DISTRICT; o.politieal subdivision of the State; of California, FOUNTAIN VALLEY SCHOOL DISTRICT, apolitical subdivision of the Stato of California, rESTMINSTER SCHOOL DISTRICT, apolitical subdivision of tho Stnta of California, and WNTINGTON BEACH SCHOOL DISTRICT, apolitical subdivision of the State of California �areinafter collectively sometimes referred to as Jistfl cts" , W I T N E S S E T H: WHEREAS, the parties hereto desire to promote and preservo the health and general welfare of the peop1L of the City of Huntington Beach, the Oceqn View School District, the Huntington Oench Union High School District, the Fountain Valley School District, the Westminster School District, and the Huntington Beach School District and to cultivate and develop good citizenship by providing for an adequate program of community recreation and to conduct such a program of comnunitV recreation as will. contribute to the attainment of genarnl educational and recreational objectivns for the children and adults of said city and said school districts; and WHEREAS, the parties hereto desire to cooperate with each other to carry out the provisions of Chapter 6, Division 12 of the Educational, Code of the State of California, and to that end enter into an agreement with each other to organize, promote and conduct r3 ,;oint program of community recreation to promote and preserve the health and general welfare of the children and people of said city and school districts, NOWt THEREFORE, for and in consideration of the mutual covenants and promises of the parties hereto, it is hereby agraed and understood by and between them as fol�.ows: The Districts shall make available to the City: a. All permanently oparatvd playground irons that are suitable for community recreational activities, these areos to ba salectad by the Director of recreation IParks of the City of Huntington Beach and approved by mutual agreement of the City Administrator and the Superintendents of the pertinent Districts. b. The Districto further agroo to allow th© City to utilize other selected school facilities for community rixroational progrnrms under the game method of selection as sot north in "a" abavu. c. Municipal use of school facilities shall be in -accordance with pertinent district policieu in granting permits for non -school use of facilities d. Schedules for use of said facii: sir f,. Community recreational activities shall be established by the Director of Recrention and Parks and approved by pertinent District Superintendents or designated representatives. IT IS FURTHER AGREED: 1. That when an admission charge is made to cover expenses only for a com- munity recreational event in a selected school fecility, there shall be no rental fee charged to the City. Further, that all foes and charges assessed for programs scheduled under this Agreement shall revert to the City General Fund. 2. That in advance scheduling use of school facilities, all conflicts between Districts and City be cvoided; school, programs and events and required maintenance shall have first priority. The community recreational program shall have second priority, except that the Huntington Beach Union High Sch.,ol District reserves the right to schedule the use of facilities in fair proportion for other public agencies ocrving portions of the area of the high school district. -3. That the advance schedules may be altered at the request of either party by mutual consent.- 4. That the Recreation and Park Director shall select and provide certain qualified personnel to conduct recreational activities and events which take place after school hours, on w2ek-ends, and during holiday and vacation periods are the above selected district facilities. 5. That all personnel employed to conduct community recreational activities shall be under the supervision of the Diructor of Recreation and Par'.s and shall be employed at salarias and wage ratas prescribed by said Recreation & Perks Director. Sold wages and salarico shall be paid from +hc City Generel Fund con- tributed to by the pertinent nch:231 districts and the City of Huntington Beach. This fund shall be administered by the City of Huntington Beach. 5. That the school principals of selected schools shall be consulted and advised as to recreotional activities conducted by the Recreation Commission on Facilities under said principals' jurisdiction. IT 15 RCCGGNIZEG BY THE P.IRTICS that school properties and facilities are intended for school use and for the benefit of children of school age. It is therefore agreed that in program planning and scheduling , the loisurv. needs and opportunities of such children shall be provided for first. IT 15 FUPTHER %GRC,.'LD that tha City shall provide Certain expendable materials :end supplies noces.sary for conducting community recreational programs for all ages. Those supplies and materiels shall be provided through the aforementioned City Gcanarnl Fund contributed to by agreeable partics. It is also agreed that certain equipment, as specified by the pertinent District Superintendent, provided as part of the school program and suitable for community recreational use, and that certain equipment and supr--lies provided by the Recreation Commission and suitable for school usa, shall b3 mutually intarchange3ble for the common use of both parties. IT IF UNOLOSTGL�D AND AG�IRLED that the school district shall provide custodial and maintenance sorvices for all school focilities utilized fnr community recreaw tionol programs, except in certain hardship canes created by events or programs conducted by the City. In such cases, the city maintenance personnel, upon written request by the Schcol Superintendent, shall assist in inordinate mainten- ance and custodial dutiev, - 2 - 0 1 re f r ! r IT 10 FU12THER L'fC,GR2;Ti:0 FWD th-it the administrative authority for the total progrnm shall ba tha Rccreation and Parks Director of the Uity of Huntington Beach. He shall b=e o saisted by an advisory Racrootion Commission which shall be composed of five mcmbc;s at large, serving four year terms, and one member representing each of the four school districts, serving one year terms, all appointed by the Mayor of the City with the approval of the City Council by majority vote. all terms of apl-.ointme:nt shall run concurrently with the fiscal year beginning July 1 and ending Juno 30. Goch participating school district board shall recommend two or more candido4r:s rrapresenting their district to the M-Ayor by the third 1Y1anday of June aach year, one of which sha17 ba aplaainted by the Mayor, with the mnjority consent of this City Council to fill the term of the District Reprrsontative, In the event that any District shall not make such racommcnddtions to the Mayor by the first day of July, than the Mayor, with the approval of the City Council, may appoint some qualified person to a one (1) year term to represent such District on the Recreation nnu Parks Commission. Further, any mombers shall be privileged to voluntarily retire from the Commission at onV "tim u, successors to be appointed as previously described, and also in the event of other occurring vacancias from whotever cousu, by the Mayor, with the opprovnl of the City Council by majority vote for thca unexpired terms of office-_. Members may be reapf.ointed by the flayor, with Council approval, for ;is many terms of officr= as .is desirable. The Mlayor shall be ex-officic mcrrbar of said Commis- sion. 1111 ►nembers of such Commission shall receive compensation for their sor- vice, the Cum of 15.00 for each monthly Commission mc; ting attanded. No compensation shall ba giver for adjourned or spacial m-:ctings. It is understood that operation of individual programs on school grounds shall ba supervisod by Recreation Supervisors responsible to the Director of >iecreation and Narks. U,e of school vehicles for the purpose of 4ransporting recreational program { participants oil nprroved trips and excursions shall be governed by pertinent district policy, and final decisions as to the racreational use of sold vehicles shall be at the discretion Pf the pertinent District Superintendent. Use of school vehicles for the purpose of transporting recreational program participants on approved trips and excursions shall be governed by pertinent district policy, and final decisions as to the recrea- tional use of said vehicles shall be at the discration of the District Superintendent.
