WITNESSETH THAT WI-IEPEAS; City required as a condition of approval of Tentative Tract No. 61P78 that Developer construrt Fleet Lane northerly across ,one half of is a Edison Company right-of-way, and Developer has Con- strucced Tracts 6278, 6331 , and 6339 original'y Tentative 1 ract No. (?2278, in the City of Huntington Beach with the exception of that portion of Fleet Lai.e within the Edison Company right-of-way, and WHEREAS; City Mas not peen able to provide the necessary right -of -Way from the Edison Com many for the Develope r to oroceed with const-uction, and WHEREAS; Developer desires to have Tracts (27t', (3,338, and,' 633.9 aur-epte.-I by the City even though S3id construction of FIE -et Lane has not been. completed, NOW THEREFORE; in consideration cf the premises and agre:,ernents of the parties as herein set forth, tne parties -agree a� follows-, I .
