Anything mentioned in the specifications and not indicated in the plans, or indicated in the plans and not mentioned in the specifications, shall be of like effect as it indicated and mentioned in both. In case of dispute or inconsistency between any plan or specification, the matter shall be immediately submitted to the Department of Public Works - 3 of C1'TY, he reinatte- r referred to as "DOW." without whose decision sai. discrepancy shall not be adjustf,d by CONTRACTOR, save only at his own risk and exoense. COMMENCEMENT OF PROJECT CON'rRACTUR agrees to commence the project with 10 calendar days after- notice o proceed is issued and sha]1 diligently prosecute. it to the comp letin- n wi thin 50 calendar days from the execution of this contract by CITY, excluding dela�,s provided for in Section 16 herein. 4. CONTRACTOR will. be granted an #',xte-nsion of time and will not be assessed with damayes for any portion of the delay in completion of t;ie work due to unforeseeable causes beyond the control and without the fault or negligence of CONTRACTOR, 9 including but not restricted to acts of God or of the public enemy, fire, floods, epidemics, quarantine restrictions, strikes, and unsuitable weather, or delays of subcOntr.actors due to such causes. CUNTRACTUk shall within fifteen (15) days from the begin- ning of any such delay (unless the DPIN shall grant a further period of time prior to the date of fina1 settlement of the contract) notify the DPW in writing of the causu of she delay, and CITY shall extend the time for completing the work if, in its judgment, the findings of tact thereon justify the delay, and its decision is conclusive on the parties hereto. Should C ONTRACTUR be delayed in the prosecution or com- pletion of the work by the act, negleCL or deta►ilt ot CITY, or should CON'rRAC,rOR be delayed waiting for materials, it said mater- ials are required by this contract to bo furnished by CITY, or by damage caused by fire or ether casualty fnr which CUNTkAC:TUR is not responsible, or by th-_• combined action of the workmen, in nowise caused by or resulting from det-au 1 t -)r- collusion on the part of CONTRACTOR, in the event of a lock(DuL b%,/ CITY, then the time herein fixed for the completion of the work shall t)e extended the number of days the CUN'rRACTOR has Lnus been delayed, but no allowance or extension shall he made unless a claL;m therefor is presented in writing to CITY within fifteen (15) days of the commencement of such delay. Nn claims for additional compensation or damages for delays, irrespective of the cause thereof and including without limitation, the furnishing of material by CITY, or delays by other - 10 - ccntractors, subcontractors or CITY will he allowed and said extension of time for the completion shall be the sale remedy of CON'rRACTUR. 17. DIFFERING SITE CONDITIONS ( 1 ) Notice. 'I'he contractor shall promptly, and before such conditions are disturbed, notify the DPW, in writing of . ( a ) subsurface or latent physical conditions at the site differing materially from those indicated in this agreement; or (b) unknown physical conditions at the site, of an unusual nature, dif.ering materially from those ordinarily encountered and generally r.ecoynizr?d ac inherent in wor': of the character provided for in this agreement. The UPW shall promptly investigate the conditions, and it it finds that such conditions do materially so differ and cause an in::rea.;e or decrease in the time required for performance of any part r,f the work under this agreement, whether or not changed as a result of seICh conditions, an equitable adjustment shall he made and the agreement modified in writing accordingly. VARIATIONS IN ESTIMATED QUAN'ri'r:E:S The quantities listed in the hick schedule will not govern final dayment . AFFIDAVITS OF SATISFACTION OF CLAIMS After the complet-on of the woO, contemplated by this contract, CONTRACTOR shall file with the DPW its attidavi.t stating that all workmen and persons employed, all firms supplying materials, and all subcontractors upon t-,RuJE;c,r have been paid in full, and that there are no claims outstanding against PRUJECT for e ither labor or materia 1 , except certa in i tems, i f any, to be set forth in an atfWavi'. covering disputed claims, or items in c;onnoction with Notices to Withhold which have been filea under the provisions of the statutes of the State of California. 23. WAIVER OF CLAIMS The acceptance by CONTRAC MR of the payment of the final certificate shall constitute a waiver of all claims against CITY under or arising out of t`iis contract. 24. INDEMNIFICATION; HOLD HARML-'SS; DEFENSE: CONTRACTOR agr.e,as to protect, defend, indemniFy and hold and save harmless CITY, its officers, agents and employees against any and ail. liability, claims, judgments, costs and demands, including death or injury to CONTRACTOR'S employees, and damage to property, arising directly or indirectly out of the obligations herein undertaken by CONTRACTOR or out of the operations conducted b.� CONTRACTOR, save and except these which arise out of the sole negligence or sole willful miscond.ict of CITY.
