By my signature hereunder, as Contractor, I certify that I am aware of the provisions of Section 3700 of the Labor Code which require every employer i to be insured against liability for workmenOs compensation or to undertake self-insurance in accordance with the provisions of that coda, and I will comply with such provisions before commencing the performance of the work of this contract. 11. An indefinite contract cannot be enforced because the courts cannot know to what the parties agreed. RESOLUTION NO. 4080 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH SPECIFYING THE PREVAILING RATES OF PER DIEM WAGES FOR PUBLIC WORKS CONTRACTS WHEREAS, the City Council of the City of Huntington Beach is authorized by Section 1773 of the California Labor Code to .specify the prevailing rates of per diem wages, and in calls for bids the city may refer to copies of such prevailing rates in the office of the City Clerk;.and The City Council has ascertained and considered the appli- cable wage rates established by collective bargaining agreements and such rates as may have been predetermined for federal public works contracts within the locality, and in the nearest Labor market area; and Has obtained and considered further data from the labor organizations and employers and from recognized collective bar- gaining representatives for the particular craft, classification or type of work involved; and The rate fixed far each craft, classification or type of work is Clot less than the prevailing rate paid in such craft, classification or type of work. NOW, THEREFORE, the City Council of the City of Huntington Beach- does hereby resolve as follows 1. That the following rates, which said rages are not less than the prevailing rates pai(Y in each such craft, classification or type of work, are hereby specified as the prevailing rate of per diem wages for work performed on public works contracts for the City of Huntington Beach. See attached Exhibit "A.," 2. The City Clerk is hereby authorized and directed to file with the Director of Industrial Relations for the State of Callrornia, a certified copy of this resolution as require; by Suction 3.773.3 of the California Labor Code. bc:k 1. s 3. The Director of Public Works is hereby authorized and d1ructed to snake available to any interested party on request, _icopy of the wage rates specified in this resolution, as re- quired by Section 1773 of the California Labor Code. 4 Each contractor is hereby instructed to post a copy of the wage�.rates specified by this resolution at each job site, as required by Section 1773 of the California Labor Code. 5. Nothing in this resolution shall be construed to limit the authority granted in Section 1773 of the California Labor fir\ Code to the effect that if there.,is any change in the prevailing, rate during the course of any year, the City shall specify such changes in the first call for bids made by the ;City there- after, and the Director of Industrial Relations of any such change, within ten (10) days of such change. 6. The City Clerk shall cause the list of prevailing wages specified in this resolution to be published at least one time during the year .beginning July 1, 1975 and ending June 30, 1976, in the Huntinf,ton-Beach News, a newspaper of lash general circulation, printed and published in the City of ' Huntington Beach. Gerrseral— The Specifications for the hereinafter described Janitorial and Building MKaintenance for the Civic Center Complex, 2000 Main Street, Huntington Beach, California, shall consist of the requirements and conditions of the following documents; General Requirements of the City of Huntington Beach, excepting deleted sections, Special. Conditions, Special Provisions, Notice Inviting Sealed Bids, and The Proposal; the composite of which shall 1tereinafter be referred to as Specifications. II Contract Documents shall consist of the Specifications, bonds, insurance certificates, the contract, and all submittals required, together with the plans. III. Plans shall consist of generalized furniture layout pl&a � of the various floor levels of the buildings within the complex. Each contractor submitting a bid shall be responsible to determine all quantities of total work, including, but not limited to, floor areas of various finishes, restroomsp kitchenettes, rooms, hallways, doors, windows, furnishings, and all other components of the work, V. Off Limits Facilities consist of areas of security, certain equipment areas to be cleaned and maintained by staff forces, and areas which are to be maintained by the using city department or by this contract on a callout basis at which time as city personnel are present during the work. Additional off-limits ,facilities, not indicated on the plans,, are the interior plants, paintings, and tapestries. These are not to be touched nor cleaned under any circumstance V1. Building Access shall be through the front desk of the Police B��-,partment unless the night technician is on duty. Coordination and Phasing- The contractor shall hereby g y be made cognizant of the fact the Council Chambers, meeting roOhL81 and at times conference and office spaces will be in use by employees and citizens. All work shall be performed in a phased operation such that these meetings are not disrupted. In no case sb,..i work commence in an area occupied for meeting purposes. The information desk will supply the contractor listings of all scheduled meetings, however department conferences are not sD scheduled and must be handled as they occur. VSII. Personnel Conduct- The contractor shall be expected to require each of his employees to afford all city employees, officials, and citizens the highest quality of courtesy in speech, action, and deed. All contractor employees shall, be identified by either uniform with company name thereon or an identification card or both. The City, through the department pfPublicWorks, retains the right to demand immediate dismissal or removal from the premises of any contractor empl .yen considers-d to be in violation of requirements of these specifications. IX. Personnel Attire-- The ,contractor shall require each of his employees to adhere to basic Public Works standards of working attire. These are basically clean uniforms, proper shoes and other gear required by State Safety Regulations, and proper tearing of the clothing. Unless all city employees and citizens have ` vacated the premises, shirts shall be worn at all- times, buttoned and tucked --in. X. Special Conditions - A. Submittals Required to accompany each proposal are listed below, and failure to comply or to complete sl,4il.l be cause to reject the bid, at the option of the City. 1. Q...ality Cu)iIk.s•_;l-� The contractor shall provide a numerical quality control system which will objectively effect means to estimate cleaning services. This system shall include an inspection report form which will be used not only by the contractor's supervisor, but also the building maintenance technician in charge of monitoring the contract work. The form or forms must be acceptable to_tho city, and must provide capabilities of inspection reporting for each area and for each service specified. C. Requirements subsequent to contract execution The contractor is hereby required to conform to the following' and submittal of a bid shall constitute prima facia evidence of .9greement to abide by all conditions and requirements of these specifications. 1. The contractor shall furnish all labor, materials, and equipment necessary to perform the specified work, with the exception of owner consumable items suchas toilet paper, paper towels, soap refill for dispenser units, plastic: trash container liners, sanitary napkins, toilet sb;at covers, and lighting lamps and bulbs. The contractor shall be responsible, however to secure city supplied items and refill all containers and dispensers! and shall sin out on a log provided by the city for all supplies takc,n. 2. Contractor's Rqu-pment shall, be new or in the best maintained working order for its intended function. Equipment which is faulty or does not perform to the satisfaction of the city shall be removed from the premises x and replaced. All contractor equipment and supplies shall be stored only in the areas designated by the city. 3s Subsequent to contract execution, and prior to work commencement, the contractor shall supply a list1by name and address,of each employee to be used on the contract work for a security check by the police department Any change in personnel shall be processed for clearance prior to working on the complex. The city shall retain the right to demand removal of any employee disobeying orders non-wperformance, unsatisfactory rating oi- change in rating of security status, . Failure of the contractor to perform any servi;,e required by the specifications, evidenced by t'[se daily inspection by the building maintenance technician, shall result in the following procedural steps being taken. a. A telephone call shall be made to the contractor ordering commencement of work rectifying the deficiency within two houra. b. 3n the went work is not so commenced, the city shall retain the right to either call in another service or to perform the service with city forces; and to bill the contractor for time and material charges plus twenty five percent for overhead. Each such billing shall be paid prior to issuance of the month]' l contractural payment 5.Working time limits All work specified as Basic- Services shall be performed within the time limits listed below: a Commencement shall occur at a regular time between 5:30 PM and 6:00 P.M. b. No work shall be performed prior to 5:30PM nor after 7:00 AM. c. Times for special service call out work shall be performed on the day and at the times selected by the city. Sundays and holidays will be excluded from this selection perogative. 6. Reporting for work- The foreman and full working force shall report to the maintenance technician prior to commencing each days work, for confirmation of the crew complement, and to receive any special instructions. This report meeting shall consume no more than f,4=e minutes for the crew. The foreman, shall be expected to remain ,for instructions and/or accompany the teclinici.an to inspect problem areas. '?. Administration Responsibilities- The contractor shall recognize the Department of Public Works as the contract administration force of the city. Direct contact for daily work shall be the building maintenance technio-.= or his assistant. Special Provisions- The hereinafter described special provisions shall establish the levels of servit,e required by these specifications, and shall be considered to include, but not be limited to,the generalized working items listed under each subsection. All work shall be perfomed in a manner equal to the best quality of the trade. The technician shall be the judge as to accepability of all work performed. The work to be performed under Basic Services shall consist of the below separate service listings wiich by natura of usage differ in per-formaneu and in frequencies. Weekly area usage within the complex varies from five days per week to seven days per week, and may ee generally segregated by plan sheet numbers. Contract payments -• Payment for the work described in the-e speclifications shall be made on a monthly basis .for work performed. Each month, on or prior to the tenth day of the nio=ith, the contractor shall submit: an invoice for the work performed during the month previous. Costs of bonds, insurance, license, and all other annual costs shall be prorated into the twelve months' payments. Payments shall be full compensation for all . iit.or, materials, equipment, overhead, profit, bonds, insurance, licenser taxes, royalties, and any other cost involved, and no additional compensation 11,E shall be made,except for specific on call special services The contractor, along with each invoice, shall furnish a monthly report on the working force furnished each day, by name, hours worked, wages, and fringe benefits. Reports or confirmation that the guaranteed working force was not supplied each day ,scheduled will result in a reduction of the monthly payments by the wages and fringes of employees short plus overhead and profits percentage. The City shall process the approved invoice on the second regular Council meeting of the month which is on the third Monday, and a check will be mailed within three days. XV. City Provided Facilities .. The City shall provide the following to the contractor. 1. Electricity 2. Water 3. City furnished supplies previously listed. 4 Various janitor spaces. All equipment and supplies must be kept only in these spaces, and the area must be kept clean. 5 Dumpster Bins exterior off' the building for disposal of trash. The contractor is hereby notified that all City space station telephones are for City business only. The contractor shall use the available pay telephone for all personal and lon7 distance business calls. XVI. Contract Duration The contract will be _awarded for a period of one year with City retained option to renew annually based on negotiation of any cost increase due to labor or materials cost excalation. X'VII Contract Cancellation The City retains thm right to cancel the contract, with thirty days notice, for failure to comply with these specifications, or for failure to perform qualitively or quantitively to the satisfaction of the Department. of Public Works. -12,- XVIII. Split Shift Clarification of Section X, C, 5a, and 6Y relative to Section XII D, cleaning of Council. C'aamhers and conference rooms adjacent thereto is as follows. The contractor may allow a minimum of the crewto arrive at a later time than the 5:30 to 6:00 PM commencement schedule, in order to provide the cleaning of t?..: areas within a normal work time assignment without causing c:xponse of premium overtime. XIX. Reservation of Rights—� The City reserves the right to arrange for any or all items of extra service and on call service, by separate contract or purchase order to one or more other contractors, in the best interests of the City. XX. Proi._ _ _ ')roposal shall include both unit pricing for basic service and for extra or on call services, however in order to arrive at an annual comparison with budge''ary projections, a summary based on certain extensions of the extra and on call services added to the twelve month bid for basic service will be the basis of award, even though election to use or not use the extras and on calls is reserved. Additionally, two deductive alternates are listed to further expand the reservation rights to either delete or reduce frequency schedule or to arrange fcr with other contractors. Lastly, one additive bid is requested to provide firm quotation for the addition of .tie .fifth floor of the Administration building at such time as it is completed. Service levels for this work shall be in accordance with those of the fourth floor. The contractor shall base his proposal bid on. the area identical to that of the fourth floor. Partitioning is unknown at present, however the spaces will be utilized by the seven council members, fire department, and recreation staff, each of whom will require minimal closed offices along with open concept stations for the balance of the staff, Three other additives are provided for the possible future inclusion of areas now classed off limits. These latter additives are to be bid based on the square feet of various types of floor finish. XXI. Bid comparisons will be based on review of all unit pricing, the summary, deductives, and additives. The City reserves the right to sward to that bidder providing the lowest responsible bid, as determined by the City. Obviously unbalanced bids, indicative of misunderstanding of thk+ specified quantity or quality of work will.: be re l ected. i
