, and the portion of County lands known
as Bolsa Chica Lagoon. The study area is shown on the attached maps, Fig. 1.
IV. CONSULTANT agrees to c�.nmence work on the project within ten
(10)days following the execution of this Agreement, and to diligently
continue the same to completion. All work to be done by CONSULTANT under
this agreement shall be completed within a. period of .four months following

execution unless mutually agreed changes are made.
CONSULTANT further agrees to provide twenty(20) copies of
a non -technic s °summary report, five (9) copies of a technical report,
containing all findings, analyses, and recommendations (both in written
and graphic form) of the work as outlined by Exhibit "A"`- Scope of Study,
and reproducible masters for both reports.
CONSULTANT further agrees to provide oral public presentations
on said report to CITY'S Planning Commission and City Council at such timks
and in such number's as CITY'S representative deems appropriate. Said
oral presentations shall not exceed a total of three �3) in number. CITY
agrees to notify consultant of the time and place of said oral presentations
at least ten (10) days prior to the date on which the ,presentations are to
take place.
Beyond these oral public presentations, CONSULTANT will meet
regularly with authorized representatives of the Planning Department staff
in order to facilitate coordination and to dutifully carry out the study

V. BILLING AND PAYMENT
For furnishing the services specified under Exhibit "A" of
this Agreement, CITY agrees to pay CONSULTANT the sum of Seven 'Thousand

Five Hundred Dollars ($7,500.00). partial payments for work performed
under this Agreement shall be made on a calendar month basis and at monthly
intervals during the progress of this work. Each partial payment shall be
made within ten (10) days after presentation to the City of a statement
setting forth in detail the work performed and all costs incurred by
CONSULTANT, together :with supporting vouchers for the period covered by

each said statement, up to and including the total sum of Four Thousand -
Dollars
Dollars ($4,000.00). The balance of Three Thousand Five Hundred/($3,500,)0)
shall be paid to CONSULTANT within thirty (30) days of submission and st - factory
completion of the final report.
The totalamount of Seven ThousandFiveHundred Dollars
($7,500.00) shall include all costs incurred by CONSULTANT for salary
and out-of-pocket costs for travel and miscellaneous expenses necessary
to perform the Scope of Services specified under Exhibit "A" of this
agreement.
Any specific additional assignments, salary expenses,
authorized travel and appearances not provided for in the scope of services
set forth.under Exhibit "A" must be approved by CITY; payment for said
approved and designated additional Mork and 1 imbursable expenses shall
tie made on a calendar month basis at monthly intervals, on the basis of
the Professional Staff Fee Schedule, July 1, 1972, marked Exhibit "B"
and attached hereto and by reference made a part hereof, and each payment
shall be made within ten (10) days after presentation to CITY of a statement
setting forth in detail the additional work performed and all costs incurred
by CONSULTANT, together with supporting vouchers, for the period covered
by each said statement.
VI. DESIGNATION OF AUTHORIZED REPRESENTATIVES
CONSULTANT hereby agrees, upon the signing of this Agreement,,
to furnish the City in writing the name of an individual who will be
authorized to act in person or through his designee for CONSULTANT in all
matters pertaining to the study. Such individual shall be approved by
the CITY'S Planning Director:

CITY agrees, upon signing of this Agreement, to furnish
CONSULTANT the name of an individual who, as the CITY'S Project P asen-
tative, will be authorized to act in person or through his designee as
representative for the CITY in all matters pertaining to this study.
It is aderstood and agreed by said parties that the
authorized representatives may be changed, provided either party to this
Agreement so desiring the change give at least five (5) days' prior notice
in writing to the other, naming its new authorized representative, and
th4t CONSULTANT'`s said representative shall be acceptable to the CITY.'
VII. COOPERATION
All departments of the CITY will assist CONSULTANT in the
performance of this study, and CONSULTANT agrees to provide general guidance
and direction to CITY personnel that are to assist CONSULTANT in the collec-
tion of data and the preparation of said reports. CITY shall provide
letters of introduction of CONSULTANT to such other persons, firms, or
governmental entities as necessary to assist CONSULTANT in obtaining
required data.
The use of CITY records and personnel by CONSULTANT shall
be coordinated through the CITY's representative.
VIII. OWNERSHIP OF REPORTS AND DATA
All reports, exhibits,., data, and other work or materials
prepared in compliance with this Agreement shall be and remain the property
of the CITY, to be used by CITY as may be required.
IX.' CHANGES IN WORK
CITY may, at any time, by written request of the CITY's Project
Representative, make any minor changes in the services to be provided

hereunder and act an additional cost not to exceed One Thousand Yiolla..rs
($1,000.00). If such changes cause any increase in the cost of doing the
work ,under this Agreement or in the time required for its performance,
an adjustment as mutually agreed upon will be made by CONSULTANT and the
CITY, and the Agreement shall be modified in iTriting accordingly. Any
claim for adjustment under this article must be made in writing to the
CITY's Project Representative within ten (10) days from the date the
change is requested. -
X. TERMINATION
This agreement is subject to termination by the CITY at any
time upon serving written notice to CONSULTANT, and the CITY shall there-
after be liable to CONSULTANT only for fees and costs accrued to the date
of receipt by CONSULTANT of such notice.
XI. NOTICES
All notices to CONSULTANT under this Agreement shall be
deemed valid and effective upon deposit in the United States Mail, postage
prepaid, by certified and/or registered mail, addressed to Leighton -Yen
Associates, 300 South Beach Boulevard, La Habra, California 90631.
All notices to the CITY under this Agreement shall be deemed
valid and effective when personall, served upon the Planning Director or
upon deposit in the United States Mail, postage prepaid, by certified
and/or registered mail, addressed to the Planning Director, City of
Huntington Beach, P.O. Box 190, Huntington Beach, California 92648
X11. GENERAL PROVISIONS
In this Agreement, whenever the context so requires, the
masculine gender includes the feminine and/or neuter and the
singular-

APPENDIX E EXHIBIT A
SCOPE OF STUDY
CITY OF HUNTINGTON BEACH
GEOLOGIC AND SEISMIC SAFETY STUDY
THE STUDY
The study shall consist of four pri.ncipah tasks:
1. The collection and compilation of existing geologic, soils,
and seismic data.
2. An assessment of existing '.Lta and specific factors for
further study.
3. The study and analysis of high -priority geologic, soils,
and seismic factors.
4. The development and review of specific criteria as related
to land use planning,
Task I. Collection and Compilation of Existing Data
Activities under this initial task shall consist of those efforts required
to gather and compile all available data on the geologics soils, and seismic
conditions of the Huntington Beach area. This data shall include, but not
be limited to, information related to the following geologic, soils, and
seismic a5perts:
1. local geologic formations
2. expansive/collapsible soils
3. slope stability
4. mineral resource depletion
S. land subsidence
6. earthquakes
7. fault rupture
8. tsunami

Data to be gathered by the City staff will include aerial photographs, topo-
graphic maps and geologic maps and reports of the Huntington Beach area from
City files,
The Consultant shall review all available'existing literature and data from
other sources and gather such information as may be obtainable to complete the
data base. Infoni-tion gathered from all sources shall be compiled in such a
form as to be, readily available for future use by both the Consultant and City
staff.
Task II. Assessment of Ex� Data

reuire further study. The Consultant shall identify these factors, and in
cooperation with the City staff, assign priority rankings to each factor.
The Consultant shall also develop and submit to the City staff, a phasing
program for the continuance of such studies as determip,ed to be beyond the
present study scope.
Task III. Study and Analysis of High -Priority Factors
It is presently anticipated that the following geotechnical factors or conditions
will require further study beyond the level of information provided from
Task I. As a part of the Scope of Study, these would include:
1. Seismic conditions --'the relative susceptibility of all
areas to seismic hazards, including surface ruptures from
faulting, to ground motions, and to soil liquefaction.
2. Ground F osidence - resulting from future withdrawal of
petroleum from underground.Leservoirs.
3. Expansive soils - the pi,-esence of expansive,soils which
impose special requirements or future constr-faction.

Task IV. Development"of Criteria for Land. Use Planning
From the va-s.ous geologic, soils and seismic data and factors studied under
the previous tasks, the Consultant shall develop and recommend specific criteria
by which to assess the type, design and location of buildings and land uses
within various geo-physical areas of the City. These criteria will be designed
to allow the land use planner, as well as the civil or structural engineer to
assess the relative impact of geologic, soils and seismic conditions on
development throughout the City and to effect various trade-off options..
In order that effective use can be made of the geologic, soils and seismic
zP f stud the
data that is to be gathered. and an:��y.,.„fl during the course o the y,
following conditons should be met.
1. The data should be presented in such a form as can be readily
interpreted and used by study groups carrying out investigations
of other elements of the General Plan.
2. The data should be presented in a manner which is readily under-
standable by non -technical persons.
3 The data should be in a form which allows continual upgrading as
more information becomes available in the future.
4. The methodology for upgrading data banks should be presented in
sufficient detail to allow eventual turnover to City staff.
S. The geologic, soils and seismi-z study should develop guidelines
for further study, not only by public agencies, but more importantly,
studies which become a routine requirement of private developers.
6. The geologic, soils and seismic study should make full use of
current sate -of -the -art techniques

Data developed during the course of the study shall be presented in both
map and report fo7:m. All maps shall be in a form suitable for the addition of
future information. The a ;ty shall furnish the Consultant with abase topo-
graphic map of a scale of 1P1 = 800' from which to develop the maps.
The report will interpret and present data used in the development of the maps;
a discussion of the potential impact of the information contained on the maps,
ff and the Consultants recommendations regarding future studies.

The maps to be included are as follows:
1. Geologic Map This map will present the distribution of geologic
units within the study area, the structural character and com-
posit4'-n of the formations, and other basic geologic and
engineering properties of each unit. Developed primarily from
existing data, this map will form one of the data bases from
which other maps may be developed.
2. Expansive/Collapsible Soils Map - The Consultant will present
in this map existing and potential areas containing expansive
soilsandcollapsible soil sets, as well as a rating of the
expansion potential of the former ?materials
3. Active Fault Map - This map shall identify the location of recent
and active faults throughout the study area, and in particular the
Newport -Inglewood Fault which passes through the corporate Limits
of the City. The Consultant will ascertain the surface traces
of this fault, determine whether movement has taken place along
these traces, and will present zones of movement or potential movement
in relation to faults'.

4. Map of Areas Subject to Soil Liquefaction - If a major_ earthquake
were to occur on the Newport -Inglewood Fault, it is conceivable that
certain near -shore areas might undergo liquefaction, or a momentary
loss of strength. The Consultant will define such r;tential lique-
faction zones through the use of a dynamic -stress computer ara?ysis,
using representative soil profiles of the various local, near -shore
conditions.
S. Ground Response Spectra Zone Map - The Consultant will develoij sm3
delineate upon this map various response -spectrum zones ut:LI-iZi.r,z
a dynamic -stress computer program, at the same time the soA]. lique_
faction studies are being carried out. By developing and utilizing
estimated ground motion characteristics, the Consultant will determine
the characteristic response spectrum at the sur;',ace of sites or areas
throughout the City. An analysis and recommendations will be made
ry the Consultant as to the type, design and location of buildings
and land uses within each area designated on the map.
The City staff, insofar as practical, will provide the Consultant with assistance
in drafting services, report reproduction, and other allied services.
PERFORMANCE
Performance time on the study shall be four months. Regular meetings with the
Planning Department will be scheduled as necessary. A minimum of three presen-
tations to the Planning Commission and City Council will be required.

The City Council of the City of Huntington Beach does
hereby resolve as follows:
That the Agreement for Geologic and Seismic Safety Study,
by and between the City of Huntington Beach, a municipal
corporation and Woodward -McNeill & Associates, a California
corporation, dated February 20, 1973, a copy of which is marked
"Exhibit A", attached hereto and made apart hereof, is hereby
approved.
That the Mayor and City Clerk oftheCity of _iuntington
Beach are hereby authorized and directed to execute the Agree-
ment for Geologic and Seismic Safety Study.
PASSED AND ADOPTED by the City Council of the City of

RE: GEOLOGIC AND SEISMIC STUDY
At the February 20, 1973 meeting of the City Council the
Planning Department's request for the retention of a
consultant to perform a geologic and seismic study for
the city was refused. The Council expressed concern over
two points:
1. There was only one consultant considered by the
department.
2. There was a study being considered by; the County
of Orange to provide the same information to the
city.
On March 20, 1973 the Planning Department sent out 24
requests for proposals for the study to qualified firms
in Orange and Los Angeles Counties. Nine responses were
received. The Planning staff then screened the proposals
and selected three firms that best met the criteria of
the request for proposal. (Refer to Scope of Service
attached.)
The firms were Woodward -McNeill, Moore and Taber, and
Leighton and Yen. Representatives of Public Works,
Building, Civil Defense and Planning Department interviewed
each of the firms Leighton and Yen was selected as the
firm that would serve the city's need best. Also the
Planning Department investigated the county sponsored
study and found the following:
1. The study is being done by the California Division
of Mines and Geology and the County of Orange
Building Department and is being coordinated by
the Orange County Planning Directors' Association.
Completion is scheduled for January 1974.

2. The study is on a broad county -wide scale and will
not result in a Seismic Safety Element. (The
information is being developed at a scale of 1"=40001
as opposed to 1"=800' being requested by the Planning
Department.
3. A consultant ,could- have to be retained to further
develop the county study to meet our needs.
The Planning Department contacted the Orange County Planning
Directors' Association, California Division of Minus and
Geology and the Orange County Building Department to verify
the information. Also a representative of California Division
of Mines and Geology was present at a portion of the oral
interviews and confirmed this to the interview board.
In addition to the SeismicSafetyElement the information
developed in this study will be valuable for use in other
planning programs such as the Conservation, and Open Space
Elements,
Therefore the Planning Department requests your approval to
negotiate a contract with Leighton -Yen and ,associates to
perform this study as outlined in their proposal for the
sum of $7,500.

In order that effective use can be made of the geologic, oils and seismic data
that is to be gathered and analyzed during the course of the study, the follow-
ing conditions should be met.
1. The data should be ;presented in such a form a, can be readily
interpreted and used by study groups carrying out ivestigations
of other elements or the General Plan.
2. The data should be presented in a manner ti Mich is readi.y under-
standable by non -technical persons.
3, The data should be in a form which allows c;ont:ynual up ding as
more information becomes available i:i future.

4. The mzthodology for upgrading data banks should be presented an
sufficient detail t allow eventual turnover to City staff.
S. The geologic, soils sad seismic study should develop guidelines for
further study, not only by public agericies, but more ,,importantly,
studies which become a routine requirement of private developers.
b. The geologic, soils and seismic study should matte full use of current
state-of-the-art techniques.
Data developed during the course of the study shall be presented in both map and
report form. All maps shall be in a form suitable for the addition of future
information. The City. shall :Furnish the Consultant with a base topographic trap
cf a scale of l" 800' from which to develop the maps.
Via report will interpret and present data used in the development of the maps;
a discussion of the potential impact of the information contained on the maps,
and the Consultants recommendations regarding future studies
The traps to be include, are as of-t-!s:
1 Geologic tilap - This rap will present the distri> ution of geologic
units within the study area, the structural character and com-
position of the fo .rations, and other; b•tsic geologic and
eng:bieerirg properties of each unit. Developed primarily from
existing data, this map will form, one-ef the data rases from
which other maps may be developed.
?. Expansive; Collapsible Soils lvi-,tp - The Consultant will present
in this Tnap oxisting and potential areas containing expansive
soils arrl collAps-Lble so:,?. sets, as well. as a rating of the
expansion potential of the former ma?,aerials.
3. Active Fault i`a This map shall :identify the location of recent
and active faults throughout the study area, and in particular the
Nei�port-molt;+=d Fault which passes through the corporate limits
of thie City, The Consultant will ascertain thesurfacetraces
of this fault, determine whether movement has taken place along
these txdces, �Md will present zones of movement or potential move-
rrent in ..•elan on to faults.

certain hear-s!;ore areas might undergo liquefaction, or a rr;_mentar}
loss ;, E strength. Ilie Consultant will define such potential `liaue
.faction zones through the use of a dynamic -stress computer analysis,
vying representative soil profiles of the various local, near -shore
conditions.
S. Ground Resp se Spectra Zone Map.- The Consultant will develop and
delineate upon this map various 'response -spectrum zones utilizing
a d-namic-stress computer program, at the same time 'the soil lique
factioi, studies are being carried out. By developing and utilizing
est.Ura.ted gro m-cl motion characteristics, the Consultant will ieterm -ie`
the character)^tic response spectra-m at the surface of sites or areas
throughout the City. An analysis and recommendations will be maje by
the Consultant as to the type, design and location of buildings and
land uses within each area designated on the map.
The City staff, insofar as practical, will provide the Consultant with assistance
in draftLiirg services, report reproduction, and other allied services.
PRRFORMAPCE
Performance time on the study shall be four months. Regular meetingo
with the Planning Department will be scheduled as necessa._y. A
minimum cf three presentations to the 'Planning Commission and City
Council will be required.
