[13011 Construction of Improvements The Improvements to be conGtructed by Participant and to be financed by Agency in accordance with the provisions of Section 2.01, consist solely of atructliral and aesthetic improvements necessary to rehabilitate the exterior of the exiatirg �.,ommercia' %square footage an the Site. All other Improvements, Including but not limited to expansion of commercial square footage, tenant improvements oi- interior improvements do not cot&_,'titute Improvements under this Agreement and shkM be the sole responsibility of Participant. Expansion of commercial square footage on the Site (i.e. the addition of a second floor) shall be subject to Agency approval. In the event that Participant enters Into a written contract(s) for construction of the Improvements, such contracts shall be submitted by the Participant to the Agency for its review and approval which approval shall not be unreasonably withheld. If any submitted contracl., has not btan approved or denied by the Agency within fifteen (15) working days of submitttl, it shall be deemed approved. (§4001 USE OF THE SITE A. 1§401) Uses The Participant covenanta and agrees for itself, its 'Aq successors, its assigns, and every successor in interest to the X Site or any part thereof, that the Participant, such successors and such asnigneea, ahall devote the Site to the uses specified in the Redevelopment Plan and thin Agreement for the periods of time specified therein. All uses conducted on the site isliall conform to all applicable provisions of the Huntington Beach honicipal and Ordinance Codes. The Participant further covenants not to use thn site for residential or manufacturing purposes and not to allow operation of any type of arcade on the site. The foregoing covenants shall run with the land. The Participant shall maintain the Site i,nd all improvements theroon, including 'the subject Improvemento, in compliance with the terms cf the Redevelopment Plan and with all applicable pr&vislonu of the Huntington Beach Municipal Code until the expiration date of the Redevelopment Plan'*and as said expiration date mny be extended by proper amendment to the Redevelopment Plan. The agreement provides that as an Incenti— to the property owners to rehabilitate the building located at 126 Main Street, the Redevelopment Agency will provide a Tahaldillitation grrrt in the maximum amount of $C3,625 for the actual cost of the facade improvement;;.
