The Memorandum of Understanding defines the respective roles and responsibilities of the City of Huntington Beach, the County of Orange, and the Orange County Sanitation District regarding leading, coordinating, and managing AB411 urban runoff issues. Funding Source: General Fund Balance. No appropriation required with this RCA. Recommended Action: That the City Council approve the attached Memorandum of Understanding between the City of Huntington Beach, the County of Orange, and the Orange County Sanitation District, and authorize the Mayor and City Clerk to execute on behalf of the City. Altemative Action(s): Do not approve the Memorandum of Understanding as proposed. G I REQUEST FOR ACTION MEETING DATE: May 15, 2000 DEPARTMENT ID NUMBER: Analysis: The City of Huntington Beach began to meet with the County of Orange and the Orange County Sanitation District in August of 1999 to work cooperatively on the issues associated with the implementation of AB411. Since that time, it has been clear that the three agencies would benefit from the adoption of a Memorandum of Understanding (MOU) which defines and delineates the roles and responsibilities of the respective governments. The MOU provides for the. County to serve as the overall lead on issues related to implementation of AB411 _ Each agency will pay its fair share toward those costs associated with its role and responsibility. This is the first MOU between the County of Orange and any subregion of the County. The City's role and responsibility is comprised of remediating causes of urban runoff within its own facilities and hosting informational sessions for other governmental agencies on the issues relating to Huntington Beach. The City Administrator is also co-chairing an Orange County City Managers' Task Force with the City Manager of Laguna Beach. Environmental Status: Not applicable. Purpose Statement The purpose of this document is *to clarify roles and responsibilities of the County of Orange, the City of Huntington Beach and the Orange County Sanitation District with regard to coastal water quality and urban runoff management studies. Ongoing Studies The County of Orange, City of Huntington Beach, and Orange County Sanitation District, together with the National Water Research Institute, contracted with UCI to perform sampling studies to determine whether urban runoff from the Talbert Marsh is a predominant source of contamination to local coastal waters. In addition, the three agencies have jointly contracted with two consulting firms in a cooperative study to expand on the work accomplished by others, investigate further the experiences of the summer beach postings/closures of 1999 and develop specific corrective actions. Action Plan The County of Orange will take the lead role in the development of watershed study groups, and in securing partnerships and financial commitments from cities, the state and federal government. The County of Orange will review and coordinate the ongoing study efforts. All agencies will work to garner legislative and fiscal support from the State and Federal governments to further local efforts. Roles Solutions to coastal water quality problems are regional in nature, and require action from a variety of entities. Therefore, the three parties to this memorandum agree to the following roles: COUNTY • Subject to the approval of the Board of Supervisors, the County of Orange will provide its fair share of financial support. 04/2010010:27 ANICATENINMEMORANDUM Of UNDERSTANDING.doc i • The County of Orange will continue in the lead role in coordinating with its NPDE:S co-permittees on urban runoff issues. • The County of Orange will assume the lead role in the development of a remediation action plan to provide recommendations for any regional measures to address needed coastal protection enhancements identified as a result of direct urban runoff or due to unique geophysical factors contributing to beach closures and/or postings caused by excessive bacteria levels. • The County of Orange will take the lead in working cooperatively with other agencies to support additional methods for educating the public about the impacts of urban runoff. • The County of Orange will participate in urban runoff educational sessions for city and special district staff members. • The County of Orange will host urban runoff education sessions for elected officials. CITY • Subject to the approval of the City Council. the City of Huntington Beach will provide its fair share of financial support. • The City of Huntington Beach will assume the lead role in the development of remediation actions required for maintenance and modification of City sewer and local drainage infrastructure. • The City of Huntington Beach will assume the lead role by hosting urban runoff educational sessions for city and special district staff members. • The City of Huntington Beach will work cooperatively with other agencies to support watershed planning and additional methods for educating the public about the impacts of urban runoff. SANITATION DISTRICT • Subject to the approval of its Board of' Directors, the Orange County Sanitation District will provide its fair share of financial support. • The Sanitation District will coordinate with its member agencies, including the City of Huntington Beach and the County. and with other agencies on urban runoff issues and ,%.ork cooperatively to support requests for diverting dry season runoff to the sanitary sewer system. • The Sanitation District will participate in and work cooperatively with other agencies to support watershed planning and additional methods for educating the public about the impacts of urban runoff.
