Our mixer consists of a batch type Essick plaster mixer, which deposits the properly prel•ared jrnut into a manually agitated pump feed hopper. We use the batch type rnixe r because it provides a superior grout mix being thoroughly biendecl and more readily adjustea as to both compo- sition and consistency (slump). Therefore, the mixing eq'. Comeetency of Bidders and_ Payment for Plans and Specifications Plans, specifications and proposal forms will be issued only to those contractors who can qualify as competent bidders. A charge will be required for the taking out of plans, none of which will be refunded to any bidder. Z-c. Proposal Form All proposals trust be made upon blank forms to be obtained from the office, of the Director of Public Works at the Civic Center, Huntington Beach, Californiu. The bidder shall submit his proposal on the form furnished him. Proponals submitted on forms other than the one issued to the bidder will be disregarded. All proposals must give the prices propooed both in words and numbers, of which words will prevail over numbers, and must be ,signed by the bidder with his address and telephone number, If the proposal is made by an individual, his namw,post office address and telephone number must be shorn. If made by a firm or partnership must be shown. If made by a corporation the proposal must show the name of the State under the laws of which the corporation was chartered, the name of the corporation, and the namest titles, and business addesses and telephone numbers of the President, Secretary and Treasurer. 2--d. Proposal Guaranty 0 All bide shall be presented under sealed cover and sW - be accompanied by cash, a cashier's check, certified check, or bidder's bond made payable to the City of Huntington Beach, for an amount equal to at least ten percent (10%) of the amount of said bid, and no bid will be considered unless IV such cash, cashier's check, certified check, or bidder's bond is enclosed therewith. 2-e. Scope of Work a. Control of the Work 5--a. Authority of the Director The Director shall decide any and all questions which arise as to the quality or acceptability of materials .furnished and work performed, the manner of performance and rate of progress of the work, the interpretation of the plans and specifications, the acceptable completion of the contract by the contractor, and all questions as to claims and compensation. The Director's decision shall be final and he shall have executive authority to enforce and make effective such decisions and orders. The contractor shall carry out promptly all decisions or orders of the director, &ffectAng the work. 0 0 S-b. Standard drawings of the Department of Public Works, lists, rules and regulations referred to are recognized printed standards and -shall be considered as one and a part of these specifications within the limits specified. Coordination of Plans and Specifications These general requirements, specifications, special provisions, the plans, and all supplementary documents are essentiAl parts of the contract, and a requirement occurring on one is as binding as though occurring in all. They are intended to be cooperative, to describe, and to proviOfor a complete work. Plans shall govern over specifications. 5-f. Interpretation of Plans and Specifications Should it appear that. the work to be done, or any matter relative thereto, is not sufficiently detailed or explained in these specifications and plans, the contractor shall apply to the Director for such further explanations as may be necessary, and shall conform, to such explanationE or inter- pretation as part of the contract. Remo7a.l of Defective and Unauthorized Work All work which is defective in its construction or does not ineet all of the requirements of these plans and/or specifications shalJO be remedied, or removed and replaced by the contractor in an acceptable manner, and no compensation will be allowed for such correction. Any work done beyond the limite of the lines and grades shown on the plans or established by the Director of Public Works, or any extra work clone without written authority, will be considered as unauthorized and will 'not be paid for. Upon failure on the part of the contractor to comply forth- witli with any order of the Director made under the provisions cf this article, the Director shall have authority to cause defective work to be remedied, or removed and replaced, and unauthorized work to be r©moved, and to deduct the costs thereof from any moneys due or to become due the contractor. ;-i. Superintendence Whenever the! contractor is not present on any part of the work where the City desires to give direction, order:; will be given by the Director in writJ.nq, and shall be received and obeyed by the contractor's supe�rindeynte�nt or foreman in charge of the particular work in reference to which orders are given. 5- j . Lines and _Grades All distances and measurements are given and will be made in a horj.zontal plane. Grades will be given from and referenced to the top of stakes or points, unless otherwise noted on the plane. The contractor shall furnish the Director such facilities and labor necessary for making and maintaining points and lines as lie may require. Final IisRection Whenever the work provided for and contemplated by the contract shall have been satisfactorily completed and tho final. cleaning performed, the Director will make the final inspection. o. Control of Materials 6--a. Qualit of Material Materials shall be new, and of specified kind and quality and fully equal to samples when samples are required. When the quality or kind of material or articles shown and required under the contract is not particularly specified, the contractor shall. estimate that the City will require articles or materials representing the best of its class or kind or at least equal to the ^lass or quality of similar articles or materials that are specified. Materials shall be furnished in ample quantities and at such times to insure uninterrupted prog+ess of the work. same shall lb ba stowed properly and protected as required. The contractor shall be entirely responsible for damage or lone by weather or otter cause, 6-b. Trades Names or Equals It is the intent of these specifications to permit the con- tractor to supply any of the materials specified or offer an equivalent. The engineer shall determine whether the material offered in equivalent to that specified. Adequate time shall be allowed for the engineer to make this determination. Whenever any particular material, procesa, or equipment is indicated by patent, proprietary or brand name; or by name of manufacturer, such wording is used for the purpose of facil- itating its description and shall be deemed to be followed by the words "Or approved equal" A listing of materials is not intended to be comprehensive,or in order of preference. The rontractor may offer for approval any material, process, or nqu:.pment which he consid©rs to be equivalent to that indicated. Unless otherwise authorized by the engineer the substantiation of offers must be sub- mitted within 35 days after award of contract. The contractor shall, at, his expense, furnish data concerning items offered by him as equivalent to those specified. He shall have the material tested as roquired by the engineer to determine that the quality, strength, physical, chemical, or other characteristics, including durability, finish, efficiency, dimensions, service, and suitability are such that the item wia1 fulfill its intended function. Lest meflI ods shall he subject to the approval of the engineer. Test: results shall be reported promptly to the engineer, who will evaluate the results and determine if the substitute item is equivalent. His findings shall be final. Installation and use of a substitute item shall not be made until approved by the engineer.. If a substitute offered by the contractor is found to be not equal to the specified material, the contractor shall furnish and install the specified material. The specified contract, completion time shall not be affected by any circumstance developing from the provisions of this Subs ect::On. 6-c. Samples and Tests A. the option of the Director, the source of supply of each of the materials shall ba approved by the Director before delivery is started and before such material is used in the work. Upon request of the Director of Public Works, representative preliminary material samples of the character acid quality prescribed shall be submitted, by the contractor producer or manufacturer of all materials to be used in the work, for such testing or examination deemed necessary by the Director of Public Works. All tests of materials furnished by the contractor shall be made in accordance with commonly recognized standards of national organization, and such special methods and tests as are prescribed in these specifications. The contractor shall furnish, at no cost to the city, au►:h samples of materials as are requested by the Director of Public Works. No material shall be used until it has been approved by the Director of Public Works. Materials reiuiriag test shall be delivered in ample time before intended use to allow for testing, and none may be used before receipt of approval. No rejected material, the defects; of which have: been sub- sequently corrected, shall be used until approved in writing by the Director of Public Works. Upon failure on the part of the contractor to comply with any order of the Director of Public Works my1.de under the provisions of this article, the Director of Public Works shall have authority to remove and replace defectivb material and to deduct the cost of removal and replacement from any monies due or to become due the contractor. 7. Legal Relations and Responsibilities 7-a. General Compliance with Law The contractor shall keap informed and observe, and comply wi;:h, and cause all of his agents and employees to observe and comply with, all prevailing Federal, State and Municipal Laws, Ordinances, Rules and Regulations which in any way affect the conduct of the work of this contract. If any conflict arises between provisions of the plans and specific- ations and any such law above referred to, then the contractor shall notify the City at once in writing. The contractor shall protect and indemnify the City or any of its officers, agents, and employees against any claim or liability arising from or based on the violation of any such law, ordinance, rule or regulation, whether by himself or his agents employees. 7-b. Registration of Contractor Prior to the award of contract# the contractor shall be licensed accordance with the provisions of Article 1 to 9 inclusive of Chapter 9, DI.vision 3 of the Business and Professions Code of the State of California and Amendments thereof, providing for • the registration of contractors, and defining the term con- tractors providing a method of obtaining licenses to engage in the business of contracting and fixing the fees for such licensesr and prescribing the. punishment for violation of provisions therauf, as amended. 0 7-c. Permits and Licenses The contractor shay,l procure all permits and licenses, pay all charges and fees, ai,d give all notices necessary and incidental to the due and lawful prosecution and completion of the work. C'I 9 7-d. Patents The contractor shall assume all .Liability arising fro» the use of patented materials, equipment., device3, or processes used on or incorporated in the work. 7-e . California Fair EA! loyment Practice Act V M The contractor shall utilize fair employment practices in accordance with California Labor Code Section 14 -10 et seg. 7--f . Prevailing Wage The contractor shall forfeit as penalty ;twenty-five dollars ($25.00) for each laborer, workman or mechanic employed for each calendar day or portion thereof, such laborer, workman or mechanic is paid less than the general prevailing rate or wages stipulated for any work done by him, or by any subcontractor under him in violation of the provisions of the Labor Code, particularly Section 1770 to .1781 thereof, both inclusive, providing for the payment of not less than the general prevailing rate of wages for legal holiday and overtime work on public work, providing for the ascertain- ment of sut.h general prevailing rate by the public body awarding the contract, providing for, the keeping of records of the wages paid all workers engaged in public work and the inspection of such records by the proper officials, providing for forfeiture for each calendar day, or portion thereof, any worker is paid less than the said rate and for, a stipulation to this effect in the contract, and providing other penalties for violation of the provisions. 7-g . Hours of Labor The contractor shall forfeit, as penalty, twenty-five dollars ($25.00) for each laborer, workman, or mechanic employed in the execution of the contract by him, or by any subcontractor under him for each calendar, day during which said laborer, workman, or mechanic is required or permitted to labor more than eight (8) hours in violation of the provisions of the Labor Code, particularly Section 1810 to 1816 thereof, both inclusive, relating to the hours of labor on public works, by requiring c:>>:tr.actors to file with the awarding body a verified report as to the nature of any extraordinary emergency when their employaps are permitted to work over eight (8) hours per day, together with the names of the said employees, and the hours worked per day making failure to file said report within thirty (30) days prima facie proof that no extraordinary emergency existed, also making it a misdemeanor for any contractor or subcontractor on public work, or agent thereof, to fail to keep an accurate record showing the name of and the actual hours worked by each workman employed by him in connection with public work. Residents along the road, str(:et, or other alignment of improvements shall be provided convenient access to driveways, houses, and buildings along the road or street, and temporary crossings shall be provided and maintained in good condition. Not more than one cross street or intersecting street or road shall be closed at any one time without the approval of the Director of Public Works. The contractor shall furnish, erect, and maintain such fencer, barriers, lights, and signs as are necessary to give adequate wa.-ning to the public at all times that the road or street la under construction and of any dangerous conditions to be encountered as a result thereof, and he shall also erect and maintain such warning and directional signs as may be furnished by the C :. ty . Strict prohibition against committing any nuisance in or about the work must be maintained. Coveniences shall be provided for employees and maintained in sanitary conditions. At street crossings and where existing driveways occur., the contractor ahal.l make provision for ditch crossings at these points either by means of backfills or temporary bridges as the Director of Public Works may direct. Free access must be provided to all fire hydrants, water gates, meters and private drives, and means shall he provided whereby all storm and waste water can flow in the gutters uninterrupted,. 7-j. The safety provisions of applicable laws, building and construction codes shall be observed. Public Liability and Property Damage Insures The contractor shall furnish to the City and maintain during the life of the contract a public liability policy in which the City is name:d as an additional insured. The policy shall also hold harmless the City, its officers and employees while acting within the scope of their duties, against all claims arising out of or in conn*ction with the work to be performed. Labor The contractor shall observe str.ic:ly that each and ovary kind of work shall be performed by workmen, laborers, or mechanics especially skilled in the class of work required and that workmanship shall be of the best regardless of the duality of material. The contractor shall. provide, at all times, sufficient com- petent labor to properly accomplish the work and to insure completion of each part in accordance with schedule and with 40 the time agreed to. The contractor shall retain a competent superintendent to direct the work constantly during construction and to represent the cont.a►ctor at all times in connection with the contract. B -d. Subletting and _Assri%Izient The contractor shall give his r.*xsonal attention to the fulfillment of the contract and shall keep the work under his control. The specifications are in "schedules" divided and arranged according to variouri trades. No obligation is inferred to sublet the work ,as divided, nor is the contractor relieved of fully.performing and completing any part of the work. Where a purticn of the work sublet by the contractor is not being prosecuted in a manner satisfactory to the Director of Public Works, the subcontractor shall be removed immediately on the request of the Director of Public Works and shall not again be employed on the work. Assignment of the obligations and/or duties of the contractor in they whole or any part of the contract shall be made only upon the consent and approval of the City Council of a written request by the contractor. 8-e, progress of the Work and Time for Completion The contractor shall begin work within ten (10) days after receiving notice that the contract has been executed by the City and shall diligently prosecute the ranee to completion before the expiration of the time specified in the proposal, specifications, and/or contract. Character. of Workmen .if any subcuntrartor or person employed by the contractor either fail or refuse to carry out the directions of the Director of Public Works or shall appear to the Di.roctor of. Fublic Works to be incompetent or to act in a disorderly or improper manner, he shall be discharged immediately upon request of the Director of Publics Works, and such person shall nct again he employed on the work. 6-g . Temporary Sus2ens ion of Work The Director of Public Works shall have the authority to suspend the work wholly or in part, for such Period as he may dean necessary, due to unsuitable weather, or to such other ncriditioris as are considered unfavorable for the prosecution of the woxk, or for such time as he ma deem necessary, clue to the Failure on the part of The con -- tractor to carry out orders give, or to perform any provis:Lons of the work. The contractor shall immediately ebey all ordexs of the Director of Public Works and shall not resume the work until ordered to do so in writing by the Director of Public Works. 9-h. Time cal: CoMl etion and Liquidated Damages_ It is agreed by the parties to the contract that in case all work called for under they contract is not completed before or upon the expiration of the time limit as sec foxth in these specifications}, damage will be sustained by the City of Huntington Beach and that it is and will be impracticable to determine the actual damage which the City will sustain in the event of and by reason of such delay; and it is therefore agreed that the contractor will pay to the City of Huntington Peach the sum of one hundred dollars ($100.00) per day for each and every day ° ss delay beyond the time: prescribed to complete the work, or any approved extension thereof, and the contractor agrees to pay such liquidated damages as herein provided and in case the same are not paid, agLOes that the City of Huntington Beach may deduct the amount thereof from any money, due or that may become due the contractor under the contract. it is further agreed that in case the work called for under the contract is not finished and completed in all parts and requirements within the time specified the Director shall have the right to extond the time for completion. If the Director extends the time limit for the completion of the contraeot, the City L-1all further have this right to charge to the contractor, his heirs, assigns or sureties, and to deduct from the final payment for the work, all or any part, as it may deem proper, of the actual cost of engineering, Inspection, superintendence, and other overhead expenses which are directly chargeable to the contract, and which accrue during the period of such extension, except that the cost of final surveys and preparation of final estimate shall not be included in such charges. i The contractor shall not be isse.s sera with liquidation damages nor the cost of enKfineering and inspection during any delay in the completion of the work catised by acts of Cod or of public enemy, acts of the City, fire, floods epidemics, quarantine restrictions, strikes, freight embargoes, and unusually severe weather or delays of sub- contractors due to such causes; provided, that: the contractor shall within ten (101 days from the beginning of any such delay notify the Director of Public Works in writing of the causes of delay. The Director of Public Works shall ascertain the facts and the extent of delay, and his findings, of the facts thereon shall b^ final and conclusive. d-i. Suspension of a Cash Contract • If at any time .in the opinion of the City Council the contractor has Eailed to supply an adequate working force, or material of proper quality, or has failed in any other respect to prosecute the work with the diligenue and force specified and intended by the terms of the contract, notice thereof in writing will be serves] upon him, and should he neglect or refuse to provide means for s satisfactory compliance with the contracts as directed by the Director of Public Works, within the time specified in such notice, the City Council sha11 have the power to suspend they operation of the contract. Upon receiving notice of such suspension, the contractor shall discontinue performance of said work, or such parts of it as the City Council may designate. Upon such suspension, the contractor's control shall ter- minate and thereupon the City Council or its duly authorized representative may take possession of all or any pert of the contractor's materials, tools, equipment and appliance upon the premises, and use the same for the purpose of completion of said contract, and hire such labor and buy or rent such additional machinery, tools, appliances, and equipment, at the contractor's a>pense as may be necessary for the proper conduct of the work and for the completion thereof, or may employ other parties to carry the contract to completion, or employ the necessary workmen, substitute other machinery or materials, and purchase the materials contracted for by contractor, in such inanner as the City Council may deem proper; or the City Council may annul and cancel the contract And relet the work or any part thereof. Any excess of cost arising therefrom over and above the contract price will be charged against the contractor and hie sureties, who will be liable therefor. In the event of such suspension, all money due the contractor or retained under the terms of this contract shall be forfeited to the City; but such Forfeiture will, not release the contractor or his sureties from liability by failure to fulfill the contract. The contractor shall make his own arrangem(;.&nts, and pay all expenses for additional area required 'jhim outside of the limits of right of way. Y �J Y 8--1. Prevervation and Cleani.nU The contractor shell properly preserve and clean the work as it progresses. At regular intervals,, or when directed, rubbish shall be collected and removed, and at completion the whole work shall be cleaned and all tools, false work, equipment and rubbish shall be removed rrom the site, which shall be Left in clean and proper condition as directed. 8-m. Acce2tarsce Should it become necessary, due to developed condition, to occupy Tiny portion of the work before contract is fully com- pleted, such occupancy shall not constitute acceptance. 9. Meaasucnnent and Payment for a Cash Contract 9-a. Extra and Force Account Work Extra work as defined, when ordered and accepted, shall be paid for under a written change order in accordance with the terms therein provided. Payment for extra work will be made at the unit price or lump sum previously agreed upon by the contractor and the Director of Public Works; or by force account. if the work is done on force account the contractor shall 0 receive the actual coat of all materials furnished by him as shown by h+s paid vouchers, plus fifteen percent (1500 and for all labor and equipment necessary hi shall receive the current prices in the locrlity, which shall have been pre- viously determined and agreed to in writing by the Director 40 of Public Works and contractor, plus fifteen percent (15%) 1 Provided, i.owevor, that the City res-orves the right to furnish such materials required as it deems expedient, and the contractor shall have no claim or profit on they coat of stitch materials. Progress Payment s The City shall, once: in each month, cause: an estimate in writing to be made by the Director of Public Works of the total amount of work done and the: acceptable materials � furnished and delivered by the contractor to the ;job site and not u3ed as of the time of such estimate and the value thereof. The City shall retain money in the amount of ten percent (10,A) of the progress payment unless approval of Director for greater percent of such estimated value of the work done. The City shall retain money in the amount of fifty percent (50%) of the value of the materials so estimated to have been furnished and delivered and unused provided the mate.: ials were fabricated spf.�cif2cally for the project. No payment will be made: for standard stock items that have not been .incorporated ;n the work. The City shall monthly pay to the contractor while performing the work, the progress payment balance, after deducting therefrom all previous payments and all sums to be kept or retained under the provisions of the contract. No estimate or payment shall he required to be made when in the judgement of the Director of Public Works, the work is not pro':eeding in accordance with the Provisions of the contract or when in his judgment � the total value of the work bone since the last estimate amounts to less than three hundred dollars ($300) . Progress payments shall be submitted to th►:. Department of Public Works on the Monday before each City C,,,uncil meeting for monthly progress payment or final payment. City Council meetings are field on the first and third Monday of each month. Progress payment shall also be typed written on form furnished by the City (see formx). 9_c. Final Payment The Director of Public Works shall, after completion of the contract, make a final estimate of the amount of work done thereunder and the value of such work, and the City of Huntington Beach shall pay the entire sum found to be due after deducting therefrom all previous payments and all amounts to be kept and all amounts to be retained under the � provisions of the contract. All prier partial estimates and payments shall be oubjec:t to correction in the final estimates and payment. Did Price The contractor shall for the price bid, furnish all equipment, labor and materials and do all incidental work necessary to deliver all of the improvements complete in place in accord- ance with the specifications, special provisions, ordinances, plans, cross sections detail drawings and City standard plans. 12. Guarantee The contractor, by submission of a bid for this project, expressly agrees to the herein stipulated guarantee of materials, products, workmanship, and installations incorporated into this project. All work performed in accordance with these general requird- ments, special provisions, spec;.fications, and plans, including, but not limited to, workmanship# installation, fabrications, materials, and structural, mechanical, or electrical facilities shall be guaranteed for a period of one year, nomaencing at the recorded date of filing the notice of completion of the contract by the City, Unless specific areas are to be guaranteed longer as provided in special provisions. Security of this guarantee shall he furnished to the City in the form of a bond in favor of the City for an amount equal. to 10% of the final adjusted and agreed upon contract pace. Notification will be given to the contractor oJ! the date of anticipated Council acceptance and the expected date of filing of Notice of Completion in order that he may arrange for then bond.
